All interest In and to all right to acquire title to the property which is the subject of this escrow. 2. All funds now on deposit to the account of the undersigned in this escrow. No consideration is to be paid to the undersigned through this escrow for or on account of this agreement. Agreement: iT IS AGREED BETWEEN City of Redlands, a municipal corporation, as Seiler and Patrick O'Brien, as Buyer and Balboa Park Properties, LLC as Assignee, with respect to the Purchase and Sale Agreement And Joint Escrow Instructions dated November 1, 2016 in Escrow No. NCS-818580-ONTias follows: 1. Seller hereby releases Buyer from all claims and demands against Buyer with respect to the Supplemental Escrow Instructions and accepts assignee in place of Buyer as the substituted party to said escrow instructions and hereby agrees with Assignee to be bound by the terms of the escrow instructions in all respects as if Assignee was originally named therein as a party in place of Buyer. 2. Assignee agrees to perform in accordance with the escrow instructions and to be bound by all terms thereof in all respects as if he were the original party to the escrow instructions in place of Buyer. 3. In the event of cancellation of this escrow, funds to be returned to non-defaulf;ng buyer, if any, less costs, if any, shall be forwarded to new buyer (assignee) as shown herein. The above named Assignee have received, read and familiarized themselves with the original escrow instructions dated November 22, 2016 , and hereby approves same in their entirety along with any and all amendment(s) to said escrow instructions, and request that you proceed therewith on their behalf. Any deposit in this escrow shall be used for the benefit of the Assignee named herein. In the event of cancellation of this escrow, funds to be returned to non -defaulting Buyer, if any, less costs, if any, shall be forwarded to new Buyer(s) (Assignee(s)) as shown herein.
