EASEMENT made this 01th day of December
1976, by SANTA FE IMPROVEMENT COMPANY, a Cala.-
fo=a corporation, hereinafter designated "Grantor",
to CITY OF REDLANDS, a municipal corporation,
hereinafter designated "Grantee".
FOR A VALUA= OC3NSiDEPATIoN, Grantor hereby grants and conveys unto
Grantee a nonexclusive pipe-lam easement over that certain real property in the
City of Redlands, County of San Bernardino, State of California, described as
follows:
A 30-foot-wide strip across that portion of Lot 10
of the Orange Grove Homestead as recorded in Book
No. 2 of Mapps. Page 5, of the official records of
San Bernardino County, California, said strap being Col
between the east right of way of YgDuntain View Avenue
and the north right of way of Lugona_a Avenue and
being northeasterly, parallel and adjoining the
northeasterly right of way of The Atchsicn, Topeka
and Santa Fe Railway Corpany.
EXCEPTTW- AND RESEWMSG the right to be exerca_sed by Grantor and by
any others who have obtained., or may obtain, permission or authority from Grantor
so to do, (a) to operate, maantain, renew and/or relocate any and all existing
wares, pipes and other facilities of like character upon, over or under the
surface of the hereinabove-described premises; and (b) from time to time to
construct, operate, maintain., renew and/or relocate upon said premises addi-
ta_onal facilities of the character described in Clause (a) of this paragraph,
consistent with the rights granted herein, without an any instance being
required to obtain the consent of Grantee, the Sara as of this easenent. had not

purposes so long as the premises hereinabove described shall be so used, subDect,
however, to all licenses, leases, easements, restrictions, reservations

title which may in any wise affect the said premises and subject, also, to the
express condition subsequent that if said premises, or any portion thereof,
shall cease to be used for the purposes above stated, then and in that event,
the easement hereby given shall, as to such portion or portions, as the case
Y be, thereupon cease and determine and Grantor, its successors and assigns,
shall resume possession thereof the same as though this instrument had not been
executed.
This easement is given without warranty of title of any kind, express
or implied, and no covenant or warranty of title shall be implied from the use
Of any word or words herein contained.
in case of the eviction of Grantee by anyone owning, or claiming title
to or any interest in, the premises hereinabove described, Grantor shall not
be liable to Grantee for any damage of any nature whatsoever.
