HomeMy WebLinkAboutContracts & Agreements_5-1937 37 2Dti OC 1084 A .......... ................. e&e If etl q, ni This Agreement made and entered into this 23rd day of April 1937, by and between the PACIFIC ,1 LECTRIC RAILWAY CO-U'ANY, a corporation, first party, and the CITY OF REDLANDS, a municipal corporation of the State of California , second party. 1,1ITNESSETH: 1. Second party agrees to furnish ail labor , materials , tools and equipment necessary, and to mix and lay approximately 43,000 square feet of "oil mix" on San Bernardino avenue between Tennessee and Orange Streets, in the City of Redlands, San Bernardino County, California , the same being on a portion of the street nine (9 ) feet in width, now occupied by tracks from Tennesee Street to Clay Street, and from which tracks have been removed from Clay Street to Orange Street. 2. First party agrees to pay to second party for such work and materials , three (3¢ ) cents per square foot. - 3. It is further understood wed agreed that all vvoTi, I" and materials used under this agreement must be in accordance with the specifications of the City of Redlands, unless otherwise ordered by first party and must be sati sfe.ctory to the Chief Engineer of the fi rst party or his authorized representative and is subject to his inspection and approval. 4. Second party agrees to do any work provided in this agree- ment promptly upon notice from first party. 5. Second party agrees to save first party free and harmless from any and all personal injuries to or death of employes of the first ` party, or for personal injuries to or death of any person or persons whatsoever or damages to property arising out of or resulting from said work to be performed under this agreement. 6. Second party agrees to save and hold first party fres q4 and narmle ss from any and all liens or claims of liens of laborers and mechanics, end for material furnished under this agreement, 7, It is further understood and agreed that payments for the pavement laid by second party under this agreement shall be made by first party vel thin thirty (30) days after the completion and acceptance of said work. It is further understood and agreed that second party has by careful examination satisfied himself as to the nature and location � of the work, the character, quality and quantity of the materials to be encountered , the character of equipment and facilities needed prelim- inary to and during the prosecution of the work, -'Ehe general and local conditions and all other matters which can in any t�!ay affect the work under this agreement .
