UL[LJS V PATROSS❑ 2670 CANTERSURY ROAD SAN MARENa, CALIFORNIA 91108 1.1/21/72 Alice G. Walls, Deputy City Clerk, Redlands, Cal 92373 T acknowledge receipt of your letter of November 21., enclosing copies of letters of your City Clerk address- ed to the Board of Supervisors re the parcel of pro- perty jointly owned ja y by myself individuAly and my deceased brother Louis J. Patrosso' of whose estate T am executor, conveyed to the City of Redlands. T notice that in the copies of the letters of the City Clerk to the Board reference is made to two deed, one executed by myself and an6ther executed by my wife Georgia. Tn addition to these there was delivered to City Attorney Edward Taylor another deed executed by myself as Executor of the Estate of Louis J. Patrosso pu suant to an adef; of the Superior Court of Los Angeles County, certified copy of which accompanied the deed. The property of which the parcel conveyed was a part, as shown on the 1972/73 tax bill is assessed to Louis J. Patrosso and myself under parcel, number 174 161 34, Assessment #93859. While apparently the deeds were not recorded by the City they were in fact forwarded by my c6unsel to Mr. Taylor on JULY 30, accompanied by a letter from me setting forth the conditions upon which the same were delivered to the City which included the following that , as set forth in the deeds , the same were subject to 1972/73 taxes, and that "the City take timely action t6 have the property conveyed to it separatly assessed from the re- maining portion of which it is now a part to the City for 1972/73 taxes. " Not hearing to the contrary, 1 has assumed that the deeds were re- corded promptly and in due course, and that the City had complied with its obligation to have the parcel separately assessed until 1 .received the current tax bill, and,as it did not contain a description of the property, T addressed a letter to the County Assessor requesting that he advise rye whether or not the property conveyed to the City had been eliminated to which l received a reply in the negative. Under the circumstances T do not believe we should be penalized by bung obliged to pay any portion of the tax applicable to the property con- veyed to the City as a result of its failure to comply with its express agreement pursuant to which the conveyance of the property was made . Alice G. Walls -2- I would therefore request t1lat this matter be referred to the City Council or other appropriate official to take the necessary action to relieve us of any obli- gation to assume my portion of the 72/73 taxes on this por=tion of the property. Respbtfully' CC , Edward Taylor, City Attorney
