A GRE E M E N T

3 This Agreement made this 20th day of august, 19402 by
and between the Redlands Country Club, a corporation, party of
4 the first part, and the City of Redlands, a municipal eorp*
5 ®ration, party of the second part;
1 SETH. That whereas the said party of the first
6 part owes and is indebted to the City of Redlands, party of
the second part, for a delinquent water account in the amount of
7 01688.53 as of July 20th, 1940, for water supplied and
furnished, the party of the first part hereby covenants and
8 : agrees with the City of Redlands, party of the second part,
to pay this delinguezzt water account as follows:

The party of the first part hereby agrees to pay the
10 sum of 554.00 on account of said obligation herewith on
the execution of this agreement, and to pay the balance of
11 $1338.58 in monthly installments of $37.20 payable on the lst
day of each and every month until the said indebtedness is
12 ° paid in full, the installments to begin on the 1st day of
November, 1940.

And the party of the second part, the City of Redlands,
14 ; in consideration of the said covenants on the part of the
party of the first part hereinbefore contained, gees to
15 accept such an amortization of the obligation of the said
&eliaq„uent water ageount.

And whereas the said City of Redlands believes that the
17 golf course of the said party of the first part is an asset
and is of general Value to the city as a whole, the City of
18 Redlands hereby covenants and agrees, under certain terms and c
conditions, to pr ote th i if course by contributing
19 the sins of 0500, . or es for said course to the
'party of the first part from its Masie and Promotion .Fund, in
20 manner following- By monthly contl*ibutions of 42.50 made on
account of the current monthly water bills of the party of the
21 first part, such contributions to begin on the lst day of October,
1940, the contributions to be made on November lst, 1940, and
22 thereafter to be made simultaneously and contingent on the party
of the first part making payments in cash to the City of Redlands
23 of the balance of the current monthly water bill, such payments
to begin on November lst, 1.940. And also on condition that the
24 : Redlands Country Club, the party of the first part, popularizes
the said golf course and makes the said course available to the
25 general public at a green fee of fifty cents per person on a week
i day and a green -fee of sevenjy~�fi:ve° aenta per person on Saturdays,,
26 Sunday's and Rolida.ys, the number of such fees allowed any one
person to be limited to two tines a month, Farther that the golf
27 course be promoted and advertised on this basis, and that the said
Club endeavors to have the Chamber of Commerce duly promote the
28 said course as a community recreation affair. And whereas the sai
Redlands Country Club, party of the first part, desires the said
29 contribution of the sum of 500.00, the said party of the first
part hereby covenants itself to carry out the terms and provision
30 as herein set forth. It is understood and agreed that the said
Country Club will maintain the same right to refuse admission to
31 play to anyone that is reserved by all public courses in Southern
California.

I The party of the first part hereby covenants and agrees
to mare payment of each month' s current water bill, less the
2 $42.50 city contribution credit , on the lst day of each month,
beginning on November lst, 1940, and this payment is in addition
3 to the amortized installment payments on the delinquent account
as above set forth

The party of the first part hereby covenants and agrees to
5 pay to the party of the second part the sum of $100,00 on
October lst, 19402 on account of its current city water bills
6 for the months of August, 1940, and September, 1940, and to pay
the balance of said August and September 1940 water bills in four
7 equal installment payments to be paid on the lst day of January,
of February, of March, and of April in the year 1941, It being
8 expressly understood and agreed that the said four equal
installment payments are to be made in addition to the then
9 current water bills and the installment payments on account of
the now delincuent water account.

It is hereby understood and agreed that should such money
11 installments and payments be not made as herein covenanted by saiA
party of the first part, interest shall be charged at the rate
12 of six per cent on delinquent installments and payments, and no
further credits of $42,50 will be made on the current water bill
13 for this year by the party of the second part, the City of Redlands.
14 IN WITNESS WHEREOF, the Redlands Country Club, the party
of the first part, a corporation, has caused its corporate
15 name to be hereunto subscribed and its corporate seal to be
affixed hereto this day of August, 1940, and the City
16 of Redlands, a municipal corporation, the party of the second part ,
has caused its corporate name to be hereunto subscribed by the
17 Mayor of said City and attested by its City Clerk and caused its
corporate seal to be hereunto affixed thisday of August,
