4 THIS AGREEMENT, made and entered into , in duplicate , j

5 this day of April, 1942, between the STATE OF CALIFORNIA
6 acting by and through the Department of Public Works, Division of
7 Highways , hereinafter for convenience referred to as "THE STATE" ,
S and the CITY OF REDLANDS, hereinafter for convenience referred to
9 as "THE CITY" ,

ZZ W I T N E S S E T H:
12 WhTREAS, the California Highway Commission on
13 November 28, 1941, adopted a Resolution declaring the following
14
section of State Highway Route 26 to be a freeway:
15 That portion of State Highway Route 26, as same
is shown on the general route map thereof adopted by
1f the California Highway Commission on November 28, 1941,
which general route map is on file in the office of
17 the Department of Public Works at Sacramento, California,
18 between the north right of way line of Fern Avenue and
a aoint opposite City Reservoir and that portion of
19 State Highway Route 26, as same is shown on the general
route map thereof adopted by the California Highway
20 Commission on November 5, 1937, which general route map
is on file in the office of the Depr�artment of Public
Works at Sacramento , California, between a oint
21 opposite City Reservoir and the east city limit of the
2P City of Redlands ; and
23 WHEREAS, this agreement is to cover that portion of
24 said freeway lying between the north line of Fern Avenue at
25 Engineer 's Station 472+40 and Engineer' s Station 543+00; and
26 WHEREAS, plan maps for such freeway have heretofore
27 been prepared showing the proposed plan of the State as it
28 affects City streets ;
29 NOW, THEREFORE, IT IS AGREED;
30 (1) THE CITY agrees and consents to the construction affectin

I City streets , all as shown on the plan ,map hereto attached,
2 marked Exhibit "A" and made a part hereof by this reference .
3 (2) THE STATE in the construction of said freeway will , out
4 of funds available for expenditure on State Highway routes , make
5 such changes affecting City streets in accordance with the said
6 plan attached hereto, or as the sante may hereafter be modified by
7 subsequent agreement between the parties hereto.
8 (3) This agreement may be modified at any time by the mutual
9 consent of the parties hereto as may become necessary for the
10 best accomplishment through State and City cooperation of the
11 whole freeway project for the benefit of the people of the State
12 ' and of the City.
