2 This Agreement, made and entered into this ,� day of
3 February, 1935, by and between the City of Redlands, a municipal
4 corporation of the sixth class, party of the first part, and
5 Vau, h L. A1chi.an, of San Bernardino , California, party of the
6 second -parts
7 WHEREAS, the party of the second part has requested of the
8 party of the first part an extension of that certain agreement mi
9 dated the 1st day of November, 1933, by and between the said part,
to of the first part and the said party of the second loart pertain-
11 ing to garbage and rubbish collection and disposal, which said
12 agreement terminates on the 31st day of December, 19388 to the
13 31st day of December, 1943,
14 ,AND WHEREAS , at a regular meeting of the City Council of th.
15 party of the first part, regularly held on the 20th day of Febru-
16 ary, 1935s by resolution of the said City Council, it did resolve
17 that the aforesaid agree)iaent pertaining to garbage and rubbish
18 collection and disposal shall be extended to and including the 31
19 day of December, 1943, upon the same terms and conditions and cov
20 pants as in the aforesaid agreement contained,
21 AND WHEREAS, the party of the second part has a certain lea
22 or agreement, between the said party of the second part and the
23 said party of the first part, dated the 1st day of November, 1933
24 pertaining to the Leasing of the Redlands City Dump Ground from
25 the lst day of January, 1.934, to and including; the 31st day of
26 December, 1938, and that said agreement contains an option to be
27exercised by the party of the seond part expending said lease or

agreement for an additional five years from the date of theter-

urination thereof , if the exercise of said option is mutually afire
30
able to both the party of the first part and the party of the
31
second part, and party of the second part did inform the party of
32
the first part that party of the sedond part was desirous of
I exercising the aforementioned option at this time,
2 AND WHERFAS, at a regular meeting of the City Council of the
3 party of the first, part, regularly held on the 20tlh day of Februar
4 1935, by resolution of the said City Council, it did resolve to e�'I
5 t'.nd,and accept the exercise of the aforementioned o})tion containe
6 ,in said lease agreement upon the Redlands City Dump Ground and the
7 said lease agreement to and including; the 31st day of December, 1�
8 upon the same terms, conditions and covenants now contained therei
9 NOVO' THEREFORE, WITNESSETH:
10 TLat it is mutually agreed by and between the party of the f'
11 part and the party of the second part, in consideration of the pri
12 ises , that the said agreement by and between the party of the fir;
13 part and the party of the second part, dated the 1st day of Novem_
14 1933, pertaining to garbage and rubbish collection and disposal,
15 hereby extended from the date of termination tliereof as provided
16 said agreetnent, to , to and including the 31st day of December, 194
17 the same terms, conditions and covenants, now contained therein,
18 the part of each party to be performed, to be in bidding force an
19 effect to the said extended date of termination.
20That it is further mutually agreed by and between the party
21 the first part and the party of the seond part, in consideration
22 the premises, that the lease agreement by and between the party c
23 the first part and the party of the second part pertaining to the
24 Redlands City Dump Ground, herein referred to, dated the lst day
25 of J� ovember, 19339 is hereby e'Ltended from the date of terminatic

27 of December, 1943, t=he same terms , conditions and covenants, now
28 contained therein, on the part of each party to be iDerformed, to
29 be and remain in binding force and effect to the said extended
30 date of termination.
