HomeMy WebLinkAboutDeeds & Easements_34-1971E EASDUNT THIS AGREEMENT, made and entered into this day of November 19 71, by and between The Redlands Security Company , hereinafter called "Security" , their heirs, executors, administrators, agents or assigns, and the City of Redlands, a municipal corporation of the State of California, hereinafter called "City" , its assigns and successors in interest. WITNESSETH: whereas, City has title to and owns that real estate and real property located in Redlands , County of San Bernardino, State of California, hereinafter called the "Property" and described as follows - All that portion of the 14 foot wide alley running east and west through Block 7, Town Plat of Redlands, as re- corded in Book 5 of Maps, Page 10, in the office of the County Recorder, County of San Bernardino, State of California, lying northerly of the following described line. Beginning at the point of intersection of the southerly lane of the said alley and the westerly line of Orange Street, Said point being 10 feet west of the northeast corner of Lot 1 of said Block 7 . Thence, westerly along the said south line of the alley 111.35 feet. AND WHEREAS, City desires to grant an Easement to Security. for the sole purpose of construction of a canopy and new brick veneer facing on the north wall of the La Posada building at EASEMENT - 2 12 1/2 State Street, Redlands, California, said canopy and new brick veneer facing is shown on Exhibit "A" attached hereto and incorporated herein by reference. NOW THEREFORE, it is hereby agreed as follows The City does hereby grant, assign and set over to Security an easement as follows: An easement over the southerly twenty-four (24) inches of the "property" , L"asement granted herein shall be revoked in the event city or its successors or assigns, in their sole discretion con- struct any structure on the property. Security agrees, in this event upon receiving thirty (30) days written notice from City, its successor ' s or assigns, to remove, without delay, at Security' s sole expense, all structures which were constructed to permit. Security ' s use of said easement. Easement granted herein shall take effect upon completion by Security of all of the improvements to the north wall of the said La Posada building, as shown on Exhibit "A" hereto. In the event that all improvements to the north wall of the La Posada building have not been completed by February 29, 1972, the easement granted herein shall be null and void.
