RE: Hagy Lease on Highway 99 Property.
Dear Mr. Whaley:
Please find enclosed the City*s Copy of
the H. C. Hagy Lease for the City Clark's records. This
Lease was authorized by Council Action in January of this
year and has only been recently executed and completed.
Enclosed is Mr. Hagy's check to the City
Treasurer in the amount of 4416.65 covering tLe first five
(5) Months rental.

3 This INDENTURE, made this 17th day of January, 1946, between
4 the City of Redlands, a municipal corporation, Lessor, and H. C .
5 Hagy of the City of Redlands, California,
6 WITNESSETH:
7 That for and in consideration of the
payment of the rents and
S the performance of the covenants contained herein, on the part of
9 the said Lessee, and in the manner hereinafter specified, said
10 Lessor does hereby lease, demise and let unto the said Lessee
11 that certain real
property, ovmed by said City of Redlands, and
12 situated in the City of Redlands, County of San Bernardino, State

of California, described as follows , to-wit.

of each year of said term to be payable in advance on the first

And the said Lessee does hereby promise and agree to pay to

the said Lessors the said rent, herein reserved, in the manner

Lessee agrees to construct on said above described demised

premises permanent ir�provements thereon at a minimum cost of Five

Thousand Dollars ($5,000.00 ) , and it is mutually agreed, and

covenanted by Lessee, that all such permanent improvements are to

become the property of said City of Redlands at the termination of

2 It is mutally agreed that should default be made in the pay-

vent of the rent when due as hereinbefore set forth, said Lessor,

5 " possession of said premises, remove all persons therefrom and at

7 Lessee agrees to conform with all government laws and regulations
8 and ordinances with regard to and pertaining to the use of said
9 dem:.sed premises by him and agrees to commit no nuisance on said
10 promises.
11 Lessee agrees to pay all utility charges against said demised
12 premises , all personal property taxes and any county real estate
13 taxes on said property.
14 Lessee may not sublet all or part of the demised premises, or
15 assign the within lease without the official consent of said lessor.
16 Lessee agrees not to hold the said Lessor, the City of
17 Redlands, liable for any loss, injury or damage which mai arise
from any cause whatsoever up94 or shout said demised premises

to any person, or persons, Which may be caused. by the negligence
20 or any act or omission of the Leseee.
21 At the expiration of said lease, the Lessee is hereby given
22 the option of renewal of said lease for an additional five (5)
23 year period at a rental to be negotiated and determined at that
24 time providing the City Council desires the property to be continued
25
to be rented for a nursery business, and Lessee is hereby given
26 the option to purchase the property at the same price as any bona
27 fide offer for said property providing the City Council wishes to
28 sell the property during the term of the within lease or its
29 renewal.

32 Lessor, its officers or agent, to re-enter the said premises and
