This AGTREillvE T, made and entered into this f�day of August , 1947, between the City of Redlands, a municipal corporation, First Party, and the Lamb Transportation Co . , of Longi, Beach, California, Second Party, 1ITNESSETH- That 6hereas the City of Redlands issued a Notice Inviting Sealed Bids for the furnishing, d.elivering and spreading of various types of road oil to said City on duly 3rd, 1947, and whereas the Second Party presented the bid accepted by said City, Now, Therefore, the said City, the First Party, and the Lamb Transportation Co. , Second Party, have agreed the one with the other that the said Second Party will furnish, deliver and./or spread various types of road oil for the said City of Redlands, for the following consideration, which First Party agrees to pay: SC-3, 4 and 5 road oil---15 .60 per ton, delivered into a mixing machine. SC-6 road oil-----------619.30 per tor., delivered and spread €with Etnyre two-man operating spreading units eq,uiped €��ith full circulating bars and retorts fox raisihg the. temperature , of the road oil if required. M'C-3,Zr and 5 road oil-- :`16.62 per ton, delivered into mixing machine . FOR THJE TEE coim'oencinZ as of Chis day and continuinS for the balance of the Fiscal Year ending Tune 30th, 1948. And it is further agreed that two(2) hours free time will be allowed for unloading or spreading eac'ii delivery, and that tir-n:e consulaed in excess of the free time in unloading deliveries of SC-3, 4, 5, MC-3, 4 and 5 €All be charged for on the basis of X5 .50 per hour, and that time consumed in excess of the free time in spreading deliveries of SC-6 will be charg- ed for on the basis of 86.50 per hour. (l) And it is understood, and agreed by the Second Party that all and each of the costs for its services of furnishing, delivering and/or spreading road oil as hereinbefore set forth include the California Sales Tax and all other applicable taxes. It is further understood that such costs are based on minimum truck and trailer load deliveries of eighteen (18) tons . It is further agreed by the Second Party that all types of road oils used by said Second Party in the performance of the within contract shall conform to the State Highway Specifications of 1945 of the State of California. And Second Party agrees to keep its equipment in a satisfactory condition and agrees to bear the expenses of any delay as a result of faulty equipment. In Witness Whereof, said First Party has hereunto caused its corporate name and seal to be affixed by its officers thereunto duly authorized, and the Second Party has hereunto caused its name to be affixed thereto.
