7 SOUTHERN CALIFORNIA EDISON COMPANY, a California
8 corporation, hereinafter referred to as Grantor, hereby grants to
9 the CITY OF REDLANDS , a municipal corporation, hereinafter
10 referred to as Grantee, an easement for drainage purposes , in,
11 on, over, under, and across that certain real property in the
12 City of Redlands , County of San Bernardino, State of California ,
13 described as follows :
14 That portion of Lot 2 of Block 18 of Smith's
Subdivision No. 52 as per map recorded in Book 15 ,
15 page 35 of Maps , in the office of the County

Recorder of said County, described as follows :

SUBJECT T0: Covenants , conditions , restrictions,
5 reservations , exceptions, easements and rights , whether
of record or not, affecting the above described real
6 property, including, but not limited to, those described
7 in the within easement grant.

9 !I The foregoing easement grant is made in consideration.
of and subject to the following terms, covenants and conditions -
10 1. Grantee agrees to maintain a minimum clearance of

11 not less than fifteen (15) feet between all construction or other
12 equipment operating on the easement area and all overhead
13 conductors.
14 2. Grantor reserves the right to use the above
15 described real property for any and all purposes , and in any and
16 all manners , that will not unreasonably interfere with the rights
17 granted hereunder.
18 3. Grantee agrees for itself, its successors and
19 assigns , to defend at its own cost, to indemnify, and to save
20 harmless Grantor, its successors and assigns, to the fullest
21 extent it may legally do so, from and against all expenses,
22 liability, claims, losses , damages , causes of action., or actions,
23 arising out of loss of or damage to property, including, but not
24 limited to, property of Grantor, or injury to or death of persons,
25 including, but not limited to, employees or agents of Grantor,
26 resulting in any manner whatsoever, directly or indirectly, by
27 reason of the exercise of rights granted hereunder.
28 4. Grantee agrees that the public improvement for which;
29 purpose this easement is granted, regardless of the time done,
30 shall be done without any cost or expense to Grantor, its
31 successors and assigns , and in the event a special assessment is
32 levied against the real property of Grantor, its successors and

I assigns, for the public improvement for which purpose this
2 easement is granted, Grantee agrees that it will- reimburse
3 Grantor, its successors and assigns, for the full amount of any
4 such special assessment. Grantee further agrees that the public

5 improvement for which purpose this easement is granted shall be
6 maintained by Grantee without any cost or expense to Grantor, its
7 successors and assigns.
8 5. The above described real property is to be used
9 only for the purposes herein specified, and in any event said
10 real property is not so used, or the improvement for which
11 purpose this easement is granted is abandoned, said easement
12 ! shall thereupon be terminated, and Grantee shall thereupon
13 execute a quitclaim of said easement.
141 6. It is expressly understood and agreed that this
15 easement is granted pursuant to the authority of and subject to
16 ': the conditions prescribed by General Order No. 69-B of the Public
17
Utilities Commission of the State of California dated and i
18 effective September 10, 1963, which General Order is by this
19 reference incorporated herein and made a part hereof.
20 IN WITNESS WHEREOF, Grantor has caused its corporate
21 name and seal to be affixed hereto and this instrument to be
22 executed by a Vice President and Assistant Secretary thereunto
23 duly authorized this day of 1970.
