2 SECOND AMENDI4+fENT TO RIGHT OF 'NAY CONTRACT

4 VVIMEAS, the CITY OF REDLANDS, a municipal corporation,
5 and the STATE OF CALIFORNIA, acting by and through the Department
of Public Works, Division of Highway
6 s, have heretofore entered
7 into that certain Right of Way Contract dated June 2, 1953, which
9 set forth the terms and conditions under which the State acquired
9 certain rights for State highway purposes described in Grant
10 Deed 4302-B,C; and
11 NIM,7AS, said parties have also entered into that cei fain
12Amendment to Right of V.Jay Contract dated September 1, 1953,

13 1i which sets forth further terms and conditions to do with the

14 subject :natter covered in the above referred to Right of Way Con-
15 tract dated June 2, 1953; and

1e VVIEREAS, Paragraph 3 of the above mentioned Right of Way
17 Contract dated June 2, 1953 and restated in said Amendment to
18 Right of lVay Contract dated September 1, 1953, provides in part
18 as follows:
20 "'Nithin one (1) year after approval of this Contract
the State shall drill a well on grantor 's remaining
21 property that will produce a quantity of water
equal to, or greater than, that produced by the
22 existing well. Be it understood that the new well
shall be drilled to a depth at least equal to that
23 of the existing well. "
24 and;
26 WHEREAS, the depth of the existing well is 560 feet and;
26 MEREAS, the State has drilled a new well to a depth of

27 579 ft. and cased same to a depth of 520 feet and;
28 ISHEREAS, in lieu of placing casing to the depth of 560 ft. ,
29 I the State shall pack the lower 59 ft. of said well with screened,
30 rounded rock all passing a 1-1/2 inch wire mesh screen, 90 per
31 II cent passing a one inch wire mesh screen and all retained on a

1 3/4 inch wire mesh screen.
2 and;
3 WHEREAS, it is now the desire of the parties that the
4 above stated portion of Paragraph 3 of the Right or Way Contract
5 and also set Forth in Amendment to Right of Way Contract also
6 above mentioned shall be amended to read as follows :
7 "Within one year after approval of this Contract
the State shall drill a well on grantors remaining
S property that produces a quantity of water equal
to or greater than produced by the existing well.
9 Be it understood that the new well shall be drilled
to a depth of 579 ft. and cased to a depth of at
10 least 520 feet, provided however, that the lower
11 59 ft. of said well shall be packed with screened,
rounded rock all passing a 1-1/2 inch wire mesh
screen, 90/ passing a 1 inch wire mesh screen, and
12 all retained on a 3/4 inch wire mesh screen. "
13 and;
14 WHEREAS, by reason of the foregoing, it is now the desire
15 of the parties hereto to amend said Right of Way Contract and
16 Amendment thereto.
1.7 NOW, THEREFORE, it is agreed bIT and between the parties
1$ hereto as follows :
19 That said portion of Paragraph 3 of the Right of Way
20 Contract, and as restated in the Amendment above quoted in part
21 shall provide as follows :
22 "Within one year after approval of this Contract
the State shall drill a well on grantors remaining
23 property that produces a quantity of water equal
to or greater than produced by the existing well.
24 Be it understood that the new well shall be drilled
to a depth of 579 ft. and cased to a depth of at

2.9 The balance of said Paragraph 3 of the Right of Way Con--
30 tract and its restatement in the Amendment thereto and all other
31 terms and conditions of the Right of ' ay Contract and the
- Two -
1 ` Amendment thereto shall remain unchanged.
2 IN WITNESS WHEREOF, the parties hereto have executed
