HomeMy WebLinkAbout7740 RESOLUTION NO 7740 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT FOR FISCAL YEAR 2017-2018 FOR LANDSCAPE MAINTENANCE DISTRICT NO 1 WHEREAS, the City Council of the City of Redlands, ("this City Council) has heretofore detennimed that the public interest, convenience and necessity require the maintenance of landscape and irrigation facilities set forth in Section 22525 of the Streets and Highways Code, State of California, within the incorporated boundaries of the City of Redlands, and WHEREAS, Michael Pool, City of Redlands' Assistant City Engineer, 35 Capon Street, Suite 15A, Redlands, California, has been appointed "Assessment Engineer" with all provisions of Division 15 applicable to the Engineer berg applied to "Assessment Engineer", and WHEREAS, Section 22622 and 22623 of the Streets and Highways Code required that an Engineer's Report be prepared and filed annually, outlining the assessments to be levied against the benefiting properties within the City's Landscape Maiitenance District No 1, and WHEREAS, the City of Redlands' City Engineer, as the Assessment Engineer, has prepared and filed with the City Clerk a report in writing as required by the Landscaping and Lighting Act of 1972 and in compliance with Article XIIID of the California Constitution, and WHEREAS, the City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that no part of the report requires or should be modified in any respect, NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as follows Section I That the Engineer's estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of therm are hereby, preliminarily approved and confirmed Section 2 That the diagram showing the Landscape Maintenance District No I referred to and described in said report, and the boundaries of the lots and parcels of land within such assessment district as the same existed at the trine of passage of this resolution, is hereby preliminarily approved and confirmed Section 3 That the proposed assessment upon the properties in Landscape Maintenance District No 1, in proportion to the estimated benefit to be received by such properties, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed I\eelerklResoluhons\Res 7700 7799/7740 LMD FY17 18 Prelun App.doc I Section 4 The assessments to be levied and collected against the assessable lots and parcels of property within the District for fiscal year 2017-18 have not been increased since the assessments levied and collected for fiscal year 1997-1998 Section 5 That said report shall stand as the Engineer's Report for the purposes of all subsequent proceedings, for Landscape Maintenance District No 1 APPROVED AND ADOPTED this 20th o June, 2 7 Paul Barich, Mayor Pro Tempore ATTEST J e Donaldson, City Clerk 1�cclerk\Resolutions\Res 7700 7799/7740 LMD FY17 18 Prelim App.doc 2 I, Jeanne Donaldson, City Clerk of the City of Redlands, hereby certify that the foregoing resolution was duly adopted by the City Council at a regular meeting thereof held on the 20' day of June, 2017, by the following vote AYES Councilmembers Gilbreath, Barich, Tcjeda NOES None ABSENT Councilmember Harrison, Mayor Foster ABSTAIN None Jc ie Donaldson, City Clerk I lcclerk\ResolutlonslRes 7700-779917744 LMD FY17 18 Prelim App.doc 3
