HomeMy WebLinkAbout5099 RESOLUTION NO. 5099 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING TENTATIVE CANCELLATION OF LAND CONSERVATION CONTRACT NO. 74-RO14 WHEREAS, pursuant to the California Land Conservation Act of 1965, and by Resolution No. 2182, the City Council of the City of Redlands has authorized the establishment of Agricultural Preserves throughout the City; and WHEREAS, the property described in Exhibit "A," attached hereto (the "Property"),is located in an Agricultural Preserve established by Resolution No. 2999 of the City Council; and WHEREAS, the owner of the Property and the City have entered into Land Conservation Contract No. 74-R014; and WHEREAS, on December 23, 1986, the owner of the Property recorded a notice of non-renewal for Land Conservation Contract No. 74-RO 14; and has since petitioned the City for cancellation of that Land Conservation Contract; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. In accordance with Government Code Section 51282, the City Council of the City of Redlands hereby finds: A. Cancellation of Land Conservation Contract No. 74-RO14 is in the public interest in that, because of the Property's proximity to residentially developed land, the potential for vandalism and related public nuisance problems will be substantially reduced by such cancellation; B. That other public concerns relating to the orderly development of the community substantially outweigh the objectives of preserving the Property in Agriculture under the Williamson Act Land Conservation Contract; C. That development of the Property as proposed by the Property owner would provide more contiguous patterns of urban development than development of proximate non-contracted land by discouraging "leap frog" development and encouraging more orderly and efficient development of surrounding lands; DJN1206LE D. San Bernardino County Assessor's Parcel No. 168-171-04 is hereby granted approval for tentative cancellation of Land Conservation Contract No. 74-R014. Section 2. Pursuant to Government Code Section 51.283.4, the Property owner shall satisfy the conditions and contingencies contained in Exhibit "B", attached hereto and incorporated herein by this reference. The Property owner further shall notify this City Council whether or not he has been able to satisfy such conditions. Within thirty days after receiving such notice from the Property owner, this City Council shall either execute a Certificate of Cancellation or a withdrawal of tentative approval of a Cancellation of Contract and cause the same to be recorded. Mayor of the City of Redlands ATTEST: City G erkOF— L Lorrie Poyzer, Citi Clerk, City of Redlands, hereby certify that the foregoing resolution was duly adopted by the City Council at a regular meeting thereof held on the 5th day of July , 1994 by the following vote: AYES: Councilmembers Foster, Gil , Gilbreath; Mayor Larson NOES: Councilmember Cunningham ABSENT: None City Cler Resolution No. 5099 Page 2 DJM206LE Resolution No. 5099 Exhibit "A" That portion of the northeast 114, Section 24, Township 1, south, Range 3 west, San Bernardino Base and Meridian, in the City of Redlands, County of San Bernardino, State of California, according to the official plat of said land on file in the District Land Office, described as follows: Commencing at a stone l chain north of the northwest corner of the south 112 of the northeast 114 of said Section 24; thence south 7.50 chains to a post; thence east 4.26 chains to a post on the right bank of the Sunnyside Ditch; thence north 76 deg. 30' east along said ditch 5.21 chains to a post; thence south 89 deg. 30' east along said ditch 9.61 chains to a post; thence north 76 deg. 5' east, along said ditch 7 chains to a post; thence north 4.07 chains to a post I chain north of the line dividing the north and south 112 of the northeast 114 of said Section; thence west 25.50 chains to the place of beginning. Exhibit "B" Resolution No. 5099 CONDITIONS OF APPROVAL 1. Prior to recordation of a Certificate of Cancellation the applicant shall pay in full the required cancellation fee as deferred taxes upon cancellation. The County Assessors Office provided a Cancellation Fee Worksheet that identifies a cancellation fee of fifty-three thousand four hundred sixty- two dollars and fifty cents ($53 , 462 . 50) . Failure to pay the cancellation fee within one (1) year from the date of tentative approval shall result in a recomputation of the cancellation fee. 2 . Application fees for Williamson Act Cancellation applications are based upon the hourly rate for all staff time involved in reviewing and processing the application. Those staff involved include, but are not limited to, the City Attorney, Community Development Director, Assistant Planner, Secretary, and Senior Administrative Clerk. Prior to recordation of a Certificate of Cancellation the applicant shall pay in full additional application fees to the City Treasurer. These additional fees amount to approximately two-thousand ($2 , 000. 00) dollars, please contact the Planning Division for the actual fee amount.
