from SOUTHERN PACIFIC COMPANY, a corporation of the State of
Delaware, Grantor, to CITY OF REDLANDS, a municipal corporation of
the State of California, Grantee;
WITNESSETH:
1. Grantor hereby grants to Grantee an easement for the reloca-
tion of a grade crossing at First Street across Grantor's right of
way and tracks and more fully described as follows :
All that portion of Lots 6, 7, 8, 9, Block B
and all that portion of Lots 5, 6, 7, Block C, all
being a portion of Rancho San Bernardino in the City
of Redlands, as per plat recorded in Book 7 of Maps,
page 2, Records of San Bernardino County, and that
portion of land lying within vacated Redlands Avenue in
the City of Redlands, County of San Bernardino, State
of California, described as follows :
BEGINNING at a point in the westerly line of said
Block B, distant southerly thereon, 15. 00 feet from
the northwesterly corner thereof; thence North 89043' 19"
East, parallel with the northerly line of said Block B,
a distance of 122. 19 feet; thence South 00°16141" East,
10.00 feet to a point; thence Southwesterly and South-
easterly as follows : along a curve to the left of a
25 foot radius through an angle of 116"25120" from a
tangent that bears South 89c43 '19" West at last mentioned
point, an are distance of 50.80 feet to a point; thence
South 26042101" East, 'tangent to last described curve at
last mentioned point, 100. 22 .feet to a point; along a
curve to the right of a radius of 525 feet through an
angle of 23°49 tOl" from a tangent that is the last de-
scribed course at last mentioned point, an are distance
of 218. 22 feet to a point and along a curve to the left
of a radius of 25 feet, through an angle of 870o8t4411
from a tangent that bears South 2°53 '00' East at last
mentioned point, an are distance of 38.02 feet to a
point in the southerly line of said Block C, thence
South 89058 ,16f1 West, along said southerly line being
also in the northerly line of West Central Avenue in
said City, tangent to last described curve, 100. 16 feet
to a point; thence Northeasterly and Northwesterly,
leaving said southerly line of said Block C; along a
curve to the left of a radius of 25 feet through an angle
of 93029 '22" from a tangent that is the last described
course at last mentioned point, an arc distance of 40.79
feet to a point; along a curve to the left of a radius of
475 feet through an angle of 23°10155" from a tangent that
bears North 3°31106" `fest at last mentioned point, an arc
distance of 192. 20 feet to a point, North 26042101" West,
tangent to Last described curve at last mentioned point,

area of 211+5 square feet, more or less .
2. Grantor hereby agrees that for and in consideration of the
above grant of said easement Grantee shall take all action ne :
to vacate and abandon existing First Street on Grantor's right of ,
way as soon as the new street has been constructed. Grantee further
agrees that said vacated area as described below shall be quitclaimed A-

to Grantor when abandoned in order to clear Grantor's title.
All thatortion of First Street (formerly
Lugonia Street, 50 feet in width, including a por-
tion of Vacated Redlands Avenue, as shown on map of
a portion of Rancho San Bernardino, in the City of
Redlands, County of San Bernardino, State of California,
as per plat recorded in Book 7, page 2, of Naps, records
of said County, which lies between the northerly line
of West Central Avenue (9feet wide) and a Line which
is parallel with and distant southerly 25 feet from the
northerly line of Block B of said portion of the Rancho
San Bernardino, and the westerly prolongation thereof.
3. Should Grantee, its successors or assigns, at any time
abandon the use of said land or any part thereof, or fail at any time
to use the same for said purpose for a continuous period of one (1)
year, the rights granted shall cease to the extent of the use so
abandoned and discontinued, and Grantor, its successors or assigns,
shall at once have the right to resume exclusive possession of said
land, or the part thereof the use of which is so discontinued or
abandoned. .
4. The parties hereby agree, in order to clear said right of
way for the street construction, that Grantor shall remove a portion
of its existing freight house, platform and ramp, and construct a
new ramp and rearrange its facilities as shown in yellow and red on
attached print. Grantee agrees to reimburse Grantor for all expenses
incurred by Grantor in performing said work.
5. Grantee at its expense will remove paving from a portion of
vacated First Street north of Grantor's tracks as shown crosshatched
on the attached print, and will make all arrangements with Grantor's
lessees for relocation and rearrangement of buildings, fences and

otter facilities of the lessees.
C) 6. After first Street has been constructed on its new align-

crossings within lines two (2) feet outside the rails of its tracks

Iand Grantee at its expense will maintain the portions outside such
lines, together with all drainage facilities and street lights.
7. This grant is made subject and subordinate to the prior
and continuing right and obligation of Railroad, its successors ;
and assigns, to use all the property described herein in the per-
formance of its duty as a common carrier and for that purpose there
is reserved unto Railroad, its successors and assigns, the right
(consistent with the rights herein granted) to construct, recon-
struct , maintain and use existing and future railroad tracks,
facilities and appurtenances for railroad and transportation
purposes generally, and existing and future transportation, com-
munication and pipe line .facilities and appurtenances in, upon,
over, under, across or along said property,
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed in duplicate the day and year first herein
written.

RESOLUTION NO. 2105
RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF FIRST STREET IS
UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING VACATION
OF SAID STREET.
THE CITY COUNCIL OF THE CITY OF REDLANDS ORDAINS AS FOLLOInG:

SECTION ONE- The Council of the City of Redlands having eleed to
proceed under the provisions of Division 5. Part l., Chapter 2 of the Streets
and Highways Code of the State of California, and having held a public hearing
as provided therein,., hereby finds from all the evidence submitted that the
street described in this resolution is unnecessary for present or prospective
street purposes and that the public interest and convenience requires the
closing of said street.
SECTION TWD. The City Council hereby orders the vacation of that portion
of First Street described as follows-.
All that portion of First Street (.formerly Lugonia
Street) 50 feet in width., including a portion of
vacated Redlands Avenue, as shown on map of a portion
of Rancho San Bernardino in the City of Redlands,
County of San Bernardino., State of California, as per
plat recorded in Book 7, Page 2 of Maps,, records of
said County,, which lies between the northerly line of
West Central Avenue (92 feet wide) and a Line which is
parallel with and distant southerly 25 feet from the
northerly line of Block B of said portion of the Rancho
San Bernardino., and the westerly prolongation thereof.
SECTION THREE: The City Council hereby determines that the vacation of
the street described herein is required by public interest,, convenience.,
safety and welfare.
