HomeMy WebLinkAbout7768 RESOLUTION NO 7768 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING AGRICULTURAL PRESERVE REMOVAL NO 124 FOR THE PROPOSED SUBDIVISION OF APPROXIMATELY 6 03 ACRES INTO FOURTEEN SINGLE-FAMILY RESIDENTIAL LOTS AND ONE LETTERED LOT AT 1485 EAST SAN BERNARDINO AVENUE (APN 0168-071-06-0000) WHEREAS, Diversified Pacific Communities, LLC, has filed applications for Agricultural Preserve Removal No 124,Zone Change No 456, and Tentative Tract Map No 20079 with the City of Redlands fol the subdivision of approximately 6 03 acres into fourteen (14) smrigle-family residential lots and one lettered lot located at 1485 East San Bernardino Avenue(the"Project"), and WHEREAS, in conjunction with the filing of Agricultural Preserve Removal No 124, the proposed Project also includes the filing of Tentative Tract Map No 20079 and Zone Change No 456, collectively known as the "Project Entitlements," and WHEREAS, the applicant is authorized to represent the legal owner(s) of record, and the property owner(s)have authorized Redlands Pioneer, LLC, to proceed on their behalf to pursue the Project Entitlements, and WHEREAS, on August 8, 2017, the Plannung Conuiussion held a noticed public hearing on the Agricultural Preserve Removal and considered verbal and written testimony of City staff, the applicant for the proposed Agricultural Preserve Removal, and testimony frommembers ofthe public, and. WHEREAS, the Plainniing Cornnussion has recomnrnended to the City Council that the Agricultural Preserve Removal be approved, and WHEREAS,the Environmental Review Committee reviewed Agricultural Preserve Removal No 124 at a noticed public hearing on June 5, 2017, and recoimmended approval of a Mitigated Negative Declaration for the Project, and WHEREAS on August 24,2017,notice of the City Council's public hearing for Agricultural Preserve Removal No 124 and the related Project Entitlements was published in the Redlands Daily Facts by the City Clerk, and WHEREAS, on September 5, 2017, the City Council held a noticed public hearing on the proposed Agricultural Preserve Removal and considered the staff report and oral reports, the Planning Comm-mission iecom mendatmon, and testnnony and written evidence submnitted by and on behalf of the applicant, and testimony by members of the public, and WHEREAS, at the public hearing on September 5, 2017, the City Council considered and -1- I lccleikXResolutionslRes 7700-779917768 - Agricultural Preserve Removal No 124 doc heard public comments on Agricultural Preserve Removal No 124 and the Project Entitlements,and WHEREAS, the land requested to be removed from the Preserve abuts a developed zone other than agricultural,and the Project site adjoins an existing residential neighborhood and Tract No 18979, which is under construction, and WHEREAS, the application confonns to the City of Redlands General Plan., and the applicant's proposal is consistent with the density allowances of the Very Low-Density Residential(0- 2 7 units per gross acre) land use designation of the City's General Plan, and WHEREAS, the land requested to be removed from the Preserve does not circumvent land under contract in accordance with the California Land Conservation Act of 1965 (Williamson Act), the property is not under contract with the State for Land Conservation (Williamson Act), and the property does not adjoin land under a Williamson Act contract, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION 1 CALIFORNIA ENVIRONMENTAL QUALITY ACT The Project Entitlements are subject to the California Environinental Quality Act(CEQA),the City has prepared an Initial Study, and there is no substantial evidence that the proposed Project may have a significant effect on the environment, and a Mitigated Negative Declaration has been prepared in accordance with the State CEQA Guidelines SECTION 2 RECOMMENDATION FOR APPROVAL Agricultural Preserve Removal No 124 is hereby approved for the Project Entitlements SECTION 3 EFFECTIVE DATE This Resolution shall take effect upon the effective date of City of Redlands Ordinance No 2855 effectuating the change of zoning designation for the Project property from Agricultural (A-1) to Residential Estate (R-E) ADOPTED, SIGNED AND APPROVED this 5`'' day of September, 2017 �U t Paul W Foster, Mayor ATTEST <::;�C��ZLaLz Jaime Donaldson, City Clerk -2- 11cclerklResolutionsacs 7700-779917768 - Agricultural Preserve Removal No 124 doe I, Jeanne Donaldson, City Clerk of the City of Redlands, hereby certify that the foregoing resolution was duly adopted by the City Council at a regular meeting thereof held on the 5`h day of September, 2017 AYES Counelhnembers Harrison, Gilbreath, Banch, Teleda, Mayor Foster NOES None ABSTAIN None ABSENT None Je e Donaldson, City Clerk -3- I 1cclerklResolutions\Res 7700-779917768 - Agricultural Preserve Removal No 124 doe
