HomeMy WebLinkAbout7769 RESOLUTION NO 7769 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING TENTATIVE TRACT MAP NO 20079 FOR THE SUBDIVISION OF APPROXIMATELY 6 03 ACRES INTO FOURTEEN SINGLE-FAMILY RESIDENTIAL LOTS AND ONE LETTERED LOT AT 1485 EAST SAN BERNARDINO AVENUE (APN 0168-071-06-0000) WHEREAS, Diversified Pacific Conrrrnunities, LLC,has filed applications for Agricultural Preserve Removal No 124, Zone Change No 456, and Tentative Tiact Map No 20079 with the City of Redlands for the subdivision of approximately 6 03 acres into fourteen (14) single-family residential lots and one lettered lot located at 1485 East San Bernardino Avenue (the "Project"), and WHEREAS, in conjunction with the filing of Tentative Ti act Map No 20079,the proposed Project also includes the filing of Agricultural Preserve Removal No 124 and Zone Change No 456, collectively known as the "Project Entitlements," and WHEREAS, the applicant is authorized to represent the legal owner(s) of record, and the property ownei(s) have authorized Redlands Pioneer, LLC, to proceed on their behalf to pursue the Project Entitlements, and WHEREAS, the City of Redlands has the authority per Chapter 17 07 of the Redlands Municipal Code to take action on Tentative Tract No 20079 to subdivide approximately 6 03 acres into fourteen (14) single-family residential lots and one lettered lot, and WHEREAS, on August 8, 2017, the Planning Commission held a noticed public hearing on the Tentative Tract Map and considered verbal and written testimony of City staff,the applicant for the proposed Tentative Tract Map, and testimony from members of the public, and WHEREAS, the Planning Coininission has recommended to the City Council that the Tentative Tract Map be approved, and WHEREAS, the Enviromnental Review Corrumittee reviewed Tentative Tract Map No 20079 at a noticed public hearing on June 5, 2017, and reconumennded approval of a Mitigated Negative Declaration for the Project, and WHEREAS on August 24, 2017, notice of the City Council's public hearing for Tentative Tract Map No 20079 and the related Project Entitlements was published in the Redlands Daily Facts by the City Cleik, and WHEREAS, the proposed project is subject to the California Environ nental Quality Act (CEQA), the City has prepared an Initial Study and exercised its own independent judgment and analysis, there is no substantial evidence that the proposed Project may have a significant effect on the enviromnent, the custodian of records is the City Planner and the Development Services Department, and a Mitigate Negative Declaration has been prepared in accordance with the State I \ccierk\Resolutions\Res 7700-7799\7769-TTM 20079 docx CEQA Guidelines, and WHEREAS, on September 5, 2017, the City Council held a noticed public hearing on proposed Tentative Tract Map No 20079 and considered the staff report and oral reports, the Planning Commission recommendation, and testimony and written evidence submitted by and on behalf of the applicant, and testimony by members of the public, and WHEREAS, at the public hearing on Septembei 5, 2017, the City Council considered and heard public connnents on Tentative Tract Map No 20079 and the Project Entitlements, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION 1 CALIFORNIA ENVIRONMENTAL OUALITY ACT The Project Entitlements is subject to the California Environmental Quality Act(CEQA),the City has prepared an Initial Study and there is no substantial evidence that the proposed Project may have a significant effect on the environment, and a Mitigate Negative Declaration has been prepared in accordance with the State CEQA Guidelines SECTION 2 PROJECT APPPROVAL The City Council of the City of Redlands hereby approves Tentative Tract Map No 20079 foi the Project subject to the conditions of approval included as Exhibit "A" to this Resolution, and based upon the following findings I Theproposed nrap is consistent wadi the General Plan of any applicable speck plan of other applicable pi ovisions of the Redlands Municipal Code The proposed map will be consistent with the Redlands General Plan and the Redlands Municipal Code The proposed subdivision is designated in the General Plan land use map as Very Low Density Residential which permits up to 2 7 dwelling units per acre The proposed zoning designation is Residential Estate(R-E) District, and the proposed density of 2 42 units per acre would be consistent with the General Plan land use designation The application is consistent with the General Plan's land use policies 4 40(a), 4 40(d),4 40(q), and 4 40(s) of the Land Use Element The application is consistent with the General Plan's traffic and circulation policies 5 30(1) and 5 32(c) of the Circulation Element This finding can be made 2 The site is physically suitable for the proposed type of development The project site is physically suitable for the type of development The site has a relatively flat topography and is large enough to subdivide the site into fourteen lots in accordance with the density and design requirements of the Redlands Geneial Plan and the Redlands Municipal Code All on-site and off-site improvements proposed as part of the project's design will meet all City standards and provide a safe and efficient environment for the residents In addition, other smnlai residential development (i e , single-family subdivisions) have been previously approved in the iminediate vicinity of the project site 3 The site is subdivision is designated in the Geneial Plan land use snap as Very Low Density Residential, which allows a maximum density of up to 2 7 dwelling units per gross area The project site's topography is relatively flat and the design of the subdivision will generally follow the grade of the site, and will not require excessive grading to yield the number of lots proposed As indicated in the analysis m this staff report,the project proposes a density of 2 42 dwelling units per net acre, and is physically suitable for the density of development hi addition, other si ilai residential development (i e , single-family subdivisions) have been previously approved at similar densities in the immediate vicinity of the project site 4 The design of the subdivision of the proposed inipi ovein.ents is not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat The design of the subdivision and proposed improvements is not likely to cause substantial environinental damage of injure fish or wildlife or their habitat The site does not contain any biological resources including fish of wildlife, and based on the Initial Study that has been prepared foi the project, there are no envirorunental factors that cannot be mitigated to a level of less than significant S The design of the subdivision or the type of inipi overnents ai e not likely to cause ser nous public health pi obleins The design of the subdivision or the type of inprovements are not Iikely to cause serious public health pioblems The proposed project would accoininodate a single-family residential subdivision, and is not hkely to cause any serious public health problems as the project is designed with improvements that meets all City and State building and fire codes, no offensive emissions or odors will be associated with the development, and the ambient noise will not affect residential properties because all noise will be mitigated to a level of less than significant 6 The design of the subdivision of the type of irnprovernents will not conflict 14th easements, acquired by the public at large,for access thi ougli or use of pr open ty within the proposed subdivision The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision The project will improve access in the nninediate vicinity by constructing a new cul-de-sac from a new extension of Lucas Lane (a minor local street), and installing associated street improvements such as curb, gutter, sidewalk, signs, etc , to serve the subdivision Additionally, all interior public streets and pedestrian access will be provided throughout the project site and abutting subdivision 7 That pur suant to Section 66474 4 of the Subdivision Map Act, the land is not subject to a conte act entered into pur suant to the California Land Conservation Act of 1965 1 sustain their agricultural use The subject property is not under a Williamson Act Contract pursuant to the California Land Conservation Act of 1965, and will not be detrimental or otherwise affect Communities, LLC Location 1485 East San Bernardino Avenue (APN 0168-071-06-0000) Develooment Services — Planninq Division 1 The issuance of any permits shall comply with all provisions of the Redlands Municipal Code 2 Unless the Final Map is recorded, or a time extension is granted in accordance with Title 17 of the Redlands Municipal Code, this tentative tract map shall expire two (2) years from the date of City Council approval 3 This approval is for a Tentative Tract to subdivide approximately 6 03 acres into fourteen (14) single-family residential lots and one (1) lettered lot located at 1455 East San Bernardino Avenue (proposed change to R-E District) 4 The subdivision shall be subject to the provisions of the Residential Development Allocation process under the Growth Management Ordinance, Title 19 of the Redlands Municipal Code 5 All plans submitted to the City shall reflect the Planning Commission and City Council approval and any other changes required by the Commission/Council and/or staff 6 The applicant shall not make any modifications or changes during construction that are in conflict or contrary to the project's approved tentative map, site design, grading plan, landscaping plan, or building elevations without first consulting with the Development Services Director or his/her designee 7 Pursuant to Government Code Section 66020(d), certain fees, on the date this project was approved by the City 8 The property owner and applicant and their successors and assigns, shall defend, by paying for the defense costs of the City of Redlands (for counsel retained by the City), indemnify and hold harmless the City of Redlands, and its elected officials, officers, employees, and agents, from and against any and all claims, actions, and proceedings (collectively "Claims") to attack, set aside, void or annul the approval of this Conditional Use Permit by the City, or Claims brought against the City due to acts or omissions in any way connected to the applicant's project that is the subject of this permit This indemnification shall include, but not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions or proceedings, including damages for the injury to property or persons, including death of a person, and any award of costs or attorneys' fees In the event any such action is commenced to attack, set aside, void or annul all, or any, provisions of this permit, or is commenced for any other reason against the City for acts or omissions relating to the applicant's project, within fourteen (14) City business days following notice of such action from the City, the applicant shall file with the City a performance bond or irrevocable letter of credit, or other form of security satisfactory to the City (the "Security') in a form satisfactory to the City, and in the amount of $100,000, to ensure applicant's performance of its defense and indemnity obligations under this condition The Security amount shall not limit the total indemnity obligation of the applicant pursuant to this condition The failure of the applicant to provide the Security shall be deemed an express acknowledgement and agreement by the applicant that the City shall have the authority and right, without objection by the applicant, to revoke all entitlements granted for the project pursuant to this permit The City shall have no liability to the applicant for the exercise of City's right to revoke this permit 9 The grading plan associated with the tract map shall be designed so that the incorporation of retaining walls are not necessary on-site 10 The applicant shall record the lots by tract map 11 The applicant shall ensure that the project shall be kept in weed and dust free condition throughout all periods of development 12 All utilities on-site shall be placed underground, including utility vaults Prior to approval of the final map the applicant shall bond for undergrounding of utilities, and submit plans to be approved by the Development Services Director that detail undergrounding of all utilities found on-site Bonds shall be calculated and included in any bonds required by the City of Redlands Municipal Utilities and Engineering Department 13 Prior to the recordation of the final map, the applicant shall submit final landscape and irrigation plans, and wall and fence plans for review and approval by the Development Services Director or his/her designee I \clerk\Resolutions\Res 7700-7799\7769 TTM 20079 docx 14 Any conditions of approval determined by the City to not be completed prior to Final Map approval shall be the subject of a Subdivision Improvements Agreement entered into by the developer with the City 15 The final map shall conform with the tentative map as approved by the City Council 16 The applicant shall provide a subdivision improvement bond to ensure the installation of common area landscaping, recreational open space facilities and equipment (if any), and the required noise barrier wall and any perimeter walls 17 Developer shall comply with all Mitigation Measures (repeated in the following conditions) and related requirements as identified in the Initial Study/Mitigated Negative Declaration and Mitigation Monitoring/Reporting Program prepared for the project Prior to issuance of any building and engineering/grading permits to construct the project (unless otherwise specified by the mitigation measure), Developer shall provide sufficient information to the Planning Division to ascertain compliance with applicable conditions/mitigations 18 Mitigation Measure AIR-1 Applicant/Developer shall ensure that the project shall comply with all applicable SCAQMD Rules and Regulations during construction, and grading contractors shall limit the daily disturbed area to five (5) acres or less at any time on the subdivision site (for both Tentative Tract No 20079 and Tract 18979) 19 Mitigation Measure BIOLOGY-1 Prior to beginning ground-disturbance activities or any other construction activities, a qualified biologist shall conduct pre- construction surveys for burrowing owls and nesting birds, including Loggerhead Shrike, on the protect site and the adjacent areas(100 feet)where project activities have the potential to cause nest failure The first survey shall be conducted no more than fourteen (14) days prior to the commencement of ground-disturbing activities, and the second survey shall be conducted within three (3) days of ground-disturbing activities if no active avian nests and no burrowing owls are found during the clearance surveys, no additional mitigation will be required If an active burrowing owl or other avian nest is discovered during the pre- construction clearance survey, the City of Redlands Planning Division shall be notified immediately, and the Developer and/or site superintendent shall cease construction activities around the nest within 500 feet so as not to disturb the wildlife As determined by the City, a qualified biologist shall delineate the boundaries of any necessary buffer area The perimeter of the nest setback zone shall be fenced or adequately demarcated with stakes and flagging at 20-foot intervals, and construction personnel and activities restricted from the area The buffer shall be sufficient to ensure that nesting behavior is not adversely affected by the construction activity Once the qualified biologist has determined that young birds have successfully fledged or the nest has otherwise become inactive, a I \cclerk\Resolubons\Res 7700-7799\7769-TTM 20079 docx monitoring report shall be prepared and submitted to the City of Redlands for review and approval prior to continuing or re-initiating construction activities within the buffer area The monitoring report shall summarize the results of the nest monitoring, describe construction restrictions currently in place, and confirm that construction activities can proceed within the buffer area without jeopardizing the survival of the young birds Construction within the designated buffer area shall not proceed until written authorization is received from CDFW If burrowing owls are observed, the area shall be flagged and/or staked (a minimum of 500 feet), unless and until a reduced buffer has been deemed appropriate), and the biologist shall establish an appropriate no-work buffer in consultation with the California Department of Fish & Wildlife (CDFW) The no- work buffer shall be clearly delineated by the biologist and actively monitored to ensure avoidance of the impacts, until consultation with the CDFW and applicant results in a plan to avoid or relocate the burrowing owl(s) A monitoring report shall be prepared and submitted to the City, and written authorization by the CDFW shall be received before construction may proceed within the no-work buffer 20 Mitigation Measure CULTURAL-1 If any prehistoric or historic resources over 50 years of age are encountered during land modification, then activities in the immediate area of the finds (i e , within 50 feet) should be halted so that a qualified archaeologist can assess the find, determine its significance, and make recommendations for appropriate mitigation measures within the guidelines of the California Environmental Quality Act and/or the Federal National Environmental Policy Act Based on the recognized sensitivity for the occurrence of buried sites and artifacts on the protect site, Developer shall allow for monitoring by a qualified archaeologist who meets the Secretary of the Interior's guidelines and is listed in the Register of Professional Archaeologists Monitoring shall be required for all soil disturbances including grading (cut and fill) Should movement of soils for grading for re-compaction activities show no evidence of an archaeological site or artifacts, and with the agreement of the City of Redlands Planning Division and the on-site archaeological monitor, further monitoring at this location shall no longer be required In the event that a prehistoric site or historic remains older than 50 years is identified during monitoring, the Project Archaeologist monitor shall be empowered to stop all construction activities in the vicinity of the find (e g , 50 feet radius) If the discovered archaeological/cultural materials are prehistoric in nature and/or include Native American remains, the Protect Archaeologist shall notify the City of Redlands Planning Division as well as a Native American monitor to assist in the identification of the resources or human remains The Native American monitor shall be retained from a list of suitable candidates from the Native American Heritage Commission I \cclerk\Resolutions\Res 7700-7799\7769-TTM 20079 docx The Project Archaeologist shall assess the discovered material(s) and prepare a survey, study, or report evaluating the impact The Archaeologist's survey, study, or report shall contain a recommendation(s), if necessary, for the preservation, conservation, or relocation of the resource The Developer shall comply with the recommendations of the evaluating Archaeologist, as contained in the survey, study, or report Protect development activities may resume once copies of the archaeological survey, study, or report are submitted to the City of Redlands Planning Division and to South Central Coastal Information Center Department of Anthropology C S U Fullerton McCarthy Hall 477 800 N State College Blvd Fullerton, CA 92834 Not less than 14 days prior to the issuance of any grading or excavation permit, the Applicant/Developer shall submit the draft contract between the selected Project Archaeologist (or firm) and the Developer to be employed for the required monitoring services The contract shall also include the proposed scope of services (including the monitoring, reporting, and disposition requirements noted above) which shall be subject to review and approval by the City of Redlands Contracts shall include a requirement for monthly written reports from the archaeological monitor to the Planning Division summarizing the monitor's activities during the reporting period 21 Mitigation Measure GEOLOGY-1 The project shall be developed in accordance with all the recommendations included in the geotechnical investigation prepared by RMA GeoScience for the subject property In addition, the proposed project will be constructed to adhere to all applicable federal, state, and local regulations pertaining to seismic design 22 Mitigation Measure GEOLOGY-2 The project shall require that all permanent landscaping be installed prior to final occupancy, and, following construction, disturbed soils shall be landscaped, or otherwise treated (covered with gravel, mulch or hardscape) to protect soils from wind and water erosion 23 Mitigation Measure GEOLOGY-3 The project shall require the applicant to include a Soil Erosion Control Plan as part of the Stormwater Pollution Prevention Plan (SWPPP) and Water Quality Management Plan (WQMP) for the project site This section of the SWPPP/WQMP shall include measures designed to control wind and water erosion on the site during and after construction The Best Management Practices (BMPs) shall include measures including landscape, hardscape, and incorporation of retention facilities to reduce the volume of stormwater runoff, minimize soil exposed to concentrated runoff, and infiltrate surface runoff on the project site in I \cclerk\Resolutions\Res 7700 7799\7769-TTM 20079 docx accordance with the City's Stormwater Management ordinance (Section 15 54 160 of the Redlands Municipal Code) 24 Mitigation Measure HH M-1 Prior to recordation of any Final Map(s) for the project and sale(s) of any lot(s), Developer shall record an Overflight/Avigation Easement(s) on the title(s) in favor of the City of Redlands to operate the Redlands Municipal Airport, to include aircraft overflight, including helicopters, aircraft and/or airport noise, aircraft vibration, aircraft and/or airport exhaust, odors, dust, and any other effects associated with airport operations Developer shall submit the Overflight/Avigation Easement to the City of Redlands Quality of Life Department (Airport Division) for review and approval at or prior to the time of application for a Final Map, and the text of the notice must be approved prior to approval of any Final Map Evidence of recordation shall be provided to the Quality of Life Department (Airport Division) and the Development Services Department (Planning Division) prior to approval of any Final Map 25 Mitigation Measure HHM-2 Prior to any sale(s) of any lot(s), Developer shall provide written notice to prospective buyers that the property is located in the vicinity of the Redlands Municipal Airport, and as such may be exposed to the effects or inconveniences of aircraft overflight, noise, vibration, odors, etc , associated with airport operations The notice shall be consistent with Redlands Municipal Code Sections 17 28 050 and 17 28 060 pertaining to notice(s) for property in proximity to Redlands Municipal Airport Such notice shall also be recorded on all title(s) of all properties created by the project Developer shall submit the written notice to the City of Redlands Quality of Life Department (Airport Division) for review and approval at or prior to the time of application for a Final Map, and the text of the notice must be approved prior to approval of any Final Map Evidence of recordation shall be provided to the Quality of Life Department (Airport Division) and the Development Services Department (Planning Division) within ninety (90) days of Final Map approval and prior to sale of any lot 26 Mitigation Measure HYDROL-1 The project shall be required to comply with the submitted Water Quality Management Plan (WQMP) prepared in accordance with Santa Ana Regional Water Quality Control Board and the City of Redlands requirements Also, a Storm Water Pollution Prevention Plan (SWPPP) must be prepared and submitted to the Santa Ana Regional Water Quality Control Board The project shall also provide the appropriate Best Management Practices (BMPs) within the project site to stop "first flush" of accumulated pollutants from entering the City storm drain system The project-specific BMPs may also incorporate other measures such as bio-swales in planter areas which can also eliminate the "first flush" of accumulated pollutants on street surfaces BMPs can include onsite infiltration trenches, treatment units and detention basins that will reduce pollutant levels of on-site runoff The specific mix of BMPs will be I \cclerk\Reso[ubons\Res 7700-7799\7769-TTM 20079 dou reviewed and approved by the City (Municipal Utilities & Engineering Department) 27 Mitigation Measure NOISE-1 The project shall require the construction of a sound wall six (6) feet in height for lots adjacent to San Bernardino Avenue The barrier must be constructed of decorative material (e g , split-face CMU wall) and present a solid face from top to bottom Unnecessary openings or decorative cutouts which permit sound to transmit through the wall shall not be made All gaps (except for weep holes) should be filed with grout or caulking 28 To satisfy the City of Redlands 45 dBA CNEL interior noise level standards, all lots shall be provided with the following items air conditioning or mechanical ventilation, double-paned glass, and, solid core doors with weather stripping and seals Lots 7 and 8 will also need to provide the following items to comply with the 45 dBA CNEL interior noise level standards stucco or brick veneer exterior walls or wood siding wlone-half inch thick fiberboard underlayer, glass portions of windows/doors not to exceed 20 percent of wall, and, exterior vents facing noise source shall be baffled 29 Mitigation Measure NOISE-2 In order to comply with the City of Redlands 45 DBA CNEL interior noise standards all homes shall be have air conditioning or mechanical ventilation, double-paned glass, and solid core doors with weather stripping and seals Lots 7 and 8 shall also have Stucco or brick veneer exterior walls or wood siding wlone-half inch thick fiberboard underlayer, glass portions of windows/doors not to exceed 20 percent of wall, and exterior vents facing noise source shall be baffled 30 Mitigation Measure NOISE-3 The project shall limit all construction activities to the hours of 7 00 a m and 6 00 p m Monday through Saturday, with no construction activities permitted on Sundays and Federal holidays 31 Mitigation Measure NOISE-4 During all project site excavation and grading on- site, construction contractors shall equip all construction equipment, fixed or mobile, with properly operating and maintained mufflers, consistent with manufacturer standards 32 Mitigation Measure NOISE-5 The contractor shall place all stationary construction equipment so that emitted noise is directed away from the noise sensitive receptors nearest the project site 33 Mitigation Measure NOISE-6 Equipment shall be shut off and not left to idle when not in use 34 Mitigation Measure NOISE-7 The contractor shall locate equipment staging in areas that will create the greatest distance between construction-related noise/vibration sources and sensitive receptors nearest the project site during all project construction \cderk\Resofutions\Res 7700-7799\7769 TTM 20079 docx 35 Mitigation Measure NOISE-8 The project proponent shall mandate that the construction contractor prohibit the use of music or sound amplification on the project site during construction 36 Mitigation Measure NOISE-9 The construction contractor shall limit haul truck deliveries to the same hours specified for construction equipment 37 Mitigation Measure NOISE-10 Limit the use of heavy equipment or vibratory rollers and soil compressors along the project boundaries to the greatest degree possible It is acknowledged that some soil compression may be necessary along the project boundaries 38 Mitigation Measure NOISE-11 Jackhammers, pneumatic equipment and all other portable stationary noise sources shall be shielded and noise shall be directed away from sensitive receptors 39 Mitigation Measure NOISE-12 For the duration of construction activities, the construction manager shall serve as the contact person should noise levels become disruptive to local residents A sign
