A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
ACTING AS A RESPONSIBLE AGENCY IN ACCORDANCE WITH THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT AND ADOPTING A
MITIGATED NEGATIVE DECLARATION, RELATED TO A REQUEST FOR
A PRE-ANNEXATION AGREEMENT FOR TENTATIVE TRACT MAP NO
19991 AN APPROVED SUBDIVISION OF APPROXIMATELY 16 ACRES
INTO 62 SINGLE-FAMILY RESIDENTIAL LOTS AND ONE LETTERED LOT
LOCATED AT THE NORTHEAST CORNER OF NICE AVENUE AND
SAPPHIRE AVENUE IN MENTONE (APN 0298-261-46-0000)
WHEREAS, Larry Jacinto Living Trust has filed an application for a Pre-Annexation
Agreement and outside city utility connections in accordance with Municipal Code Chaptei 13 60,
to obtain City domestic water and sewer services for a subdivision of approxiinately 16 acres into
62 single-family residential lots and one lettered lot located at the northeast cornet of Nice and
Sapphire Avenues in the unincorporated community of Mentone ("the Project"), and
WHEREAS, the City Council has the authority per Chapter 13 60 of the Redlands
Municipal Code to take action on Pie-Annexation Agreement No 17-01 and Outside City
Connection No 17-26 to provide the domestic water and sewer services necessary to serve the
proposed project, and
WHEREAS, on September 5, 2017, the City Council held a regular public meeting and
considered the staff report and oral reports, and testimony and written evidence submitted by and
on behalf of the applicant, and testimony by members of the public, and
WHEREAS, the proposed project is subject to the California Environ nental Quality Act
(CEQA), and the City of Redlands in this case is a Responsible Agency as defined in Section
15381 of the CEQA Guidelines and acting in accordance with Section 15096 of the CEQA
Guidelines, and
WHEREAS,the City of Redlands has reviewed and considered the Initial Study/Mitigated
Negative Declaration prepared by the County of San Bernardino (Lead Agency) and exercised its
own independent Judgment and analysis, there is no substantial evidence that the proposed project
may have a significant effect on the environment, the custodian of records is the Lead Agency,
and a Mitigate Negative Declaration has been prepared in accordance with the State CEQA
Guidelines, and
WHEREAS, in accordance with Chapter 13 60 of the Redlands Municipal Code, in making
its determination the City Council may consider the following, among other factors
I The relationship of the property and its proposed use to the city's general plan and
zoning ordinances,
2 The relationship of the property and its proposed use to the city's water and sewer
master plans, and the city's water and sewer capital improvement programs,

3 The proxunity of the property to the city's boundaries and existing utility
infrastructure,
4 The proposed potential for new revenue sources for the city to pay for city services
provided to the project as a result of annexation and development of the property, and
5 The proposed standards for development of the property
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS
SECTION 1 CALIFORNIA ENVIRONMENTAL OUALITY ACT The City ofRedlands
is a Responsible Agency in accordance with Sections 15381 and 15096 of the California
Environmental Quality Act (CEQA), the City has reviewed the Initial Study/Mitigated Negative
Declaration prepared by the County of San Bernardino (Lead Agency) and exercised its own
independent judgment and analysis, there is no substantial evidence that the proposed project may
have a significant effect on the environment, and the Mitigate Negative Declaration may be relied
upon in accordance with the State CEQA Guidelines Staff shall file a Notice of Determination in
accordance with the State CEQA Guidelines
SECTION 2 PRE-ANNEXATION AGREEMENT The City Council of the City of
Redlands hereby approves the continued processing of Outside City Case No 17-26 for the
proposed project, and directs staff to prepare a Pre-Annexation Agreement for the provision of
City water and sewer services to the proposed project
SECTION 3 EFFECTIVE DATE This Resolution shall take effect upon adoption
