A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
RELATED TO AN APPLICATION TO THE SAN BERNARDINO COUNTY
LOCAL AGENCY FORMATION COMMISSION ("LAFCO") TO INITIATE
PROCEEDINGS FOR A SPHERE OF INFLUENCE CHANGE AND
ANNEXATION OF CERTAIN TERRITORY INTO THE CITY OF REDLANDS
(ANNEXATION NO. 93), AND DETACHMENT FROM THE SAN
BERNARDINO COUNTY FIRE PROTECTION DISTRICT AND ITS VALLEY
SERVICE ZONE AND COUNTY SERVICE AREA 70, FOR THE WESTERLY
0.764-ACRE PORTION OF A 1.73 ACRE PARCEL LOCATED AT THE
NORTHWEST CORNER OF WEST LUGONIA AVENUE AND TENNESSEE
STREET (APN: 0167-171-13).
WHEREAS, Masterworks, LLC, the authorized representative for the property owner, has
submitted an application for reorganization including Pre-Zoning (Zone Change No. 453), General
Plan Annendment No. 138,Zone Change No. 453, and Amendment No 44 to the East Valley Corridor
Specific Plan to designate the subject property as Coininercial General (EV/CG) for the westerly
0.764-acre portion of the subject property that lies outside the City boundary, as shown on the
attached Exhibit "A" and incorporated by this reference herein; and
WHEREAS, on August 8, 2017, the Planning Comnission held a public hearing and
considered the staff report, oral report,the testiunony and the written evidence submitted by staf,and
WHEREAS, on August 8, 2017, the Planning Coininission held a public hearing and
considered the application materials, the testimony, and the written evidence submitted by the
applicant and by members of the public; and
WHEREAS, following the public hearing on August 8, 2017, the Plainniing Commission
deteriniined that the proposed pre-zoning on the City's Zone Map for the westerly 0.764 acre ofthe
subject property would be in conformity with the General Plan's existing land use designation for the
subject property as Commercial; and
WHEREAS, following the public hearing on August 8, 2017, the Planning Commission
detennined that the proposed change to the City's Zone Map and related change to the East Valley
Corridor Specific Plan's Land Use Districts Map would be iii conformity with the proposal for a
Specific Plan Amendment for the entire property; and
WHEREAS, on August 8,2017,the Planning Coininnission recommended to the City Council
that the proposed project be approved; and
WHEREAS,the proposed project is not subject to review under the California Environmental
Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061(b)(3)because the City has
deterinined there is no possibility that the proposed project will result inn any enviroiunental effect;and

WHEREAS, on August 24, 2017, notice of the City Council's public hearing for the proposed
Sphere of Influence Change, Pre-Zoning, General Plan Amendment and related project actions was
published in the Redlands Daily Facts by the City Clerk; and
WHEREAS, following the public hearing on September 5,2017,the City Council detennined
that approval of the proposal is in the best interests of the public health, safety and general welfare;
and
WHEREAS,it is the desire of the City Council that the proposed reorganization be subject to
the following teens and conditions:
A. The subject property, the westerly 0.764 portion thereof that lies outside the City
boundary, is proposed for annexation to accommodate future cornrrrercial and/or retail
development. An ordinance pre-zoning the westerly 0.764 portion of the property to
East Valley Corridor Commercial General(EV/CG), a resolution for a General Plan
Amendment to designate said portion as Commercial on the General Plan Land Use
Map consistent with the remainder of the property (easterly 0.966 acre portion
currently withal the City), and a resolution for a Specific Plan Amendment to
designate the westerly 0.764 portion of the property to East Valley Corridor
Commercial General (EV/CG), are anticipated to be introduced or approved on
September 5, 2017. The property owner supports the City's proposal to initiate
proceedings for this annexation.
B. The proposed annexation shall be subject to all standard teens and conditions required
by LAFCO.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS:
SECTION 1. The proposal is exempt froin review under the CEQA in accordance with
Section 15061(b)(3)of the State CEQA Guidelines, and the proposal does not require envirornnrental
analysis.
SECTION 2, The City Council of the City of Redlands ("this City Council"), for the reasons
hereinafter innentioned,intends to file an application with LAFCO to initiate proceedings to annex to
the City of Redlands certain vacant territory, hereinafter described, pursuant to the Cortese-Knox-
Hertzberg Local Government Reorganization Act of 2000, Division 3, conunencing with Section
56000 of the Government Code of the State of California.
SECTION 3. That this proposal for reorganization and annexation is consistent with the
City's existing General Plan and proposed General Plan Update governing the Sphere of Influence of
the City of Redlands.
SECTION 4. That this City Council's reasons for initiating annexation proceedings for a
Sphere of Influence Change and Annexation are as follows: the City's General Plan Land Use Map
and official Zone Map show the hereinafter described territory as divided by the City boundary;this
annexation of will be consistent with the City's General PIan Land Use Map and proper use of the

property in conformity with the overall plan for the City of Redlands;this annexation will contribute
to the orderly growth and development of the City; this annexation will be consistent with existing
street layout, drainage, and public utilities and services; and the property owner has requested this
annexation of the hereinafter described territory in order to receive City municipal services and
facilitate the future development of said property.
SECTION 5. That the territory which this City Council proposes to annex is herebyideritified
as City of Redlands Annexation No. 93, and consists of that real property situated in the County of
San Bernardino, State of California, as shoA,,n on the map attached hereto as Exhibit "A."
SECTION 6. This City Council acicnowledges and agrees to the LAFCO requirement for
imposing legal indemnification as outlines in Policies 10 and I I of LAFCO's Accounting&Financial
Division of its :Policy& Procedure Manual adopted June 2012.
SECTION 7. That the City Clerk of the City of Redlands is hereby directed to file with
LAECO a copy of this Resolution to initiate annexation proceedings for the territory described herein
to the City, to request a report by LAFCO, provided for by the Cortese-Knox-Hertzberg Local
Governinent Reorganization Act of 2000, and to submit and execute such other application mateiials
including the Application and Annexation Supplement Forni, which includes the certified Plan for
Service and Fiscal Impact Report and other reports as may be required by law in such annexation
proceedings.
