HomeMy WebLinkAboutDeeds & Easements_15-1957E GRANT OF EASEMENT 5A4808 For and in consideration of the sum of One Dollar, receipt of Which is hereby acknowledged, does hereby grant to THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY, a corporation, its successors and assigns, an ease- ment to construct, place, operate, inspect, maintain, repair, replace and remove such underground telephone, tele graph and communication structures as Grantee may from time to time require, consisting of cables, conduits, man holes, markers, and necessary fixtures and appurtenances, under, and upon that certain real property in 'bee Gity or s County of qan State of California described as '� Uat portion of ei6tty (80) foot Vide Cajon Street in the City of Funds, County or Sail Bernardino, State of ^.al.ifornia, vacated by Resolution No. 900 at a regular Ming of the City Counc:11 of said City on December 17, 1957, said portion of said suet being particularly described as lying westerly of artd abutting the gest line of Orange Street, a street of 69.4 feet right of imy, and southerly of and abutting the south line of Citral Avenue, a street of seventy (70) feet right of vay. The above-described easement rsh 31 be located on the northeasterly fifteen (15) feet of the soutiraesterly thirty (30) feet of that vacated portion of Cajon Street described above. Grantor covenants for himself, his successors and assigns not to place or maintain any building or structure on said easement. Grantor also grants to Grantee the right to cut such roots on said property as may be necessary for the protec- tion of said structures, and to enter upon said property at all times for the purpose of exercising the rights hereby granted. Grantee shall be liable to Grantor for any damage which may occur to the above-described property by reason of negligence on the part of Grantee in the exercise of the easements gra f6d. Whaley, City Clerk City of Redlands Redlands, California Dear Mr Whaley: Reference is made to our letter of September 5, 1957, in which -re gave notice of our interest in that portion of Cajon Street proposed to be vacated and that we desired an easement to maintains this plant in its present location We understand that the vacation was approved and adopted under Resolution No 900 on December 17, 1957, and that the property was acquired by the City of Redlands for City parking lot purposes. In view of this, we are enclosing our standard grant of easement form in triplicate It will be appreciated if you will present this docu- ment to the city council and arrange for proper execution on behalf of the City of Redlands In order that our records will be complete, please return the original and duplicate of our easement -together with two certified copies of the resolution.
