CLOSED SESSION REPORT
CAN Attorne` McHugh announced the CAN Council voted unammousl` to approve an industrial disabilrtN
retirement application of a public safet` employee during the closed session.
PRESENTATIONS
Redlands Animal Shelter—Animal Control Officer Bill Miller introduced Rusthna a two-year old female
Labrador Retriever mix,who is available for adoption,with them-one other dogs and eight`-four cats, at
the Redlands Animal Shelter Officer Miller informed the Council twent`-eight dogs and fortti-six cats
have been adopted since the last regular CAN Council meeting
Staff RecoRnrtion-Mavor Foster presented certificates from the CrtN of Redlands and Assemblvman Marc
Stemorth to Sergeant Bill Miller in recognition and appreciation of his extraordmarN contributions to the
Redlands Animal Shelter and his dedicated service to the communrtN and the animals of Redlands
Baha'i Faith-Mavor Foster presented a certificate of proclamation to Arthur and Linda GregorN
declaring October 22, 2017 as the 200th Anmversar-, of the birth of Baha'u'llah,the Founder of the Baha i
Faith.
National CommunitN Planning Month-Mavor Foster presented a certificate of proclamation to
Development Services Director Brian Desatnik declaring the month of October to be National Communrt`
Planning Month in the CAN of Redlands Also recognized were several people who have been instrumental
in the General Plan update process, including Planning Commissioners, Carol Dver Julie Rverson-Rock,
Judith Batte` Jan Hudson, Steven Frasherr Historic & Scenic Preservation Commissioners Kurt
Heidelberg,Alison Roedl, Kristine Brown. and CrtN planning staff members Brian Foote Loralee Farris,
Sean Reill` and Emil` Elliott.

PUBLIC COMMENT
Bulk` Waste Collection - Charles Redden restated his suggestion the Council consider adding free
pick-up of bulk` waste items for residents and cited several surrounding cities which offer this to their
customers The Mavor directed staff to review the feasibilrt` of offering users bulk` waste pick-up
services for free
GrocerN Store Ingress/Egress Points -Paul Letson raised safetN concerns with the practice of several local
big-box grocerN stores in the CrtN which have disabled one of their main ingress/egress points at the front
of the stores

unammousl` approved a proclamation recognizing October 22, 2017 as the 200th Anmversar-, of the birth

Council unammousl` approved a request for permission to consume alcoholic beverages at Prospect Park
for the Guillen wedding reception to be held on October 29 2017

Independent Contractor Agreement -Ceramics and Art Classes
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved an independent contractor agreement between the CAN of Redlands and
Lisa Tucker to conduct ceramics and art classes for the Crtv's Recreation Division.

Fee Waiver-First Fndays Art Bazaar
QualrtN of Life Director Boatman introduced a request from The Crtrograph Foundation Inc for a fee
waiver and a request to serve and consume alcohol at the Civic Center nth Street Breezewa` As public
comment, Dennis Bell recommended the Council consider utilizing CVP officers instead of two police
officers to patrol the event. He raised questions concerning the art bazaar and wondered if the location
of the event,would be in direct competition with surrounding bars and restaurants
On motion of Council Member Jon Harrison, seconded b` Mavor Pro Tempore Paul Banch,the CrtN
Council unammousl` approved the request from The Crtrograph Foundation Inc for a waiver of
$1,320 00 in fees, and authorized permission to serve and consume alcoholic beverages at the Civic
Center nth Street Breezewa` for the First Fridays Art Bazaar to be held on November 3 2017

Resolution No 7790 -Grant Application
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved Resolution No 7790 authorizing the submittal of a grant application for
the 2016 Historic Preservation Fund Grant, approved the acceptance of the grant award in an amount not
to exceed $40 000 from the State Office of Historic Preservation for the Historic Context Statement, and
authorized the CrtN Manager to sign as the Grantee Representative

On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` determined that approval of the Mills Act Contract Agreement is exempt from
the California Environmental Quaht` Act Guidelines pursuant to Section 15061(b)(3)and approved the
Agreement between the CAN of Redlands and Travis and April Lose` for propert` located at 933 Walnut
Avenue

Mills Act Contract- 1049 Clifton Avenue
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` determined that approval of the Mills Act Contract Agreement is exempt from
the California Environmental Quaht` Act Guidelines pursuant to Section 15061(b)(3)and approved the
Agreement between the CAN of Redlands and Eric and Jennifer Hill for propert` located at 1049 Clifton
Avenue

Resolution No 7789 - Street Name Changes
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved Resolution No 7789 authorizing the adoption of street name changes
within Tract Map No 19975 from Kristion Lane to Adeline Avenue and Jill Court to Kristion Court.

Settlement Agreement
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved the public disclosure of details of an Agreement of Settlement and
General Release between the CAN of Redlands and Gerald Williams Under the terms of the agreement,
the CrtN agrees to pa` Mr Williams $25 000 00 to settle and dispose of disputes and controversies
associated with a civil action pending in the San Bernardino Superior Court and entitled Williams v
CAN of Redlands,et al Case No CIVDS 1607191

Resolution No 7766 - Contractor SafetN Program
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved Resolution No 7766 adopting the Crtv's Contractor SafetN Program,to
allow the CAN to limit its liabilrt` in regards to on-the-fob safet` and require contractors to meet Crtv's
safetN standards

Grant Acceptance -Assistance to Firefighters Grant
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved the acceptance of the 2016 Assistance to Firefighters Grant (AFG)
Program in the amount of$437 487 00 and authorized the additional appropriation of the same to the
Fire Department for the purchase of 64 Complete Self Contained Breathing Apparatus (SCBA) Packs

Agreement-Automated Data Svstem
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved the agreement between the CrtN of Redlands and the California
Department of Corrections and Rehabilitation for access to the Parole Law Enforcement Automated
Data Svstem (LEADS) intended for crime analvsis or other law enforcement uses to assist with
investigations and contacts involving parolees

COMMUNICATIONS
CAN Council Vacanc`
Mavor Foster described the recent passing of Council Member Gilbreath, leading to a vacant Council
seat and summarized the options available to fill the vacanc` either b` appointment or a special
election.With an appointment process,the appointee must be a Redlands resident and registered voter
and an` person appointed would hold office until the next municipal election in November 2018 since
the vacanc` occurred in the first half of the term of office and there are at least 130 days left until the
next general municipal election. If Council agreed to hold a special election, an` candidate must be a
registered voter and Redlands resident. The successful candidate would serve out the remainder of the
term expiring in December 2020 Cost estimates for a special election range from $80 000 to
$100000 Each Council Member presented their reasons for supporting the appointment process over
a special election, and agreed approving an appointment was the most fiscall` responsible decision for
the Cit-,
On motion of Mavor Paul Foster seconded b` Council Member Eddie Tejeda,the CAN Council
unammousl` approved the vacanc` on the CAN Council be filled b` appointment; directed staff to issue
a Notice of Intention to Fill Vacanc` b` Appointment, and defined procedures for conducting the
application and interview process with the following ke` dates
- October 18 2017 -Issue Notice of Intention to Fill Vacanc` b` Appointment
- October 19 2017 at Noon through November 13 2017 b` 5 00 PM-Application Period Opening and
Closing Dates
-November 21 2017 at 6 00 PM-Applicant presentation and interview Selection of CAN Council
appointee Swearing in of new Council Member
To maintain diversrt` on the council and honor Council Member Gilbreath, Mavor Foster offered his
personal thoughts relating to some of the criteria he will use to make a selection. These include looking
for a female applicant who lives in District 4 the district in which she lived.

NEW BUSINESS
Agreement-Actuarial Services and TechnoloRN
Farrah Jenner Assistant Finance Director presented the benefits of GoInvest's software program,
offering the CAN cost savings,that uses real time data, quickl` translates complicated actuarial
analvsis, and allows staff and elected officials to make informed decisions concerning employee
benefits Council Member Harrison requested the CAN Attorne` and staff work towards
adding language in the agreement stating the CAN would retain the rights to use the software even in
the evenutalrt` the vendor went out of business
On motion of Council Member Eddie Tejeda, seconded b` Council Member Jon Harrison,the CAN
Council unammousl` approved the agreement between the CAN of Redlands and GovInvest in the
amount of$64,545.30 for a period of three years,with two one-year renewal periods for actuarial
services and technolog`

RPFA MOU
Human Resources/Risk Management Director Martin thanked the Redlands Professional Firefighters
Association (RPFA) for their professionalism in reaching this agreement and their willingness to serve
the communrtN
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` approved the tentative agreement negotiated b` CrtN staff and RPFA, and
approved the final Memorandum of Understanding between the CAN of Redlands and the Redlands
Professional Firefighters Association.

Agreement-Household Hazardous Waste Program Evaluation
QualrtN of Life Director Boatman presented background on an agreement with R3 Consulting Group
for evaluation of the Crtv's existing Household Hazardous Waste Program CAN Manager Martinez
explained the consultant will evaluate not onl` the program practices,but other contractors in the
Count` who perform the same work,which could provide a cost savings to the CAN
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` approved the agreement between the CAN of Redlands and R3 Consulting Group
in the amount not-to-exceed $44 125 00 for evaluation of the Crtv's existing Household Hazardous Waste
Program

ConsultmR Agreement-Name Change
On motion of Council Member Jon Harrison, seconded b` Mavor Pro Tempore Paul Banch,the CrtN
Council unammousl` approved the agreements between the CAN of Redlands and WSP USA, Inc for
services associated with the Airport Lighting and Sign Plan, and its associated engineering, design, and
environmental services and services for construction management and inspections at the Redlands
Municipal Airport to reflect the name change from Parsons Brmckerhoff to WSP USA, Inc

Renewable Liquefied Natural Gas Agreement Amendment
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` approved the amendment to the agreement between the CAN of Redlands
and Applied LNG Technologies, LLC to revise language regarding the monthl` Natural Gas Price Index.
Vote 4 - 0 Passed
License Agreement-Dining in the Alle`
Council Member Harrison explained the CAN has been veru patient over the last several months dealing
with this project.
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` directed staff to issue a 30-da` Notice of Termination in accordance with the
License Agreement between the CrtN of Redlands and David Kramer dated December 15 201

Pre-Annexation Agreement
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the Cit`
Council unammousl` determined that Pre-Annexation Agreement No 16 is exempt from further
environmental review or subsequent Mitigated Negative Declaration, in accordance with Section 15 162
of the California Environmental Quaht` Act Guidelines and approved Pre-Annexation Agreement No
16 with Lam Jacinto Living Trust for Tentative Tract Map No 19991 for the provision of water and
sewer service for the construction of 62 residential lots on approximatel` 16 acres located at the
northeast corner of Nice Avenue and Sapphire Avenue in the Mentone area.

FundmR Agreement-Environmental Review Services
Development Services Director Desatnik presented an overview of a request to construct a hotel on two
vacant parcels located on Orange Tree Lane and the need for a funding agreement for the CAN to retain
a qualified consultant to perform environmental consulting services for the proposed project. Emil`
Elliott, of Development Services, added the hotel project will be a 4-stop extended sta` hotel
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` determined that approval of the Funding Agreement for environmental review
services is exempt from environmental review pursuant to Section 15061(b)(3) of the State s guidelines
implementing the California Environmental Qualit` Act; and approved the Agreement between the CAN
of Redlands and Woodspring Suites Redlands San Bernardino LLC in the amount of$33 987 00 to
fund the preparation of environmental review services for a proposed new hotel project, located at
Orange Tree Lane westerl` of Alabama Street.

Utilrt` Connection -Vickie L Plunkett
On motion of Council Member Jon Harrison, seconded b` Council Member Eddie Tejeda,the CAN
Council unammousl` determined that the continued processing of the application for Outside Utilrt`
Case (OSC)No 17-02 and Pre-Annexation Agreement No 19 are exempt from environmental review
pursuant to Sections 1303 and 1319 of the State's guidelines implementing the California
Environmental QualrtN Act; and determined OSC No 17-02 and the Agreement are consistent with the
Citv's General Plan, and that public health, safet` and welfare and the best interests of the citizens of
Redlands are served b` the Crtv's continued processing of the application submitted b` Vickie L
Plunkett for outside cit` utilrt` connection for residential development for propertti located at the
southeast corner of San Bernardino Avenue and Jasper Avenue (APN 298-013-23) in the unincorporated
communrt` of Mentone

COUNCIL MEMBER ANNOUNCEMENTS AND ACTIVITIES
Councilmember Teieda had nothing new to report since the last Council Meeting
Councilmember Harrison attended the Metrolink Board Meeting last week and announced the agenc`
trains are starting to utilize diesel engines which are more sustainable causing less impact on air
qualrtN He also attended the San Bernardino Count` Transit Authont` (SBCTA) Committee and
Commission meetings last week, and accepted on behalf of the CAN an award from the Farm Bureau,
entitled, "Friends of Farm Bureau" for the Crtv's work towards citrus preservation.

Mavor Pro Tem Banch and Council Member Harrison enjoved Walking with the Council last Saturda`
He attended the Fire Station 261 Open House held October 14th and was privileged to represent the
CAN for the annual Northside Impact Committee's dinner honoring Redlands communrt` leaders and
students
Mavor Foster attended the Omnrtrans Board of Directors Meeting on October 4th for Council Member
Gilbreath,He enjoved participating in the the Library Days event, and commended Librar-, Director
Don McCue and his staff for ajob well done He attended the 7th annual Optimist Oktoberfest event at
Svlvan Park,the K-9 Fundraiser held at Gerards Market, and on behalf of the CAN attended the
100-year celebration for the Assistance League Thrift Shop He participated with the clean up along the
Orange Blossom Trail, sponsored b` the Service Club Council and the CAN He also attended the Fire
Department Open house held at Station 261 and had the privilege of speaking at the memorial services
last week for friend and colleague Council Member Pat Gilbreath.

Member Pat Gilbreath,who will be remembered for her selfless dedication to serving Redlands for man`
years,with determination and honest` Her leadership and friendship will be missed b` all The next
