A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING SIGN CONDITIONAL USE PERMIT NO 20 FOR A 200
SQUARE FOOT FREEWAY ORIENTED SIGN FOR THE PARKFORD
GROVE CENTER, LOCATED AT 1035-1045 PARKFORD DRIVE
WHEREAS, Harcourts and Freeman has filed an application for Sign Conditional Use
Permit No 20 foi a 200 square foot fieeway-oriented sign foi the Paikfoid Grove center,
located at 1035-1045 Paikford Drive (APN 0174-143-07) within the C-4 (Highway
Commercial) District, and
WHEREAS, in conjunction with the filing of Commission Review and Approval No
890, the Project also includes the filuig of Conditional Use Permit No 1061, and Sign
Conditional Use Permit No 21 (tile "Project"), and
WHEREAS, the City Council has the authority per Chapter 18 192 of the City of
Redlands Municipal Code to take action on Sign Conditional Use Permit No 20, and
WHEREAS, on Septernbei 26, 2017, and Octobei 24, 2017, the City of Redlands'
Planning Commission held noticed public hearings at which interested persons had an
opportunity to testify in support of, or in opposition to Sign Conditional Use Permit No 20, as
well as Conditional Use Permit No 1061, Cormnission Review and Approval No 890, and Sign
Conditional Use Perinit No 21 at which the Plaimi ng Commission considered the Project, and
WHEREAS, in accordance with Governinent Code section 65453 and 65090, on
Decembei 8, 2017, the City gave notice by publication in the Redlands Daily Facts newspaper of
the holding of a public heaiiing at which Sign Conditional Use Permit No 20 would be
considered by the City Council, and
WHEREAS, on December 19, 2017, the City Council held a public hearing and
considered the staff written and oral reports, the iecoininendationi of the Planning Conninission,
the testimony and wi itten evidence submitted by and on behalf of the applicant, and testimony by
members of the public, and
WHEREAS, at the public hearing on Decembei 19, 2017, the City Council considered,
heard public cominents on Sign Conditional Use Permit No 20 and the Harcourts and Freeman
Erntitlements,
NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as
follows
SECTION 1 CALIFORNIA ENVIRONMENTAL OUALITY ACT The City prepared
an Initial Study and found there is no substantial evidence that there could be any potentially
significant environmental effects with mitigation, and the Project qualifies for a Mitigated
Negative Declamation in accordance with CEQA Guidelines Section 15074

SECTION 2, REOUIRED FINDINGS Pursuant to Redlands Municipal Code Section
15 36 100(F) and, after consideration of the record before the City Council, and all oral and
written evidence and testimony presented at the public hearing for Sign Conditional Use Permit
No 21, the City Council hereby finds as follows
1 The size of the sign(s) is compatible with the design, architecture, and scale of the
building(s) and/or project The applicant has proposed a single freeway sign to accommodate two
tenants in lieu of constructing two (2) individual freeway-oriented signs to minimize visual
clutter The design of the sign ties in colors and materials from the buildings located withm the
center for a cohesive appearance ,
2 The size of the sign(s) is aesthetically consistent with the Project, adjacent areas,
and the City of Redlands The Project is located in an urbanized area of the City, adjacent to the
1-10 Freeway and heavily traveled local streets The sign will be located more than 100 feet
from an adjacent 120 foot tall gasoline service station sign, which has set a precedence of
existing freeway-oriented signage in the area The sign integrates decorative elements such as a
decorative roofing cap and metal scrolls to provide a sign representative of the high aesthetic
standards of the adjacent area and within the City of Redlands
3 The size of the sign(s) are needed to provide necessary Project identification for
the benefit of the general public The sign cabinet will have a width of twenty feet and will
display two tenants To provide context, permit information for the adjacent gasoline service
station sign indicates that adjacent sign reflects one tenant and has a diameter of 12 feet As
such, a two tenant sign allocating a width of ten feet per tenant is consistent in scale and the size
and height are necessary to provide Project identification for the benefit of the general public,
given the limited visibility of the center due to topography and vegetation at points 3/10 of a mile
from beginning of each of the Ford Street off-ramps
Section 3 APPROVAL The City Council hereby approves Sign Conditional Use Permit
No 20, subject to the Conditions of Approval and incorporated herein by this reference as
Exhibit "A"

Goverinnent Code Section 66020(a) has coinirienced to ruin on the date this project was

9 The property owner and applicant and their successors and assigns, shall defend, by paying
for the defense costs of the City of Redlands (foi counsel retained by the City), indeiniufy
and hold harmless the City of Redlands, and its elected officials, officers, employees, and
agents, from and against any and all claims, actions, and proceedings (collectively "Claims")
to attack, set aside, void of annul the approval of this Conditional Use Permit by the City, or
Claiixis brought against the City due to acts of omissions in any way connected to the
applicant's project that is the subject of this permit This indemnification shall include, but
not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions of
proceedings, including damages for the injury to property of persons, including death of a
person, and any award of costs or attorneys' fees In the event any such action is commenced
to attack, set aside, void of annul all, of any, provisions of this permit, of is cornneinced for
any othei reason against the City fol acts or omissions ielatmg to the applicant's project,
within fourteen (14) City business days following notice of such action from the City, the
applicant shall file with the City a performance bond of mevocable letter of credit, or other
form of security satisfactory to the City (the "Security") in a form satisfactory to the City,
and in the amount of 5300,000, to ensuie applicant's performance of its defense and
indemnity obligations under this condition The Security amount shall not hint the total
indemnity obligation of the applicant pursuant to this condition The failure of the applicant
to provide the Security shall be deemed an express acknowledgement and agreement by the
applicant that the City shall have the authority and light, without objection by the applicant,
to revoke all entitlements granted for the project pursuant to this permit The City shall have
no liability to the applicant for the exercise of City's light to revoke this permit
10 The project site shall be kept in a weed and dust free condition throughout all periods of
development
11 The following additional dust suppression pleasures in the SCAQMD CEQA Ail Quality
Handbook shall be incorpoi ated into construction
Revegetate disturbed areas as quickly as possible
a Suspend all excavating and grading operations when wind speeds (as
instantaneous gusts) exceed 25 inph
b Sweep all streets once pet day if visible soil materials are carried to adjacent
streets (recorninend water sweepers with reclaimed water)

12 All sign lettering is to have a miinirnurn vertical and horizontal dimension of one (1) foot and
a maximum vertical and horizontal dimension of thiee (3) feet
13 The sign shall serve foi business identification for qualified uses as described in Section
15 36 420(a) The sign is intended to display identification foi "motorist serving businesses",

defined as "[a] business especially oriented to provide services to the freeway traveling
public Motorist serving businesses shall be limited to those whose primary products or
services are food, lodging, of motor vehicle fuel A motorist serving business shall be open to
the public a minimum. of twelve (12) hours pei day, seven (7) days pen week "
14 Mitigation Measure AES-1 The h eeway sign shall be designed so to not exceed a
maximum height of 110 feet as measured from finish grade (pei the approved grading plain)
at the base of the pole's foundation

15 Mitigation Measure BIO-1 . If construction and/ol tree removal is pioposed between
February 1 and August 31, a qualified biologist shall conduct a nesting bud survey(s) no
imole than three days prioi to initiation of giading to docuiment the presence of absence of
nesting birds within of directly adjacent (100 feet) to the project site The survey(s) shall
focus upon identifying any raptoi and/or passerine nests that aie diectly of indirectly
affected by construction activities If active burrowing oil of other avian nests are
documented, species-specific measures shall be prepared by a qualified biologist and
implemented to prevent abandonment of the active nest At a mininnuim, giading ii the
vicinity of a nest shall be postponed until the young buds have fledged A minimum
exclusion buffer of 100 feet shall be maintained during construction, depending upon the
species and location The perimeter of the nest setback zone shall be fenced or adequately
demaicated with stakes and flagging at 20-foot intervals, and construction personnel and
activities restricted fi•om the area
To be monitored by the Development Services Department, Planrmng Division, through
receipt of a copy of a signed contract or similai confirmation between the developer and a
qualified biologist if any woik will take place during the specified time period and the
documented results as prepared by a qualified biologist, prioi to issuance of a grading
permit
16 Mitigation Measure CUL-1 In the event that cultural resources are discovered during
furthei site preparation activities, operations shall stop in the innrmediate vicinity of the find
and a qualified archaeologist shall be consulted to determine whether the resource requires
furthei study The qualified archaeologist and shall make reconumendations to the Lead
Agency on the measures that shall be implemented to protect the discovered resources,
including but not liruted to excavation of the finds and evaluation of the finds in accordance
with Sectionl 5064 5 of the CEQA Guidelines
If the resources aie determined to be unique historic resources as defined under Section
15064 5 of the CEQA Guidelines, mitigation measures shall be identified by the monitor
and recommended to the Lead Agency Appropriate mitigation measures for significant
resources could include avoidance or capping, incorpoiation of the site in gieen space,
parks, of open space, of data recovery excavations of the finds

17 Mitigation Measure GEOLOGY-1:
The project shall be developed in accordance with all the reconninendations included
in the geotechnical investigation pmepaied by Geotechnologies, Inc for the subject
property In addition, the pioposed project will be constructed to adheme to all
applicable federal, state, and local regulations pertaining to seismic design
18 Mitigation Measure GEOLOGY-2 The applicant shall coordinate and ensure
construction monitoring by the project engineering geologist during ground disturbance
and construction activities, as outlined in the geotechnical investigation prepared by
Geotechnologies, Inc to ensuie compliance with the design concepts, specifications or
recommendations of the geotecluucal investigation
19 Mitigation Measure GEOLOGY-3 The project shall require that all permanent
landscaping be installed piton to final occupancy, and, following construction, disturbed
soils shall be landscaped, of otherwise treated (covered with gravel, inulch or hardscape)
to protect soils fiom wind and water erosion
31 Mitigation Measure GEOLOGY-4: The project shall mequire the applicant to include a
Soil Erosion Control Plan as part of the Stonnwatei Pollution Prevention Plan
(SWPPP) and Water Quality Management Plan (WQMP) fol the project site This
section of the SWPPP/WQMP shall include measures designed to control wind and
water erosion on the site duiing and after construction The Best Management
Practices (BMPs) shall include measures including landscape, hardscape, and
incorporation of retention facilities to reduce the volume of stonnwater runoff,
minimize soil exposed to concentrated runoff, and infiltiate surface runoff on the
project site in accordance with the City's Stonnwater Management ordinance
(Section 15 54 160 of the Redlands Municipal Code)
Mitigation Measures GEOLOGY-1 through GEOLOGY-4 To be verified by the
Building & Safety Division and Municipal Utilities & Engineering Department prior
to issuance of grading permits, and monitored by the Building & Safety Division and
Municipal Utilities & Engineering Department during grading and construction
activities
32 Mitigation Measure HYD-1• Prior to the issuance of a b ading permit, the project
applicant shall file and obtain a Notice of Intent (NOI) with the Regional Water Quality
Control Board in order to be in compliance with the State NPDES Geneial Construction
Storin Water Permit foi discharge of surface runoff associated with construction
activities Evidence that this Inas been obtained (i e , a copy of the Waste Dischamger's
Identification Number) shall be submitted to the City Municipal Utilities and Engineering
Department (MUED) for coverage under the NPDES Geneial Construction Permit

Mitigation Measure HYD-2 Pi for to the issuance of a grading permit, the project
applicant shall submit to and receive approval from the City of Redlands of a Storm
Wates Pollution Prevention Plan (SWPPP) The SWPPP shall include a surface water
control plan and erosion contiol plan citing specific measures to control on-site and off-
site erosion during the entue grading and construction period In addition, the SWPPP
shall emphasize structural and nonstructural Best Management Practices (BMPs) to
control sediment and non-visible discharges fiom the site
The SWPPP will include inspection forms foi routine monitoring of the site during
construction phase to ensure NPDES compliance and additional BMPs and erosion
control measures will be documented in the SWPPP and utilized if necessary The
SWPPP will be kept on site fon the entne duiatnon of project construction and will be
available to the local RWQCB for inspection at any time Some the BMPs to be
implemented may include the following
• Sediment discharges fiom the site may be controlled by the following
sandbags, silt fences, straw wattles and tennporary basins (if deemed
necessaiy), and other discharge control devices The construction and
condition of the BMPs will be periodically inspected during construction
and repairs will be made when necessary as required by the SWPPP
• Materials that have the potential to contribute to non-visible pollutants to
storm water nnust not be placed in drainage ways and must be contained,
elevated, and placed in temporary storage containment areas
• All loose piles of soil, silt, clay, sand, debris, and other earthen material
shall be protected in a reasonable manner to eliminate any discharge from
the site Stockpiles will be suriounded by silt fences and covered with
plastic tangs
• In addition, the construction contractor shall be responsible for perfon-ming
and documenting the application of BMPs identified in the SWPPP
Weekly inspections shall be performed on sandbag barriers and other
sediment control measures called for in the SWPPP Monthly reports and
inspection logs shall be maintained by the Contractoi and reviewed by the
City of Redlands and the representatives of the State Water Resources
Control Board In the event that it is not feasible to implement specific
BMPs, the City of Redlands MUED can make a determination that other
BMPs will provide equivalent or superior treatment either on of off site

34 Mitigation Measure HYD-3: The pioject shall be iequired to comply with the subinitted
Preliminary Water Quality Management Plan (PWQMP) prepared in accordance with
Santa Ana Regional Water Quality Control Board and the City of Redlands Municipal
Utilities and Engineering Department (MUED) The project shall also provide the
appropriate Best Management Piactices (BMPs) within the project site to stop "first
flush" of accumulated pollutants fioin entering the City storin drain system BMPs caninclude onsite bio-swales, infiltration trenches, treatment units and detention basins that
will reduce pollutant levels fiom onsite runoff to meet as defined in Municipal Code
section 15 54 160 The specific mix of BMPs will be ieviewed and approved by the City
of Redlands MUED
To be monitored by the Municipal Utilities and Engineeiing Department and verified
prior to issuance of Building Permits
35 Mitigation Measure NOI-1 Implementation of the following multi-part mitigation
measure is requied to reduce potential construction period noise impacts to a less than
significant level
a) The construction contractor shall ensure that "quiet" models of all compressors and
other stationary construction equipment are utilized where such technology exists
b) The construction contractor shall, to the maximum extent practical, locate on-site
equipment staging areas so as to maximize the distance between construction related
noise sources and noise-sensitive receptors nearest the project site during all project
construction
c) The construction contractor shall place all stationary construction equipment so
emitted noise is directed away fiom sensitive receptors neaiest the project site
d) The construction contractor shall prohibit umlecessary idling of internal
combustion engines (i e , in excess of 5 minutes)
e) The construction contiactoi shall designate a noise disturbance coordinator who will be
responsible fon responding to any local complaints about construction noise The
disturbance coordinator will detennine the cause of the noise complaints (starting too
early, bad muffler, etc ) and institute reasonable measuies warranted to correct the
problem The construction contractor shall conspicuously post a telephone number for the
disturbance coordinator at the construction site
f All on-site construction activities, including deliveries and engine warm-up, shall be
restricted to the hours between the hours of 7 00 a m and 6 00 p in on weekdays,
including Saturdays No such activities shall be permitted on Sundays of federal holidays

Division and Planning Division, and satisfied through notes on the approved
construction plans prior to issuance of Building Permits and implementation during
construction of the project
36 Mitigation Measure PUB-1 A construction site security plan approved by the police
department is requued, providing adequate security measures such as lights, video
cameras, vehicle transponders, locks, alarms, hauled security peisolmel, fencing etc The
nature of the measures will depend on the specific requirements of the site, and may vary
with the different stages of construction The developer shall be responsible for the
connpliance of all sub-contractois working on the site Other impacts associated with new
development ale mitigated with the payment of development impact fees, and State
established school fees
To be moinitoied by the Police Department, Development Services Department,
Building and Safety Division, and Municipal Utilities and Engineeling Department
and verified piior to issuance of a grading permit and building permits, as appropriate
to the phase of construction
371- Mitigation Measure TRA-1• The project applicant shall complete all off-site striping
and sianine. as recommended in the completed Traffic Impact Analvsis, and
contribute towards the cost of area rrnpiovements as identified below on a fan share of
"pro-rata"basis, prior to issuance of a Certificate of Occupancy
•
Fold Street at I-10 WB On-Ramp/Reservorr Road
o Restriping of the east leg with an exclusive westbound left-turn lane and
shared t1iru/right-turn lane Note that the exclusive westbound left-turn lane is
proposed to provide 100 feet of stoi age
o Restripe the northbound and southbound approaches to m ovide for a
northbound and southbound vield right-turn lane
o Installation of a traffic signal and design foi two-six-phase operation with
piotected/pernnissive phasing in the northbound/southbound duections
o Installation of a crosswalk on the east leg
o Restripe the northbound left-tuin pocket to extend back to I-10 east
off-ramp to provide 270 feet of storage Note that the western-most
northbound through lane along Ford Street, south of I-10 eastbound off-
i amp, will become a trate lane leading into this extended northbound left-
turn lane. Install avvrom iate signage to advise drivers of this trap lane.
• Ford Street at Paikfold Drive
o Restriping of the west leg with an exclusive eastbound left-turn lane and
exclusive eastbound right-turn lane Note that the exclusive eastbound left-turn
lane is proposed to provide 100 feet of storage

• Restriping of the north leg to provide a vehicle refuge which can provide
storage for up to two (2) vehicles The vehicle refu6e is vi onosed to provide a
total of 70 feet of stow a6e and transition.
• Ford Stli eet at 1-10 Eastbound Off-Ramp
o Extend the exclusive eastbound rt2ht-turn lane to provide 600 feet of
storage.
• Fox d Sti eet at Redlands Boulevardl1-10 Ramps
o Extend the exclusive westbound left-turn lane to provide 220 feet of
stoi ate.

38 Mitigation Measure TRA-2 The project shall participate in the phased construction of
off-site traffic signals through payment of traffic signal mitigation fees The traffic
signals
within the study area at buildout should specifically include an interconnect of the traffic
signals to function in a coordinated system

39 Mitigation Measure TRA-3 Sight distance at the project accesses shall comply with
