HomeMy WebLinkAbout7823RESOLUTION NO. 7823 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING THE CITY'S LOCAL GUIDELINES FOR IMPLEMENTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND RESCINDING RESOLUTION NO. 6185, WHICH INCLUDES DISESTABLISHMENT OF THE ENVIRONMENTAL REVIEW COMMITTTEE WHEREAS, in 1970, the California Legislature enacted the California Environmental Quality Act ("CEQA") (Public Resources Code section 21000 et seq.) to require public agencies to consider the envirom-mental impacts of their discretionary actions; and WHEREAS, the State CEQA Guidelines (California Code of Regulations, Title 14, section 15000 et seq.) were prepared and adopted by the Secretary of Natural Resources Agency to implement the provisions of CEQA; and WHEREAS, Section 21082 of CEQA requires all public agencies to adopt objectives, criteria, and procedures for the evaluation of public and private projects undertaken or approved by such agencies, and the preparation, if required, of environmental impact reports and negative declarations in connection with that evaluation; and WHEREAS, section 15022 of the State CEQA Guidelines allows apublic agencyto adopt the State CEQA Guidelines a sits local guidelines through incorporation by reference; and WHEREAS, the City of Redlands has previously adopted local guidelines for implementing CEQA consistent with the then -current provisions and interpretations of CEQA; and WHEREAS, such local guidelines provided for the establishment of an "Environmental Review Committee" comprised of City staff; and WHEREAS, CEQA does not require the establislument of an "Environmental Review Committee," and City staff has informed this City Council that the disestablishment ofthat committee will have no adverse effect upon the City's environmental review processes but will instead result in efficiencies for both applicants for projects requiring environmental review and staff resources of the City; and WHEREAS, City staff has now recommended to the City Council that the previously adopted local CEQA Guidelines be repealed, and that for purposes of efficiency, economy and ensuring the City remains current with the most recently adopted State regulations implementing CEQA, that the City Council adopt the State Guidelines as the City's local guidelines relating to the processing of environmental documents; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: IResolutionslRes 7800-789917823 - CHQA.doc Section 1. The City of Redlands hereby adopts the State CEQA Guidelines adopted by the Secretary of the Natural Resources Agency of the Sate of California and codified in Title 14 of the California Code of Regulations commencing with section 15000 et seq., as they may be amended from time to time, as the City of Redlands' local CEQA guidelines. Section 2. All future revisions to the State CEQA Guidelines shall hereafter automaticallybe made a part of the City's local CEQA guidelines, without the need for amendment of this Resolution or any further action by the City Council of the City of Redlands. Section 3. All prior versions of the City's CEQA guidelines and the resolutions which adopted them, including City of Redlands Resolution No. 6185, are hereby repealed.
