HomeMy WebLinkAbout7830RESOLUTION NO. 7830 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DELEGATING GOVERNMENT CLAIMS RESPONSIBILITIES TO ITS THIRD - PARTY CLAIMS ADMINISTRATOR, GEORGE HILLS COMPANY, SUBJECT TO THE PROVISIONS OF CHAPTER 3.09 OF THE REDLANDS MUNICIPAL CODE WHEREAS, the City of Redlands is a public entity and, pursuant to Government Code sections 990.4 et seq. and 6500 et seq., has a self-insured retention for liability claims and losses in the amount of five hundred thousand dollars ($500,000); and WHEREAS, California Govenunent Code sections 990.4 et seq. and 6500 et seq. allow a public entity to delegate the ministerial duties of sending notices to claimants, including, but not Iiinited to, notices of rejection, insufficiency, and untimeliness of goverm-hent claims; and WHEREAS, Chapter 3.09 of the Redlands Mulricipal Code establishes regulations governing the City's processing, acceptance, settlement, and rejection of government claims; and WHEREAS, pursuant to Chapter 3.09 of the Redlands Municipal Code, it is the desire of the City Council and the City Manager to delegate to George Hills Company, the City's third -party govermment claims administrator, in accordance with the company's contract with the City and Chapter 3.09, the authority to coordinate with City staff and process governinent claims and send notices relating to the processing, acceptance, insufficiency, timeliness, and rejection of the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. The City Council hereby delegates to George Hills Company, the City's third -party government claims administrator, the authority to coordinate with City staff and act on the City Council's behalf, pursuant to Govenunent Code section S 10 et seq. and Chapter 3.09 ofthe Redlands Municipal Code, to process, accept, return as insufficient or untimely, and reject, any government claims against the City, and to provide any notices authorized under those Govenunent Code sections and Chapter 3.09, on behalf of the City. Section 2.
