RESOLUTION NO 7854 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING SIGN CONDITIONAL USE PERMIT NO 23 TO PERMIT A UNIFORM SIGN PROGRAM FOR AN APPROVED SHOPPING CENTER LOCATED AT THE SOUTHEAST CORNER OF SAN BERNARDINO AVENUE AND TENNESSEE STREET (WALMART STORES, INC) WHEREAS, Wahnart Stores Inc has made an application for Sign Conditional Use Permit No 23 for a uniform sign program for an approved shopping center located at the southeast corner of San Bernardino Avenue and Tennessee Street, and WHEREAS, the City Council has the authority to review Sign Conditional Use Permit No 23 in accordance with Redlands Municipal Code Chapter 18 192, and WHEREAS, on April 24, 2018, the Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, Sign Conditional Use Permit No 23, and at which the Planning Commission considered Sign Conditional Use Permit No 23, and WHEREAS, following the public hearing on April 24, 2018 the Planning Commission determined that the application for Sign Conditional Use Permit No 23 is in conformity with the Redlands Sign Code and the sign regulations of the East Valley Corridor Specific Plan, and, WHEREAS, on April 24, 2018, the Planning Commission recommended to the City Council that Sign Conditional Use Permit No 23 be approved, and WHEREAS, in accordance with Government Code 65090, on May 24, 2018, the City gave notice by publication in a newspaper of general circulation of the holding of a public hearing at which Sign Conditional Use Permit No 23 would be considered by City Council, and WHEREAS, on June 5, 2018, the City Council held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, Sign Conditional Use Permit No 23, and WHEREAS, the City Council's consideration and possible approval of proposed Sign Conditional Use Permit No 23 is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines Section 15311(a) for accessory structures such as on -premises signs, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION 1 CALIFORNIA ENVIRONMENTAL QUALITY ACT. The City Council hereby determines that the approval of Sign Conditional Use Permit No 23 is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to Section 15311 of the State Guidelines implementing CEQA SECTION 2 APPROVAL The City Council hereby approves Sign Conditional Use Permit No 23, subject to the conditions of approval set forth in Exhibit "A" attached hereto, and as shown in Exhibit "B," and based upon the following findings I The size of the sign should be compatible with the design, architecture, and scale of the building(s) and/or project Two wall signs, both belonging to the major tenant, exceed 120 square feet in size The main I 1Resolutions\Res 7800-789917854 SCUP reso 06.05 18 docx Identification sign is 215 5 square feet and the secondary identification sign is 142 8 square feet The size of the two wall signs are compatible with the design, architecture, and scale of the building(s) and/or project because the building for which the signs are intended to identify, is has a building length of 573 feet with a maximum sign area of 622 75 square feet for wall signs, located within a 45 -acre regional shopping center The wall signs will utilize individual, internally -illuminated channel letters in white, and the Walinart logo (spark) in yellow/sunflower, mounted on the building wall The primary wall sign has a letter height of 5 5 feet, and a spark height of 8 feet The secondary identification sign has a letter height of 4 5 feet, with a spark height of 6 5 feet Both wall signs are adequately sized to be proportional to the scale of the structure to which it will be mounted 2 The size of the sign should be aesthetically consistent with the project, adjacent areas, and the City of Redlands The size of the sign is aesthetically consistent with the project, adjacent areas, and the City of Redlands The Redlands Crossing project was approved by the City Council with an emphasis on establishing a quality shopping center with a uniform aesthetic reflective of the City The wall signs will utilize individual channel letters that are illuminated from within The letters will be affixed to the building facade The proposed signs are suitable to the project's location, size, and orientation, and relates cohesively with nearby development 3 The size of the sign should be needed to provide necessary project identification far the benefit of the general public The size of the signs are needed to provide necessary project identification for the benefit of the general public because the size and scale of the building and the shopping center as a whole, and its intended use as a regional shopping center warrants the size of the signs Due to the massing, vast building frontages, and positioning away from the immediate right-of-way, the large wall signs are necessary to provide both business identification for the building, and to provide clarity for mcoming motorists and shoppers to the center SECTION 3. DEVELOPMENT INFORMATION FOR SIGN CONDITIONAL USE PERMIT NO 23 CONDITIONS OF APPROVAL The approval is for a uniform sign program involving the construction of one (1) wall sign 215 52 square feet in size and one (1) wall sign 142 87 square feet in size The uniform sign program is for the Redlands Crossing project, a 256,614 square foot commercial center on 45 acres located on the southeast corner of San Bernardino Avenue and Tennessee Street in the East Valley Corridor Specific Plan, Concept Plan No 4 (APNs 0167-141-01, 0167-141-02, 0167-141-03, 0167-141-04) 2 The signs shall be cared for and maintained in good condition 3 The applicant shall obtainBuilding Permits from the Development Services Department 4 All signs shall be constructed in compliance with all applicable building, electrical, and other codes in effect at the time of construction or maintenance, with particular respect to wind and seismic loads and overturning moment 5 All plans submitted to the City shall reflect the City Council approval and any other changes required by the Planning Commission, City Council, and/or staff This condition applies to the site plan and all other illustrations, text, or plans submitted to the City in connection with this project 6 Any change, modification, or revision to the sign program shall obtain the approval of the Planning Commission and/or the City Council 7 Any change, modification, or revision of signs exceeding 120 square feet shall obtain the approval of the Planning Commission and/or the City Council Pursuant to Government Code Section 66020(d), certain fees, dedications, reservations or exactions imposed by the City as a condition of approval of this project are subject to a statutory ninety (90) day protest period Please be advised that the ninety (90) day protest period for those fees, dedications, reservations and exactions which are subject to Government Code Section 66020(a) has commenced to run on the date this project was approved criteria shall be rigorously enforced and any nonconforming sign shall be removed by the Tenant or his sign contractor at their expense, upon demand by the Landlord or the City of Redlands Exceptions Underwriters Specifications" 6 All painted surfaces to have satin finish 7 Logo and letter heights shall be as specified and square footage values shall be measured per the City of Redlands Municipal Code 15 36 050 8 All sign fabrication work shall be of excellent quality All logo images and type -styles shall be accurately reproduced Lettering that approximates type -styles will not be acceptable
