HomeMy WebLinkAboutOrdinances_2867ORDINANCE NO 2867 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 10 24 OF THE REDLANDS MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF A REDUCED PRIMA FACIA SPEED LIMIT FOR LIVE OAK CANYON ROAD AND CONFIRMING PRIMA FACIA SPEED LIMITS FOR CERTAIN OTHER SPECIFIED CITY STREETS WHEREAS, an Engineering and Traffic Survey, as defined by California Vehicle Code section 627, is a survey of highway and traffic conditions conducted in accordance with methods defined in the California Manual of Uniform Traffic Control Devices, and WHEREAS, California Vehicle Code section 40802 requires an Engineering and Traffic Survey be prepared for each City street segment, every five to seven years, for the use of radar or other electronic devices to enforce speed limits, and WHEREAS, on November 3, 2015, the City Council of the City of Redlands adopted Resolution No 7583 approving the July 16, 2015 Engineering and Traffic Survey report prepared by Fehr & Peers (the "2015 Survey") for various streets within the City to update speed limits, and WHEREAS, a new Traffic and Engineering Survey was recently performed by the City's consulting traffic engineer for Live Oak Canyon Road (the "Live Oak Road Survey") which demonstrates that a reduction in the road's speed limit from fifty-five miles per hour to fifty miles per hour is justifiable and appropriate to facilitate the orderly movement of traffic, and WHEREAS, the Live Oak Road Survey and the recommendations of the City's consulting traffic engineer were presented to the City's Traffic and Parking Commission for consideration and concurrence, which recommended approval thereof to the City Council, and WHEREAS, it is the desire of the City Council to now codify within the City's Municipal Code the speed limits established by both the Live Oak Road Survey and the 2015 Survey, THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS Section 1. The City Council hereby certifies the Engineering and Traffic Survey performed for Live Oak Canyon Road conforms to the California Vehicle Code Section 2 Chapterl0 24 of the Redlands Municipal Code, entitled "Speed Limits," is hereby amended to read as follows "Chapter 10 24 SPEED LIMITS 1 11Ordmanccs\Nos 2800-2899 in Word12867 Traffic Pattern 2018 Clean.doc 10 24 010 TWENTY FIVE MILES PER HOUR, AUTHORITY TO INCREASE LIMIT 10 24 020 SIXTY FIVE MILES PER HOUR, AUTHORITY TO DECREASE 10 24 030 PRIMA FACIE SPEED LIMITS 10 24 040 BOUNDARY STREETS 10 24 010 TWENTY FIVE MILES PER HOUR, AUTHORITY TO INCREASE LIMIT A Pursuant to section 22357(a) of the California Vehicle Code, whenever the city council detennines upon the basis of a traffic engineering investigation that a greater speed would facilitate the orderly movement of vehicular traffic and would be safe upon any street otherwise subject to a prima facie limit of twenty five (25) mules per hour under the Vehicle Code, the city council shall determine and declare, by ordinance, a higher pri na facie speed limit and direct the City Engineer to erect and maintain signs upon such street as provided in the California Vehicle Code, indicating the appropriate prnna facie limit Such signs may be supplemented by appropriate pavement markings B Whenever the city council upon the basis of a traffic engineering investigation finds that the conditions, because of which a speed limit has been determined as provided in subsection A of this section, no longer exist, the city council shall by ordinance direct the City Engineer to remove such signs and markings from such street and appropriately reevaluate the speed limit 10 24 020 SIXTY FIVE MILES PER HOUR, AUTHORITY TO DECREASE A Pursuant to section 22358 of the Vehicle Code, whenever the city council determines upon the basis of a traffic engineering investigation that the prima facie limit of sixty five (65) miles per hour is more than is reasonable or safe upon any street or highway where such prima facie limit of sixty five (65) miles per hour is applicable under the Vehicle Code the city council shall determine and declare, by ordinance, a lower prima facie limit which is appropriate to facilitate the orderly movement of traffic and is reasonable and safe and direct the City Engineer to erect and maintain signs upon such street or highway as provided in the Vehicle Code indicating the appropriate speed limit Such signs may be supplemented by appropriate pavement markings B Whenever the city council, upon the basis of a traffic engineering investigation, finds that the conditions, because of which a speed limit has been determined as provided in subsection A of this section no longer exist, the city council shall, by ordinance, direct the City Engineer to remove such signs and markings from such street and appropriately reevaluate the speed limit " Section 3 Section 10 24 030, entitled "Prima Facie Speed Limits," is hereby added to engineering and traffic survey that the orderly movement of vehicular traffic would be facilitated in a reasonable and safe manner by establishing enforceable speed limits under the conditions found to exist upon the following streets It is declared that the prima facie speed limits shall be as herein set forth on these streets or parts of streets herein designated when signs are erected giving notice thereof This section does not apply to any twenty five (25) mile per hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior Redlands Municipal Code to read as follows "10 24 040 BOUNDARY STREETS In accordance with California Vehicle Code section 22359, no ordinance increasing or decreasing speed limits shall be effective with respect to boundary line streets and highways where portions thereof are within different jurisdictions, until all authorities having jurisdiction of the portions of the street concerned have approved the same " Section 5.
