HomeMy WebLinkAbout7890RESOLUTION NO 7890 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF REDLANDS SUPPORTING PROCEEDINGS FOR A SPHERE OF INFLUENCE AMENDMENT AND REORGANIZATION TO INCLUDE ANNEXATION OF CERTAIN TERRITORY INTO THE CITY OF REDLANDS TO CONSOLIDATE JURISDICTION OF THE ENTIRE PARCEL UNDER A SINGLE JURISDICTION, AND DETACHMENT FROM THE SAN BERNARDINO COUNTY FIRE PROTECTION DISTRICT AND ITS VALLEY SERVICE ZONE AND COUNTY SERVICE AREA 70, AND RESCINDING RESOLUTION NO 7770 WHEREAS, the City of Redlands desires to express support for proceedings pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, con nencmg with Section 56000 of the California Governinent Code, for 1 A sphere of influence amendment for the westerly 0 764 -acre portion of the subject property located at the northwest confer of West Lugonia Avenue and Tennessee Street (APN 0167-171-13-0000) (the "Property") that hes outside the City boundary, and 2 A reorganization proposal to include, but not hunted to, annexation into the City of Redlands and detachment from the San Bernardino County Fire Protection District and its Valley Service Zone and County Service Area 70 for the Property, and WHEREAS, the Property owner intends to file an application to initiate proceedings with the Local Agency Formation Commission for San Bernardino County ("LAFCO"), and WHEREAS, a snap and description of the Property proposed to be annexed to the City of Redlands is attached hereto as Exhibit "A" and Exhibit `B" and by this reference incorporated herein, and WHEREAS, the territory proposed for sphere of influence amendment and reorganization is legally uninhabited, and a description of the boundaries for all actions is set forth in the Property owner's application, and WHEREAS, the Property is designated for Commercial land use on the City's General Plan Land Use Map, is designated as Commercial General (EV/CG) zone in the East Valley Corridor Specific Plan within the City's jurisdiction, is pre -zoned as Commercial General (EV/CG) zone, is not prime agricultural land, is designated for urban growth in the City's General Plan, and the surrounding area is substantially developed or developing, and WHEREAS, on August 8, 2017, the Planning Commission recommended to the City Council that the proposal including initiation of a sphere of influence amendment and reorganization proceedings be approved, and 1 I \Resolutions\Res 7800 7899/7890 support of Annexation LAFCO.doc WHEREAS, the proposed reorganization will not conflict with any existing sphere of influence as the proposed change includes an amendment to the City's sphere of influence to accommodate the proposed reorganization, and WHEREAS, it is desired that the proposed sphere of Influence amendment and reorganization be subject to the following terms and conditions 1 The Property is proposed for sphere of influence amendment and reorganization to consohdate jurisdiction of the entire parcel under a single jurisdiction An ordinance pre -zoning the Property to East Valley Corridor Commercial General (EV/CG), a resolution for a General Plan Amendment to designate said portion as Commercial on the General Plan Land Use Map consistent with the remainder of the Property (easterly 0 966 acre portion currently within the City), and a resolution for a Specific Plan Amendment to designate the Property as East Valley Corridor Commercial General (EV/CG), were approved by the City Council on September 5, 2017, ii support of the proposed reorganization, 2 The City shall assume all rights, duties, responsibilities, obhgations, functions, executory provisions related to inumcipal services including police and fire protection, except as otherwise outlined in the conditions of approval unposed by LAFCO, 3 The Plan for Service included with the application outlines the general approach and parameters for delivering fire protection, police, and other municipal services to serve the Property within the City, 4 The standard terms and conditions imposed by the LAFCO upon all proposals or such additional conditions as may be deemed appropriate or necessary by LAFCO in its consideration, and WHEREAS, the reasons for the proposed sphere of influence amendment and reorganization are to consolidate the subject property under a single jurisdiction and to provide effective, safe, and financially efficient municipal services to the Property, and WHEREAS, adoption of this Resolution is not subject to envi-omuental review under the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines Section 15061(b)(3), as the City has determined there is no possibility of any environmental effects, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION I The City Council hereby rescinds Resolution No 7770 SECTION 2 The City Council hereby determines that the adoption of this Resolution is exempt from environmental review under CEQA (Public Resources Code §21000 et seq ) pursuant to State CEQA Guidelines (Cal Code Regs , §15000 et seq ) Section 15061(b)(3) SECTION 3 The City Council supports the Property owner's proposed sphere of influence amendment and reorganization as described in the Property owner's application, in the manner 2 I Utesoluhons\Res 7800-789917890 Support of Annexation
