HomeMy WebLinkAboutContracts & Agreements_47-2018A City of REDLANDS Incorporated 1888 35 Cajon Street Redlands, CA 92373 AGREEMENT FOR PRELIMINARY ENGINEERING SERVICES AND SUBMITTAL OF EXHIBIT "A" FOR RAILROAD APPROVAL March 20, 2018 Public Crossing Alessandro Road State CA City Redlands MP 0548 27 YUMA Subdivision Alessandro Road / DOT # 747221T San Bernardino County Nick Vineyard Track Supervisor Western Region Union Pacific Railroad Company 2015 S Willow Bloomington, CA 92316 Dear Mr Vineyard Plans are being prepared by the City of Redlands ("City") to establish a Quiet Zone (the "Project") at the location referenced above The proposed Project includes channelizing devices and warning signs In connection with the Project, the City considers it necessary for the successful advancement of the Project for Union Pacific Railroad Company ("Union Pacific") to collaborate in the development of the Project by performing the following • preliminary engineering and other related services • development of cost estimates • review of the Project's preliminary layouts • submit current train and switching moves The City authorizes and agrees to reimburse Union Pacific for its expenses and actual costs that are incurred for collaborating in the development of the Project's preliminary engineering and other preliminary activities Union Pacific has estimated that these preliminary engineering and other preliminary costs will be $25,000 Payment will be made within thirty (30) days from the City's receipt and approval of Union Pacific's written request for reimbursement Union Pacific will refer to City's Project Number, JL 47108, and forward invoices to Joseph Long Additionally, attached for Union Pacific's review and approval is one (1) set of half -scale prints of the concept plans marked Exhibit "A," which are the thirty (30%) complete plans and show the basic features of the proposed Project at the location referenced above Please review and provide comment on the basic features in Exhibit "A" as soon as possible The Project may require Union Pacific to incur costs for force account activities Please prepare Union Pacific's force account cost estimate for work activities to be provided by your company, as identified in Exhibit "A", and submit that cost estimate at your earliest convenience so that it may be attached to Union Pacific's proposed Construction and Maintenance agreement Please verify the number of current regular train (34) and switching movements (0) with a maximum speed of 50 mph at this location as currently shown in our inventory records This information will be used by the City's contractor to obtain Railroad Protective Liability Insurance This agreement is intended to address Preliminary Engineering It is understood by both parties that Union Pacific may withhold its approval for any reason directly or indirectly related to safety or its operations, property issues, or adverse effects to its facilities If the Project is approved, Union Pacific will continue to work with the City to develop Final Plans and Specifications, and prepare Material and Cost Estimates for railroad construction work associated with the Project It is also understood that if the Project is constructed, it will be at no cost to Union Pacific The City and Union Pacific will enter into separate License, Right of Entry, Construction and Maintenance agreements associated with the construction of the Project, if the Project is accepted and approved by Union Pacific The agreements will be drafted by Union Pacific, and forwarded to the City after improvements in Exhibit "A" and cost estimates have been approved Please contact Joseph Long at telephone number (909) 798-7584 x3, or via email at along@cityofredlands org, if you have any questions Your assistance in this matter is appreciated ATTEST anne Donaldson, City Clerk UNION PACIF By Name and Title RAILROAD COMPANY rCk Attachment Exhibit A Sincerely, Paul W Foster, Mayor City of Redlands 01 Date Off Sf Qroy Pro) j -L-+5 I 1, JJs+ry( F, �• � �.s,"5� 'car: �..� ,,� PLAN A v,kb'o Ile 'cry VION" MAP qE�w 8P� �,-efxr M nx• vu.
