A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING PURCHASE AND SALE AGREEMENTS FOR THE
TRANSFER OF PROPERTY AND GRANTING OF EASEMENTS FOR
PROPERTIES LOCATED AT The SOUTHEAST CORNER OF CALIFORNIA
STREET AND EASTBOUND I-10 ONRAMP (APN 0292-064-02-0000), 25865
CALIFORNIA STREET (APNs 0292-034-02, 05, & 08-0000), THE EAST SIDE
OF CHURCH STREET AND APPROXIMATELY 585 FEET NORTH OF
CENTRAL AVENUE (APN 0170-181-44-0000), CONCURANCE WITH A
SECTION 4(F) DETERMINATION FOR A MINOR ENCROACHMENT AT
THE SOUTHEASTERN CORNER OF SYLVAN PARK, AND
DETERMINATION THAT THE PURCHASE AND SALE AGREEMENTS IS
NOT SUBJECT TO FURTHER ENVIRONMENTAL REVIEW PURSUANT
TO CEQA GUIDELINES SECTION 15162
WHEREAS, the San Bernardino County Transportation Authority ("SBCTA") is
proposing to develop the Redlands Passenger Rail Project (the "Project") to extend passenger rail
service along an approximate nine-mile corridor extending east from the San Bernardino Transit
Center in the City of San Bernardino to the University of Redlands in the City of Redlands
("City"), and
WHEREAS, the Project will require the acquisition of (1) a 11,062 square foot portion
of a parcel, and (2) a 76 square foot permanent easements over portions of the property located at
the SEC of California Street and Eastbound I-10 onramp, County Assessor's Parcel Number
("APN") 0292-064-02-0000, and
WHEREAS, the Project will require the fee simple acquisition of 22,451 square portion
of the property identified as 25865 California Street (APNs 0292-034-02, 05 & 08-0000), and
WHEREAS, the Project will require the acquisition of (1) a 963 square foot fee simple
acquisition, (2) a 30 square foot permanent easement, and (3) a 1,695 square foot access
easement over portions of the property identified as the East Side of Church Street and
approximately 585 feet North of Central Avenue (APN 0170-181-44-0000), and
WHEREAS, the City is willing to approve the purchase and sale agreements for the
above referenced properties, and
WHEREAS, the City is willing to accept the total sum of Forty One Thousand Dollars
($41,000) for the acquisition of the portions of the property identified above for APN 0292-064-
02-0000, and
WHEREAS, the City is willing to accept the total sum of Fifty-Seven Thousand Three
Hundred Dollars ($57,300) for the acquisition of the portions of the property identified above as
25865 California Street, APNs 0292-034-02, 05 & 08--0000, and

WHEREAS, the City is willing to accept the total sum of Seventeen Thousand Five
Hundred Dollars ($17,500) for the acquisition of the portions of the property identified above as
APN 0170-181-44-0000, and
WHEREAS, SBCTA is requesting written concurrence with a Section 4(f) determination
for a minor encroachinent at the southeastern corner of Sylvan Park as part of the Project, which
is a federal process and must comply with National Environmental Policy Act (NEPA)
requirements relating to protection for publicly owned parks, recreation areas, historic sites, and
wildlife and/or waterfowl refuges from conversion to transportation uses, and
WHEREAS, SBCTA has previously determined that Project implementation would have
a de minimis effect on Sylvan Park and no direct use, temporary occupancy, or constructive use
of the Lawn Bowling Club with the implementation of quiet zones as outlined in Mitigation
Measure NV-3 in the Final Environmental Impact Report and Environmental Impact Statement
(EIS/EIR), and the State Historic Preservation Officer concurred with a finding of no adverse
effect for the Redlands Bowling Club and the Federal Transit Administration concluded that no
direct use, temporary occupancy, or constructive use would result, and
WHEREAS, approval of the above mentioned purchase and sale agreements does not
require further environmental review under the California Environmental Quality Act ("CEQA")
pursuant to CEQA Guidelines Section 15162because SBCTA, as the lead agency under CEQA
and the FTA, Region 9, as lead agency under NEPA, prepared an EIR/EIS for the Project which
was adopted on March 4, 2015, and concluded that no further environmental analysis is required,
and
WHEREAS, SBCTA filed an Addendum to the EIR on January 8, 2018, indicating that
the proposed Purchase and Sale Agreements and 4(f) concurrence does not trigger any of the
conditions listed in CEQA Guidelines Section 15162,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF REDLANDS AS FOLLOWS
Section 1 The City Council hereby determines that approval of the purchase and sale
agreements between SBCTA and City for APNs 0292-064-02-0000, 0292-034-02, 05 & 08-
0000, and 0170-181-44-0000 is exempt from review under the California Environmental Quality
Act ("CEQA") pursuant to CEQA Guidelines Section 15162
Section 2 The City Council hereby approves the purchase and sale agreements
between SBCTA and City for APNs 0292-064-02-0000, 0292-034-02, 05 & 08-0000, and 0170-
181-44-0000
Section 3 The City Council concurs that the Project will not adversely affect the
activities, features, or attributes that make Sylvan Park eligible for Section 4(f) protection,

determine that the Project will have a de minimis impact on Sylvan Park and the Redlands Lawn
Bowling Club, and authorizes the Mayor to execute the Section 4(o Concurrence Letter
substantially in the form attached to this Resolution as Exhibit "A"

SUBJECT Redlands Passenger Rail Project (RPRP) Section 4(f) Determinations for
City-Owned Park and Recreation Resources, Including Sylvan Park
Dear Mr Ramirez
On December 27, 2017, the City of Redlands received a letter from the San Bernardino County
Transportation Authority requesting written concurrence with an updated Section 4(f) determination for a
minor encroachment at the southeastern corner of Sylvan Park as part of the Redlands Passenger Rail
Project (project) We understand that the project has advanced to the 100 percent design stage and a
temporary construction easement (TCE) will be required at Sylvan Park to facilitate project construction
As stated in your letter, the approved project contemplated minor physical encroachments into the
southwest and southeastern corners of Sylvan Park The minor refinements to the project's design at
University Street would require an additional 793 square feet at the southeastern corner beyond that
noted in the Final EIS to facilitate the placement of a sidewalk and ramp, thereby totaling 1,533 square
feet We understand the improvements will be contained within an easement and no property acquisition
will be required
In addition to the temporary encroachment at sylvan Park, we understand the final design for the project
includes a center median in University Street that extends north of the railroad and will result in a net loss
of seven on-street parking spaces In the interim, existing parking at the main lot off Park Avenue will
compensate for this loss The City agrees that the improvement project at University Street combined with
the new parking offered at the university of Redlands Station will compensate for the loss of parking over
the long term
Similar to the approved project, the refined project would result in a temporary occupancy of Sylvan Park
for roadway improvements The temporary occupancy would be extended an additional 793 square feet,
as required for the proposed 100 percent design Once constructed the Project refinements would be
contained within a permanent easement on City property Parking lost in University Street will have no
adverse effect on the park
The City has reviewed the potential effects of the refined project at Sylvan Park and we concur that the
project will not adversely affect the activities, features, or attributes that snake Sylvan Park eligible for
Section 4(f) protection We agree that the refined project will have a de minimis impact on this
recreational resource
