HomeMy WebLinkAboutOrdinances_2608 t' ORDINANCE NO 2608 AN ORDINANCE OF THE CITY OF REDLANDS ADDING CHAPTER 3 53 TO THE REDLANDS MUNICIPAL CODE RELATING TO NON-POTABLE WATER FUND AND NON-POTABLE RATES AND CHARGES, AND AMENDING CHAPTERS 3 41, 3 52, 3 62, 3 12, 3 16 AND 13 44 OF THE REDLANDS MUNICIPAL CODE RELATING TO WATER AND WASTEWATER RATES AND WATER EQUIPMENT REGULATIONS AND SEWER CHARGES WHEREAS, at a duly noticed public meeting of the City Council of the City of Redlands {` this City Council")verbal and written testimony was presented to this City Council by the Utilities Advisory Committee, a committee appointed by the City Council and City staff, relating to the proposed revisions in the City's rates for water and wastewater service, and WHEREAS, based upon such testimony, this City Council has determined that revisions to the City's water and wastewater rates and charges are necessary to recover the reasonable costs it incurs by providing water and wastewater service to its customers,and WHEREAS,pursuant to Health and Safety Code section 5741, adoption of this ordinance requires a two-thirds vote of the members of the City Council, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1. Section 3 41 020 of the Redlands Municipal Code is amended to read as follows "3 41 020 Review of rates and charges A The City Council has formed a Utilities Advisory Committee comprised of City water and wastewater utility customers representing the various customer classes The Committee is charged with reviewing the current water and wastewater rates, charges, and revenue requirements on a biannual basis The primary goals of the Utilities Advisory Committee are the development of water and wastewater rates that provide revenues that (1) recover costs reasonably borne, (2) are equitable to all customer classes, (3) are in compliance with all State and Federal regulations, and(4) are easily explained to customers Based on the review, the committee will prepare and present recommendations to the City Council regarding rates and charges for water and wastewater service provided by the City Section 2 Section 3 52 040 of the Redlands Municipal Code is amended to read as follows "Table 3 52 040 WATER SERVICE RATE SCHEDULE BI-MONTHLY RATES POTABLE WATER RATES BEGINNING MAY 19,2005. Amounts of charges are set out in Table 3 53 040 Table 3 53 040 NON-POTABLE WATER SERVICE RATE SCHEDULE BI-MONTHLY RATES NON-POTABLE WATER RATES BEGINNING MAY 19,2005. A. NON-RESIDENTIAL MINIMUM CHARGE All Strengths $22 00 $23 84 SCHOOLS Elementary $69 90/ 100 ADA $84 00 1100 ADA Secondary and High School $1 16 50/ 100 ADA $131 00/100 ADA SEPTAGE Tank Dumping $05011 gallon $0501 /gallon $10 00 minimum $10 00 minimum 10 Section 5 Section 13 12 010(D)of the Redlands Municipal Code is amended to read as follows "D Water main frontage charge per foot shall be 6 inch non-potable water main --- twenty dollars, 8-inch potable water main- twenty-six dollars,and 12 inch potable-forty dollars" Section 6 Section 13 12 020 of the Redlands Municipal Code is amended to read as follows "Section 13.12.020 Due date A The City may use a unified billing system for City-provided services The charges for water, wastewater, and refuse service or any other City provided services,may be billed on one bill and collected as one item Failure to pay the amount due in full for any of the services may result in the discontinuation of water services B All bills and charges for service shall be due and payable upon presentation and shall become delinquent twenty-four days thereafter If the bill is not paid on, or prior to, said due date, the billing shall be considered delinquent and a late charge will be levied upon the unpaid balance as follows 1 For any account with an unpaid balance of$10 or more,a one-time charge of ten percent(10%)of the unpaid balance will be assessed, and each month thereafter the unpaid balance will be subject to an interest charge of 1 5% 2 This charge shall be due and payable immediately upon accrual C Service may be discontinued upon written notice required by law if payment of all charges are not made prior to the date such service becomes delinquent D If any owner or agent pays for water service on more than one property or unit, service may be discontinued on all properties for failure to pay on any one property Procedures and charges for restoration of service are set forth in Section 3 52 040 and 13 12 050 of this Code E Failure to receive a bill does not relieve the consumer of liability Any amount due shall be deemed a debt to the City, and any person, firm, or corporation failing, neglecting, or refusing to pay said indebtedness shall be liable in a civil action brought by the City in any court of competent jurisdiction for the amount thereof F In addition to other remedies it may have for the collection of delinquent accounts, the City may cause notice of a hearing on delinquent accounts in accordance with Government Code Sections 25831 and 38790 1 Such notice shall be mailed to property owners listed as delinquent accounts not less than ten days prior to the date of the hearing At the hearing, the City Council shall hear any objections or protests of such property owners The City Council may make such revision corrections or deletions to the report of delinquent accounts as it deems just, after which, by resolution, the report shall be confirmed The delinquent charges set forth in the delinquent account report may be placed as lien on such properties for the amount of such delinquent charges plus legal fees and administration costs A certified copy of the confirmed report shall be filed with the City Clerk, for the current tax roll The lien created attaches upon recordation, in the office of the County Recorder, of a certified copy of the resolution of confirmation All laws applicable to the levy, collection,and enforcement of City ad valorem property taxes shall be applicable to such liens" Section 7. Section 13 12 050 of the Redlands Municipal Code is amended to read as follows "13 12 050 Turning on and off of water supply A A charge to establish a new account will be collected by the City The amount shall be established pursuant to Chapter 3 52 of this Code B Upon request the City will shut off the water supply without charge for emergency purposes, and it is understood that the City will turn on the water supply after repairs have been made C If the service must be discontinued for nonpayment of bill(s) a charge as set by Chapter 3 52 of this Code will be made by the City which must be paid in frill prior restoration of service, including the minimum amount of prepayment as set by Chapter 13 12of this Code in the event any previous prepayments have already been applied 11 D If a City representative is prevented from discontinuing service, or if service is turned back on by anyone other than an authorized representative, the City may take any further steps it deems necessary to affect the disconnection and prior to the restoration of service, all delinquent charges and applicable miscellaneous charges must be paid in full before service will be restored as set by Chapter 3 52 of this Code, including the mimmum amount of prepayment as set by Chapter 13 12 of this Code in the event any previous prepayments have already been applied" Section 8 Section 13 16 010 of the Redlands Municipal Code is amended to read as follows "Section 13 16 010 Supply from fire hydrant A An applicant for temporary use of water from a fire hydrant must secure a permit therefore from the City The City shall require a pre-payment in the amount set by Chapter 3 52 of this Code from all applicants prior to issuance of a fire hydrant construction meter In the event the meter is lost or stolen,the entire pre-payment will be forfeited B Each applicant shall provide himself with a hydrant wrench necessary to operate such fire hydrant, and install a separate shutoff with restricting orifice to mimmize damage to fire hydrant and mams If a fire hydrant or a fire hydrant construction meter is damaged by the consumer's use to an extent requiring repair or replacement such repair or replacement shall be made at the consumer's expense" Section 4 Section 13 44 120(D)of the Redlands Municipal Code is amended to read as follows "D Sewer main frontage charge per foot shall be twenty-six dollars" Section 10. This ordinance shall be in force and take effect as provided by law Section 11.
