A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING COMMISSION REVIEW AND APPROVAL NO 901 TO
CONSTRUCT AN 110,549 SQUARE-FOOT ADMINISTRATIVE AND
PROFESSIONAL OFFICE BUILDING LOCATED ON THE SOUTH SIDE OF
PARK AVENUE, WEST OF NEW YORK STREET (APNs 0171-011-54-0000 &
0171-011--45-0000)
WHEREAS, an application for Commission Review and Approval No 901 for the
development of a 110,479 square-foot professional/adinulistrative office building on Assessor
Parcel Nos 0171-011-54-0000 and 0171-011-45-0000, generally located on the south side of
Park Avenue and west of New York Street, was filed with the City of Redlands by the applicant,
NYS North, LLC, and
WHEREAS, the City Council has the authority per Section IS 12 080(D) of the Redlands
Municipal Code to take action on Commission Review and Approval No 901, and
WHEREAS, on January 22, 2019, the City of Redlands Plannuig Commission held a
noticed public hearing at which interested persons had an opportunity to testify in support of, or
in opposition to, Commission Review and Approval No 901, and
WHEREAS, at the public hearing on January 22, 2019, the Planning Commission
considered, heard public comments on, and recommended approval to the City Council of a
Mitigated Negative Declaration, Socio-Economic Cost/Benefit Study, Zone Change No 460, and
Commission Review and Approval No 901, and
WHEREAS on February 7, 2019, notice of this City Council's public hearing for
Commission Review and Approval No 901 was published in the Redlands Daily Facts by the
City Clerk, and
WHEREAS, on February 19, 2019, the City Council held a public hearing and considered
the staff written and oral reports, the recommendation of the Planning Commission, the
testunony and written evidence submitted by and on behalf of the applicant, and testnnony by
members of the public for Commission Review and Approval No 901
NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as
follows
Section I California Environinental Quality Act The City Council hereby adopts the
Mitigated Negative Declaration and the accompanying mitigation monitoring and reporting
prograin for Commission Review and Approval 901

Section 2. Socio-Economic Cost/Benefit Study The City Council hereby approves the
Socio-Economic Cost Benefit Study, finding that the proposed project will not create
uiunitigable physical blight or overburden public services in the community, and no additional
information or evaluation is needed
Section 3 Findings for Commmnission Review and Approval No 901 The City Council
hereby approves Commission Review and Approval No 901 based upon the following findings,
and subject to the Conditions of Approval attached hereto as Exhibit "A" and Exhibit "B "
1 The site for the intended use is adequate in size and shape to accoanniodate the use,
and all of the i equii ed yards, setbacks, walls o7 fences, landscaping and other features
will adjust the use to those existing of per matted futui e uses of land in the neighbor hood,
The site for the proposed use is adequate in size and shape to accommodate the proposed
use The site proposes an office building with surrounding landscaping that will be
integrated into an existing parking area that occupies the western and southern portion of
the project site The project complies with development standards and requirements for
landscaping This use of an administrative/professional office building to serve as a
component of the adjacent ESRI campus is consistent with the zoning and land use
regulations
2 The site for the pi oposed use i elates to sti Bets and highways which are proper ly
designed and arnpraved to car ay the type and quantity of traffic generated or to be
generated by the pa oposed use
The site has been designed to carry the type and quantity of traffic generated by the
proposed use The project has been designed to accommodate traffic generated by the
office building, and has been analyzed in a Traffic Impact Analysis, to identify proper
mitigation for the project's potential nnpacts, which includes restriping, retiring of
signalized intersections, and payment of fair share fees The site has street frontage along
West Park Avenue which is designated as a collector street, and the applicant is required
to dedicate a portion of the street frontage and construct the right-of-way at its ultinate
width
3 The conditions set forth in the approval and those shown on the approved site plan as e
deemed necessary to protect the public health, safety and genes al welfare
The conditions set forth are deemed necessary to protect the public health, safety and
general welfare, and are provided to unplement the RMC development standards,
General Plan policies, and project level mitigation measures as identified in the Initial
Study/Mitigated Negative Declaration
Section 4 Effective Date This Resolution shall take effect upon the effective date of City
of Redlands Ordinance No 2890

CONDITIONS OF APPROVAL
Coniniission Review & Approval No. 901
1 This approval is for Commission Review and Approval No 901 to construct a 110,549 square
foot pro fessionalladnimistrative office building, three stories high, with a subterranean parking
garage and surface parking lot (total of 519 spaces), and related on-site improvements including
public and private utilities, landscaping, and lighting The project site is located south of Park
Avenue and west of New York Street (APNs 0171-011-54-0000, 0171-011-45-0000)
2 The issuance of any permits shall comply with all provisions of the Redlands Municipal Code
3 Unless construction has coinnienced pursuant to the issuance of a building permit, or a time
extension is granted in accordance with Code, this approval shall expire two (2) years from the
date of City Council approval
4 The issuance of any permits shall comply with all provisions of the Redlands California Fire
Code currently in effect
5 All plans submitted to the City shall reflect the City Council's approval and any other changes
required by staff This condition applies to the site plan, landscape plans, grading, and all other
illustrations, text, or plans submitted to the City in connection with this project
6 The applicant shall not snake any modifications or changes during construction that are in
conflict or contrary to the project's approved site design, grading plan, or landscaping plan
without first consultmg with the Development Services Director or designee
7 A copy of the approved Conditions of Approval shall be included on the cover page of the
construction plans submitted to the Building Division
8 No Certificate of Occupancy shall be granted until all conditions of approval have been satisfied
9 A lot line adjustment shall be approved and recorded to eliminate the lot line running through the
proposed building site, prior to issuance of building permits
10 Pursuant to Government Code Section 66020(d), certain fees, dedications, reservations or
exactions imposed by the City as a condition of approval of this project are subject to a statutory
ninety(90) day protest period Please be advised that the ninety(90) day protest period for those
fees, dedications, reservations and exactions which are subject to Governixient Code Section
66020(a) has connnenced to run on the date this project was approved by the City
11 The property owner and applicant and their successors and assigns, shall defend, by paying for
the defense costs of the City of Redlands (for counsel retained by the City), indemnify and hold
harmless the City of Redlands, and its elected officials, officers, employees, and agents, from
and against any and all claims, actions, and proceedings (collectively "Claims") to attack, set

aside, void or annul the approval of this Conditional Use Permit by the City, or Claims brought
against the City due to acts or omissions in any way connected to the applicant's project that is
the subject of this permit This indemnification shall include, but not be limited to, damages,
fees, costs, liabilities, and expenses incurred in such actions or proceedings, including damages
for the injury to property or persons, including death of a person, and any award of costs or
attorneys' fees In the event any such action is commenced to attack, set aside, void or annul all,
or any, provisions of this permit, or is coininenced for any other reason against the City for acts
or omissions relating to the applicant's project, within fourteen (14) City business days following
notice of such action from the City, the applicant shall file with the City a perfonnance bond or
irrevocable letter of credit, or other form of security satisfactory to the City (the "Security") in a
form satisfactory to the City, and m the amount of$300,000, to ensure applicant's perfonnance
of its defense and mdernnity obligations under this condition The Security amount shall not
limit the total indemnity obligation of the applicant pursuant to this condition The failure of the
applicant to provide the Security shall be deemed an express acknowledgement and agreement
by the applicant that the City shall have the authority and right, without objection by the
applicant, to revoke all entitlements granted for the project pursuant to this permit The City
shall have no liability to the applicant for the exercise of City's right to revoke this permit
12 All on-site utilities shall be placed underground except power poles for Imes over 66 KV Plans
shall be submitted that detail the undergrounding of all on-site utilities, subject to review and
approval by the Development Services Director, prior to issuance of building permits
13 Transformer cabinets and commercial gas meters shall not be located within required setbacks
and shall be screened from public view either by architectural treatment or with landscaping
Multiple electrical meters and panels shall be fully enclosed and incorporated into the overall
architectural design of the building(s) Backflow preventers shall be enclosed with landscaping
that will provide complete screening upon maturity The location and method of enclosure or
screening of this equipment shall be shown on the construction plans and landscape plans prior
to building permit issuance Location of said equipment shall be coordinated with appropriate
utility company (e g , Southern California Gas Company or Southern California Edison
Company) The applicant shall submit plans showing details of screening subject to review and
approval by the Development Services Director, prior to issuance of building permits
14 During the plan check review process, the Developer shall provide a lighting plan that provides
design details (light standards, bollards, wall mounted packs, etc) and illumination site
information within pathways, streetscapes, and open spaces proposed throughout the
development An electrical engineer shall prepare the site lighting and/or photometric plan
demonstrating that adequate lighting ranges will be provided throughout the development
without creating light spillover, light pollution, or conflicts with surrounding factors such as tree
locations, off-site or adjacent lighting The illumination within the parking lot shall be a
rmiumum of 0 5 foot candle and illumination along all property lines of the project site shall not
exceed 0 5 foot candle Walkway lighting shall have a maximum height of 12 feet and all
parking lot lighting shall have a maximum height of 30 feet
15 Plans submitted for plan check shall include an exterior lighting plan, including fixture and pole
designs, for review and approval by the Development Services Director or designee

16 All landscaped areas noted on the site plan shall be permanently maintained with healthy
planting material, and whenever necessary shall be replanted with suitable vegetation
17 Landscape and Irrigation Plans shall provide water use calculations on the submitted plans, and
Developer shall demonstrate compliance with the Model Water Efficient Landscape Ordinance
prior to permit issuance The plans shall be prepared by a California-licensed landscape architect
18 The Final Landscape Plans shall incorporate the following
a The landscape plan shall comply with all requirements for landscaping in pursuant to the
Redlands Municipal Code
b The landscape plans shall be detailed and show the specific distribution, size, and ainount
of each species of trees, shrubs, and groundcover,
c All plant material shall be sized so that the landscaping has an attractive appearance at
the tune of installation and a inature appearance within three (3) years,
d An automatic irrigation system shall be utilized to irrigate the site's approved landscape
design
19 The landscape architect responsible for the design of the project's landscape plan shall review
and certify, prior to a request by the applicant for a final occupancy inspection, that the installed
landscaping meets the specifications of the approved landscape plan, except as modified in the
conditions of approval
20 Compliance with Project-specific Water Quality Management Plan (WQMP) Recommendations
is required Prior to the approval of grading and/or building permits, the applicant shall provide
evidence to the City for review and approval that project structures, features, and facilities have
been designed and will be constructed in accordance with the recommendations cited in the
project-specific WQMP
21 Compliance with City Municipal Code Chapter 8 06 090F (Noise Disturbances Prohibited) and
Chapter 8 06 120 (Exemptions)
22 Developer shall comply with all Mitigation Measures (repeated in the following conditions) and
related requirements as identified in the Initial Study/Mitigated Negative Declaration and
Mitigation Monitoring/Reporting Program prepared for the project Prior to issuance of any
building and engineering/grading permits to construct the project (unless otherwise specified by
the mitigation measure), Developer shall provide sufficient information to the Planning Division
to ascertain compliance with applicable conditions/mitigations
23 HAZ-1 In accordance with National Einissions Standards for Hazardous Air Pollutants
(NESHAP) guidelines, an asbestos evaluation shall be performed on onsite underground utilities

proposed for removal that are known or suspected to have been constructed prior to 1980 If
asbestos-containing materials (AGMs) are detennlned to be present, the materials shall be abated
by a certified asbestos abatement contractor in accordance with SCAQMD regulations and
notification requirements Demolition and disposal of AGMs shall be completed in accordance
with SCAQMD's Rule 1403 procedures
24 HAZ-2 A Limited Phase 11 Enviroiunental Site Assessment shall be conducted at the Project
site prior to ground disturbance activities The Limited Phase 11 Environinental Site Assessment
should include a geophysical survey to identify the foriner location of the USTs and an
associated subsurface structure The Phase I1 ESA should also consist of a subsurface soil and
groundwater screen for potential contamination, which may be associated with the sandblasting
and coating activities that previously occurred on the Project site
25 NOI-1 Prior to Grading Permit issuance, the Project applicant shall demonstrate, to the satisfaction of
the City of Redlands Director of Municipal Utilities and Engineering Department or City Engineer
that construction plans and specifications include the following
• Construction contracts specify that all construction equipment, fixed or mobile, shall be
equipped with properly operating and maintained mufflers and other state required noise
attenuation devices
• Property owners and occupants located within. 150 feet of the Project boundary shall be
sent a notice, at least 15 days prior to conrirriencement of construction of each phase,
regarding the construction schedule of the proposed Project A sign, legible at a distance
of 50 feet shall also be posted at the Project construction site All notices and signs shall
be reviewed and approved by the City of Redlands Development Services Department,
prior to mailing or posting and shall indicate the dates and duration of construction
activities, as well as provide a contact name and a telephone number where residents can
inquire about the construction process and register complaints
• Prior to issuance of any Grading or Building Permit, the Contractor shall provide
evidence that a construction staff member will be designated as a Noise Disturbance
Coordinator and will be present on-site during construction activities The Noise
Disturbance Coordinator shall be responsible for responding to any local complaints
about construction noise When a complaint is received, the Noise Disturbance
Coordinator shall notify the City within 24-hours of the complaint and determine the
cause of the noise complaint (e g , starting too early, bad muffler, etc) and shall
implement reasonable measures to resolve the complaint, as deemed acceptable by the
Municipal Utilities and Engineering Department All notices that are sent to residential
units immediately surrounding the construction site and all signs posted at the
construction site shall include the contact name and the telephone number for the Noise
Disturbance Coordinator
• Prior to issuance of any Grading or Building Penmt, the Project Applicant shall
demonstrate to the satisfaction of the City Engineer that construction noise reduction
methods shall be used where feasible These reduction methods include shutting off
idling equipment, installing temporary acoustic barriers around stationary construction

noise sources, maximizing the distance between construction equipment staging areas
and occupied residential areas, and electric air compressors and similar power tools
• Construction haul routes shall be designed to avoid noise sensitive uses (e g , residences,
convalescent homes, etc), to the extent feasible
• During construction, stationary construction equipment shall be placed such that emitted
noise is directed away from sensitive noise receivers
• Construction activities shall not take place outside of the allowable hours specified by the
City's Municipal Code Section & 06 120(G), allowable construction hours are between
7 00 a in and 6 00 p m on weekdays, including Saturdays, with no activities taking place
at any tune on Sundays or federal holidays
26 TRA-1 Employ the following roadway improvements at the directly nnpacted study
intersections for both Existing Plus Project (EP)/Project Opening Year With Project conditions to
reduce peak hour delay and improve the intersections to an acceptable LOS

28 TCR-1 If human remains or funerary objects are encountered during any activities associated
with the project, work m the immediate vicinity(within a 100-foot buffer of the find) shall cease
and the County Coroner shall be contacted pursuant to State Health and Safety Code §7050 5 and
that code enforced for the duration of the project
29 TCR-2 In the event that Native American cultural resources are discovered during project
activities, all work in the immediate vicinity of the find (within a 60-foot buffer) shall cease and
a qualified archaeologist meeting Secretary of Interior standards shall be hired to assess the find
Work on the other portions of the project outside of the buffered area may continue during this
assessment period Additionally, the Participating Tribe will be contacted if any such find occurs
and be provided information and penmtted/invited to perform a site visit when the archaeologist
snakes his/her assessment, so as to provide Tribal input The archaeologist shall complete an
isolate record for the find and submit this document to the applicant and Lead Agency for
dissemination to the San Manuel Band of Mission Indians
30 TCR-3 If significant Native American historical resources, as defined by CEQA (as amended,
2015), are discovered and avoidance cannot be ensured, an SOI-qualified archaeologist shall be
retained to develop an cultural resources Treatment Plan, as well as a Discovery and Monitoring
Plan, the drafts of which shall be provided to the Participating Tribe for review and comment
a All in-field investigations, assessments, and/or data recovery enacted pursuant to the
finalized Treatment Plan shall be monitored by a Tribal Participant(s) representing the
