( "City" ) , and the CITY OF REDLANDS, a municipal corporation 6 1 ( "Contracting Agency" ) . i The parties agree as follows : 8 1. Recitals . 9 (a) City has an animal shelter and other facilities foi- io � the handling of animals. fi 11 (b) Contracting Agency Joes not have an animal shelter 12 ! or other facili"tics to handle the impounding or disposal of 13 animals. City is agreeable to 06 and assist Contracting Agency 14 Wy impounding, caring for and disposing of animals delivered to 15 ithe Animal Shelter by residents of or official representatives of 16 i, Cont``,racting Agency according to the provisions of this agreement . 17 2. 1 mx)c-,u-t-i d of Animals . City shall, through Ig jts Animal Control Department, accept, impound and dispose of 19 Kogs, cats or other animals, which are delivered to City ' s An - ima tt 20 iShelter pursuant to this agreement . Such animals shall includ( 21 i! all animals brought to the City Animal Shelter by an agent, 22 ', ofticer, or emplayee of Contracting Agency, and all cats and loose ! 23 lor stray dogs brought to the City Animal Shelter by anyone fro!-,[ 24 Within the incorporated area of Contracting Agency. Each person 25 Ijdelivering an animal shall sign a stub or delivery sheet . City IE ',, shall, for and on behif of Contracting Agency 26 , pursuant to 27 applicable laws, humanely !ill , release to the owner, or otherwis.e, 28 Wispose of all �ninals rcceived. After the 6 i72 hour period has elapse?, City is authorized to dispose of the 7 ; dog or cat in any manner permitted by law, including City ! ordinances . 9 3, Hold Harmless. Contracting Agoncy shall indemnify, 10 defend and hold harmless City, its officers, agents and employees 11 from. any liability or claim arising from the performance of any of Q the provisions of this agreement. 13 4. Paympl. Contracting Agency shall pay to City the sum of 14 "12, 219 for the period July 1 . 19BI through june 30, 1982 for services 15 ' provided for in this agreement. Such compensation shall 16 iconstitute full payment for such services except as specified in 17 this agreement. Payment will be rade in monthly installments of 18 lione-twelfth of the full amount . Contracting Agency shall pay to 19 'City, as additiona! compensation, the sum of $12.00 for each dog i 20 [lin excess of 1050 dogs delivered to the City under ms r the terof 21 lithis agreement during the perd july 1, 1981 through June 30, 11 22 ![, 1982. Contracting Agency shall pay to City, as additional 23 [ compensation, the sum of $7. 00 for each cat in excess of 30 cats , delivered to the City un6er the terms of this agreement. 24 i 1 25 !Additionally, Contracting Agency shall pay to City for livestock 26 janimals delivered to the City under the terms of this agreement I 27 ! the following fees: 28 ii -2- DAILY BOARD & CARE VARGE LIVESTOCK $4.00 3 'Over 500 lbs. YHorses, Mules, Donkeys, 4 'Cattle) 5 IMEDIUM LIVESTOCK $3 . 00 125 to 500 lbs. 1 6 I (Goats, Sheep, Pigs) 7 SMALL LIVESTOCK $2 .CO 25 lbs. or less (Rodents , Rabbits, Chickens, Geese) . 9 1() Wity shall present a bill on or before the tenth day of each month 11 jor the amount due which said bill shall be paid by Contracting i 12 Agency not later than the last day of the month in which bille6 . 13 5. Voluntary Disons- 1 City is authorized to accept a dog 14 Wr cat from ito bon= , fide owner residing within the incorporated area of Contracting Agency. In such cases no charge shall be made 15 16 Tagainst Contracting Agency for its disposal and the dog or cat 17 ishall not be included in the total number of dogs or cats computed 18 ipurtivant to Paragraph 4 of this agreement . City may charge the 19 jowner a fee not to exceed the fee City charges its own residents 20 ' for similar services . 6- City officers, agents or employees shaj 21 22 lbe deputized and authorized to collect Contracting Agency' s 23 Ilicense, apprehension, shelter, and related penalty fees at the 24 Animal Shelter, as directed by Contracting agency, for all animals 25 Aeceived under this agreement. City officers, agents, or 26 : employees shall also collect the requisite sums for rabies 21 !vaccinations where required . Such license forms and receipt boo& 29 as m av be deemed necessary by Contracting Agency will be furnished I 1ko City by Contracting Agency. 2 7. Funds Collected I Rabies vaccination deposits 3 Whall be retained ynho by Cit , and sall be the de its? 1 1 ,I !ulx)n presentation W proof of vaccination . Fees for voluntary 5 Wisposal of dogs or cats shall be retained by City. All other 1 6 Lonies coiIected by City for Contracting ASency in connection wit-in 7 Whis agreement shall be deposited in the City Treasury and shall 8 paid to Contracting Agency on or before the tenth day of each 9 6onth for the month preceding. 10 S. Term. This agreement shall be for a term of one year 11 1conn-Liencing july 1, 1921 , 12 j 9. Termination. This agreement may be terminated by either 13 !party upon 30 6ays notice. In the event of termination, the 14 lContra `ti ng Agency' s compensation to City shall be prorated to 15 Ireflect the period during which the agreement is in effect. 16 IN WITNESS WHEREOF, the parties have executed this agreement 1P G 17 Ion the date first hereinabove written.
