1. Parkies. This permit �s issued �his 26 day November, 20'f 8 ("Date of
issuane�") by the City of Redlands (hereinafter"City") to Pafrick Allan Rogers
(hereinafter referred fo as "Permittee")..
2. Tie-Down Area Identified. City permits Permittee �se of the aircraft tie-down
space at Red[ands Municipal Airport as fo[lows:

Term. The term af this permit sha[I commence on �he Date of [ss+�ance by City and
sha11 contir�ue thereafter for the period of one year, unless earlier terminated by City.
4. Fees. Fees for the tie-down space st�all be fifteen dollars ($'�5.a0} per day or
any portion of a day, payable in advance of each day or portion of a day such tie-down
space is requested, andlor forty-three and 501100 ($43.50) per month, payabl� in
ac�vance, commencing an the Date of Issuance af this permit and confinuing day ta day,
ar�d/or if a monthly permit is selected, monthly thereafter. [n the al#ernafive, Permittee
may pay an annuai fee, in advance, in the amount of four hundred seventy-eighfi anci
501100 dol[ars ($478.50) with the understanding that, should this permit be revoked and
terminafied prior to one year, the fees will be pro-rated on a monthly basis. Should this
permit commence on a day other than the first day of a calendar month, minimum
manthly rent for that parkial calendar month shalf be Pro-rated af th� rate of one and
4511 p0 dollars (�'i.45} per day, to and including the last day af the partial ca[endar
month, payable on the day the permit commences.
5. �.ate C�arges_ for__Monthly/Annual Permit. Permittee acknowledges tha� fate
payment wil[ ca�se City to incur cer�ain administrative costs. Such cosfs inc[ude,
without limitation, processing, accoun#i�g and interest charges. Therefore, if any fee
paymenfi due from Permittee for a manthfy andlor annual perm�t is not received by the
tenth day nf each month, Permittee sl�afl pay to City an additional sum equal to twenty-
five percent {25%) of fhe monfhly tie-down fee as a late charge. Payments shall b�
made payable to the City of Redlands and may be mailed fo City Treasur�r, PO Box
3005, Redlands, CA 92373.
6. Securitv Deposit. Prior to the cammencement of the term of any mor�thly or
annual permit, Permitte� shall furnish City with a check or cash deposit, in the amount
of forty-three ar�d 501100 dollars ($43.50) which amaunt equals one (1) month's permit
payment fo be used by City in the e�enfi that Permittee �s in default of any fee payments,
or any of the pro�isions of this permit. If and wher� P�rmittee pays one year's tie-down
fee in advance, no deposit shall be required.
If Permitte� defaults or any of the provisions of this permit, City may use, apply ar
r�tain the whale or another sum of �his security for the payment of any unpaid fe�s or
�or any other costs which Cifiy may incur by reaspn of Permittee's default. S}�ould
Permittee fu[ly and �aithfuliy comp[y with all of the terms, provisions, covenants and
conditions of this permit, the security or any balance of the security shall be returned ta
Permittee af the expiration af this permif.
7. Attorne_ys'_Fees. ln �he e�ent any lega! actian is commenced �o enforce or
interpret any term or condition of this permit, the pre�aiiing party in such acfion, in
additian to costs and ar�y other relief, shall be �ntitl�d to its reasonable attorneys' fees,
incfuding fees for use of in-F�ouse couns�l.
8. InsUrance. [f this permit is on a mon#hly andlor annual basis, Permittee shall
secure and maintain in force throughoufi the duration of #his Permit gen�ral aviation
liability in the amount o� one million dollars {$1,p00,p0�) ��r occurrence for public
liability, property damage and persanal injury. Permitt�e shall provide City with a
certificate of insurance and obtain an �ndorsement that City shafl be named as an
addifional insured prior to occupying the tie-down space.
9. Ho[d Harmless. Permittee shall defend, indemnify and hald harml�ss Cify,
ifs elected officials, officers, employees and agertts, fram and against any and ail
actions, claims, demands, lawsuits, lasses and liability for damages to persons or
property, incfuding casts and attom�ys' fees, thaf may be asserted or claimed by any
person, firm, entify, corporation, po[itical subdi�ision or other organizatian arising out af
ar in cann�ction wi�h Permittee's negligent andlor intentionally wrongful acts or
omissions under this Permit; but exc[udir�g sUch actians, claims, demands, lawsuits and
liability for damages to persons or property arising from the sole negligence or
intentionally wrongful acts of City, its nff�cers, empfoyees ar agent.
'10. Re[ease. Permittee hereby �oluntarily releases, discharg�s, waives and
refinquishes any and all actions or causes of acfion it may have for personal injury,
proper�y damage or wrangful death occurring to them arising as a result of the fease o�
the aircraft tie-down space at Red[ands Munici�al Airport, ar�d any activifiies incidental
there�o, wherever or howe�er the same may occur. Further, Permittee daes, for itse[f,
ar�d its employees and their heirs, executars, administrafars and assigns, her�by
release, waive, discharge and relinquish any action or causes of action, which may
hereafter arise for Permittee and City's �mPloyees' estates, and agrees that under no
circumsfances wili Permittee or its heirs, executors, administrators ar�d assigns
prosec�te or present any claim for personal injury, property damage or wrongful death
against the City of Rediands or any of its efected officiafs, o�ficers, agents or emplayees
for any of said causes of action, whether the same shall arise by the n�gligence of the
above said persons, or atherwise.
IT IS THE INTENTI�N OF PERMITTEE BY TH1S INSTRUMENT TO ASSUME ALL
RISKS ATTENDANT WITH ITS ACTiVITIES OF TYING DOWN ITS AIRCRAFT AT
THE REDLANDS MUNICIPAL AIRPORT AND TO EXEMPT AND RELIEVE CITY
FROM LIAB[�1TY FOR PERSONAL 1NJURY, PROPERTY DAMAGE AND WR�NGFUL
DEATH CAUSED BY NEGLIGENCE.
11. Conformance with Law. Permittee shal] abide by all laws, rules and
regulatians o� the Federal A�iation Administration, the State af Caiifornia, Ci�y and all
public authorifiies ha�ing jurisdiction over operations at the Redlands Municipal Airport.
12. Acceptance of,Ti�,-,Down,.S.pace_Permittee accepts the aircraft tie-down
space and tie-dawn equi�ment provided by Cify and agrees to properly use the
equipmenf to secure hislher aircraft.
'[3. Maintenar�ce of Tie-Dawn Space. Permit�ee shall main�ain the tie-dawn
space in a neat, clean, orderly and sanitary condition at afl �imes.

the public safety and welfare.
�5. Use of Tie-Down Space. No person, parknership, firm ar corPoration shall
conduct any commercial act[vity or business of any kind at �h� Redlanc{s Municipal
Airport wit�out firs� �btaining th� writt�n consent af Cify to conduct such b�asiness or
cammercial acti�ity.
1 fi. Aircraft Repair and Mair�tenance. Only minor main�enance is allowed in th�
tie-down space. Majar maintenance is authorized in other areas of the Red{ands
Municipal Airport.
17. Continuance and Termination. This permit may be revaked and terminated
by City for a day permit, �apon fo�r (4} hours prior written notice; to Permittee and far a
monthly or annual permit, upon thirty (30) days prior written notice to Permittee;
provided, however, that when Permittee is in default of any provision of this permit, City
may revoke and immediately terminate this permit.
18. Nontransferable Permit. Permittee shall not transfer this permit to any other
person or entity, voluntarily or involuntarily, and no such transfer shall be binding upon
City. Any attempted transfer shall immediately result in termination of this permit.
19. Tie-Down Space Limitations. Each tie-down space is limited to the assigned
aircraft, or the vehicle that the pilot used in arriving at the tie-down space. No other
items will be allowed to be parked or stored in the tie-down space.
20. Acknowledqment. Permittee hereby acknowledges it has read and
understands the terms and conditions of this permit.
� 21. No Interest or Estate. Permittee agrees that it does not have and shall not
claim at any time any interest or estate of any kind whatsoever in its use of a tie-down
space.
