HomeMy WebLinkAboutOrdinances_2887 ORDINANCE NO. 2887 AN ORDINANCE OF THE CTTY OF REDLANDS AMENDING CHAPTER I22 OF THE REDLANDS MUNICIPAL CODE RELATING TO FINES AND PENALTIES ASSOCIATED WITH ADMINISTRATIVE CZTATI4NS THE CITY C4UNCIL OF THE CITY O�' REDLANDS DOES ORDAJN AS FOLLOWS: Sectiozl l. Section 1.22.�60 0�the Redlands Munzcipal Code, entitled "Fines," is hereby aznended to read as follows: "1.22.050: FINES: Fines shall be assessed in the a�nounts specified by resolution or ordinance of the city councii or, where no az�ount zs specified, iza the follawing azx�ouz�ts: A. Any violation of thzs code tl�at is punisl�able as an znfraction shall be subject to a fine ui�Ile following ainoun�s: 1. A fine no� exceeding one hundred dollars ($l OQ.00} per code provisian, condi�io�l of appraval afperinit or entitleinent, coi�dition of envirorunental review, or city ab eeinenfi violated �'or�he first adaninistrative citatian; 2. A fine not exceedi�lg two hundred dollars {$200.00) per code provision, condition of approval o�pezxnit or en.title�nent, condition of enviraz�nental review, or city agreeinent violated for a seco�ld adinmistrative citation far violation of the saine code provisioi�issued within a twelve (12,) month period; and 3. A fine not exceeding five hundred dollars {$500.00) per code provision, conditian of approval of perrnit or entitlement, condition of enviroru���ntaI revievv, or city agreement violated in any subsequent adininistratzve citatian issued for violatian of t��e same code provision within a twelve{12) xnontl�periad B. Any violation of this code, condition of approval of perini� ar entitlement, canditian of enviroiunentai review, or city agreeinent that is pualishable as a Fnisdeznea�lor s�iall be subject to a fine i�ot to exceed o�le thousand dollars ($1,000.00) per code�rovision vioiated. C. Notwztl�standing any other provision of this Code, a violation of aily City building and safety code determined to be an infraction is punisl�able by the followr�zg: 1. A fine no� e�ceediur�g one hundred thirty dollars {�130.00) for a first violatioi�; 2. A fine not exceeding seven hundred dollars ($700.00) �or a second vialation withi�i a twelve (12) monfl�period afthe first vialation; and 1 I:IOrdinanceslNos 2800-2899 in Wvrd12887 Corrected Atnending Chapter 1.22 Clean.docx 3.(a) A fine of one thousand three hundred dollars ($1,300.00) for a third violation within twelve (12) months ofthe first violation; and (b) A fine not exceeding two thousand five hundred dollars ($2,500.00) for each additional violation ofthe saine code provision within twenty four (24)months ofthe first violation ifthe property is a coirunercial property that has an existing building at the time of the violation and the violation is due to failure by the owner to remove visible refuse or failure to prohibit unauthorized use of the property. D. Any person or entity subject to a fine pursuant to subsections A2 and A3, and C2 and C3, of this section 1.22.060 may seek a hardship waiver to reduce the ainount of such fine by filing an appeal of the administrative citation u1 accordance with section 1.22.080 of this Chapter and tlie amount of the fine unposed thereby, aild by submitting concurrently with such appeal tlle ulformation required by section 1.22.090 D of this Chapter and written documentation showing that the responsible party for the violation has tnade a bona fide effort to comply after the first violation, and that payinent of the full aznount of tl�e fine would iinpose an undue fuzancial burden on the responsible party. Notwithstanding the provisions of section 1.22.080 of this Chapter relating to appeals of administrative citations, no advance deposit shall be required for such appeal if only a reduction in the amoun� of the fine is being sought, and the underlying violation of tl�e admulistrative citation is not being contested." Section 2. The Mayor shall sigz� this ordinance and the City Clerk shall certify to the adoption of this ordii�ance and shall cause it, or a suininary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this orduiance shall take effect as provided by law. ��� Paul W.
