MAIN'T'ENANCE AND OPERATION AGREEMENT
The County of San Bernardino agrees to install fire hydrants using Community
Development Block Grant funds and connect to water lines owned by the city
of Redlands in the Mentone Target Area and the Bryn Mawr Target Area. The
city of Redlands will take ownership and title to the improvements and will
maintain and operate such improvements per the terms of the agreement.

5 THIS AGREEMENT is entered into by and between San Bernardino County, hereinafter 5

7 known as "COUNTY", and City of Redlands, hereinafter known as "CITY". 7

11 WHEREAS, the County Office of Community Development, (OCD) was established and 11

13 appointed to act as agent to administer the Federal Community Development Block Grant 13

15 Program and, 15

17 WHEREAS, the County will install fire hydrants and connect to water lines owned 17

19 by the City in the Mentone Target Area; to service the residents of the Mentone target 19

21 area; also the County will install water lines and connect to water lines owned by the 21

23 City in the Bryn Mawr Target Area, to service the residents of the Bryn Mawr Target 23

27 WHEREAS, after installation by the County, ownership and title to said 27

"Improvements", installed pursuant to this agreement, after transfer to the City shall 29

31 at all times, thereafter, be vested in the City; 31

33 WHEREAS, pursuant to the Housing and Community Development Act of 1977, County 33

35 has caused to be prepared a study entitled "Water Improvements - Mentone Target Area"; 35

37 and, "water lines replacement/fire hydrants - Bryn Mawr Target Area"; 37

39 WHEREAS, said study recommends the installation of fire hydrants; and, water 39

41 lines and/or Water Line Department; and 41

43 WHEREAS, the parties hereto, individually and separatly desire to do the 43

45 following 1) the County shall provide for the installation of the said "Public 45

47 Improvements"; and 2) the City, after the rights to ownership and title have vested, 47

49 shall provide for the operation and maintenance of the systems and shall continue for 49

51 a term in perpetuity unless sooner rescinded or terminated by agreement of the parties 51

5 SECTION I The County shall cause to be installed with Community Development 5

7 Block Grant Funds at the earliest practical date within the streets described in the 7

9 attached Exhibit "A" and "B" and including but not limited to the following: 9

23 1. Mentone Target Area. The proposed project is to install eleven (11) fire 23

25 hydrants at various street intersection locations along Mentone Blvd. from 25

33 2. Bryn Mawr Target Area. This is a multi-year water improvement project which 33

35 focuses on the installation of water mains and fire hydrants. The following 35

37 improvements are to be undertaken: Installation of 8" AC water mains along 37

39 Mayberry from the railroad tracks to Main Street, along Main from Mayberry 39

41 to First (Street is offset). Along First Street from Wittier to the rail- 41

43 road tracks, and along Juanita Street from Adella northwesterly to the end 43

56 1. The final design shall incorporate all required facilities and provide 55

5 design, nor require conformity to a specified plan or arrangement, except 5

33 SECTION 2 The County shall pay a single one time maintenance fee of two hundred 33

35 and eighty dollars ($280.00) per fire hydrant to the city, totaling $5,040.00 for 35

37 eighteen fire hydrants. Thereafter, the City shall operate and maintain said fire 37

39 hydrants at the sole expense of the City. . 39

41 SECTION 3 The "Fire Hydrants", in the Mentone Target Area, shall be operated for 41

43 the benefit of the residents of the Mentone Target Area, and the "Water Lines Re- 43
44 44
45 placement/Fire Hydrants, in the Bryn Mawr Target Area, shall be operated for the 45
46 46
47 benefit of the residents of the Bryn Mawr Target Area. 47

49 SECTION 4 The fire hydrants and water lines shall at all times be operated in 49

51 accordance with established safety standards. It shall be the responsibility of the 51

53 City when operating the fire hydrants and water lines under this agreement to provide 53

56 and pay for all personnel. 55

SECTION5 The City shall hold the County, their governing boards, officer, 1

3 agents, and employees free and harmless, excepting negligent acts and omissions of the 3

5 County, from liability for loss, damage or injury to persons or property (including 5

City property) occurring during the period that the City has jurisdiction and controls 7
9 of the operation of said water lines. 9

11 SECTION 6 If any one or more of the terms, provisions, sections, promises, cove- 11
12 12
13 nants, or conditions of this Agreement shall to any extent be adjudged invalid, unen- 13
14 14
15 forceable, void or voidable for any reason whatsoever, by a court of competent juris- 15
16 16
17 diction, each and all of the remaining terms, provisions, sections, promises, conve- 17
18 18
19 nants and conditions of the Agreement shall not be affected thereby, and shall be 19
20 20
21 valid and enforceable to the fullest extent permitted by law. 21

23 SECTION 7 This Agreement shall be dated the date of execution of this Agreement 23

25 by the last of the parties hereto that executes this Agreement and shall be effective 25

SUBJECT FIRE HYDRANT MAINTENANCE AGREEMENT WITH THE CITY OF REDS,' D8 FOR
CDBG TARGET AREAS OF MENTONE AND BRYN MAWR
RECOMMENDATION: Approve the Fire Hydrant Maintenance Agreement in
perpetuity between the County of San Bernardino and the city of Redlands
for the maintenance and operation of a water and fire hydrant system
in the Mentone and Bryn Mawr Target Areas to be funded with Community
Development Block Grant Funds tofaling $155,486.
BACKGROUND INFO 'TION: In 1979, the Board of Supervisors approved the
allocation of $155,486 for the CDBG project, Water Improvements in the
Bryn Mawr Target Area. The following improvements are to be undertaken:
installation of 8" AC, water mains along Mayberry from the railroad tracks
to Main Street, along Main from Mayberry to First Street., along First Street
from Main to Wittier, along Wittier from First to First (street is offset) ,
along First Street from Wittier to the railroad and along Juanita Street
from Adella northwesterly to the end of Juanita Street.
