HomeMy WebLinkAboutContracts & Agreements_15-1970_CCv0001.pdf A G R E E M E N T THIS AGREEMENT , between the San Bernardino Valley College, hereinafter referred to as College, and the City of Redlands, hereinafter referred to as City, is for the purpose of providing the means whereby College can be reimbursed by City for electrical energy used to operate City pumps from College electrical system. WHEREAS, the City will be operating a pumping plant within the Crafton Hills Campus of the College, and WHEREAS, it is not considered feasible to install and maintain electrical distribution system for City use separate from the College system, NOW THEREFORE, the College agrees to furnish electrical energy to the City pumping plant to be built in the campus utility area. Said energy shall be 480 volts nominal, 60 cycle, three phase and shall be available in quantity not less than 200 kilowatts on a continuous basis. It shall be the responsibility of the College to install and maintain an accurate meter capable of measuring the total kilowatt hours of energy used by the City. At the end of .each fiscal year, the College will bill the City for each kilowatt hour recorded on said meter during the past fiscal year. The charge per kilowatt hour shall be determined by the College by dividing the total monies charged to the campus by the supplier of electrical energy for the past fiscal year by the total campus consumption in kilowatt hours during the past fiscal year. -1- The City shall pay the amount billed within 45 days. It shall be the right of the City to audit the records of campus electrical consumption and billings and to have the meter to the City plant tested for accuracy. In the event any discrepancy is found, both parties agree to make the necessary corrections retroactive as far back as the discrepancy can be traced. City agrees to hold College harmless and free from any liability for any damage whatsoever resulting from the failure or inability of College to provide electricity, or resulting from any unusual activity of the electricity being supplied to City.
