HomeMy WebLinkAbout2151 oaaK5539, PAGE RESOLUTION NO. f RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF SOUTH AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING VACATION OF SAID STREET. THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows- SECTION ONE- The City Council of the City of Redlands having elected to proceed under provisions of Division 5a Part 1., Chapter 2,, Streets and Highways Code of the State of California. and having held a public hearing as provided therein, hereby Finds from all the evidence submitted that the street described in this resolution is unnecessary for present or prospective street purposes and that the public interest and convenience requires the closing of said street. SECTION TWO- The City Council, hereby orders the vacation of that portion of South Avenue described as followso All that portion of 80mfoot wide South Avenue in the City of Redlands, County of San Bernardino, State of California as shown on Map No. 1 of portion of Redlands Heights as per trap recorded an Book 5 of Maps. Page 74, records of said County, lying northerly of and adjacent to a line 35 feet from the centerline of said South Avenue and extending from the easterly lane extended of 70mfoot wide Cajon Street to the westerly lane extended of 80-foot wade Garden Street, SECTION THREE-. In the proceeding herein adopted by this City Council for the vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any tame, or from time to time., to construct, maa.n.taa.,n, operate., replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon,, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, z � m operates replace, remove, renew and enlarge lines of pipe, conduits, cables, wires,g poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines,, telegraphic and telephone lines., railroad lines, and for the distribution w transportation of electric energy, petroleum, and its products, ammonia, water, and incidental purposes., including access and right t6 keep property free from inflammable materials, and wood growth., and to otherwise protect the same from all hazards in, upon., and over the street proposed to be vacated. SECTION FOUR- The City Council hereby determines that the vacation of the street described herein is required by public interest., convenience., safety and welfare.
