HomeMy WebLinkAbout2131 RESOLUTION NO. 2131 RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF IVY STREET IS UN- NECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING VACATION OF SAID STREET. THE CITY COUNCIL OF THE CITY OF REDLANDS ordains and resolves as follows: SECTION ONE® The City Council of the City of Redlands having elected to proceed under provisions of Division 59 Part l., Chapter 2,, Streets and Highway-- Code of the State of California,, and having held a public hearing as provided therein" hereby finds from all the evidence submitted that the street described in this resolution, is � unnecessary for present or prospective street purposes and that the public interest and convenience requires the closing of said street. SECTION TWO: The City Council hereby orders the vacation of a portion of Ivy Street described as follows-, All of that portion of Ivor Street lying between Henrietta Street and Burg3-s Street in the City o?µ G_dilandsq County of Sara Beranardino9 State of California as shown on a Map of Smi.th4s Subdivision No. 3 as per plat recorded in Book 12 of Maps, Page 33,, records of said County described as f® logs Commencing at the centerline intersection of Henrietta and Ivy Streets, thence south W Ole east 30 feet, thence south 75' 594 West 30 feet to the true point of beginning which is also the intersection of the westerly right-of-way, _ne of 60 Look, wade Henrietta Street and the southerly right-of-way4f 60 foot w.zde Ivy Street as shown on said map., thence along said southerly right-of-way line of I-vy Street south 75' 599 west 441.20 feet, thence along a cu va of 70 foo", radius concave to the southwest whose initial tangent bears north lljQ Olu OWR crest through an .included angle of 5$o 597 35" a distance of 72.07 feet to a p nt on the northerly line of Ivy Street,, thence along say d northerly lineW514 " 590 east 75- feet to the intersection of the northerly right-of-way line of Ivy Street and the westerly right-of-way line of Henrietta Street,, thence along said westerly right-of-way sine of Henrietta Street south 144' 010 east 60 feet to the true point of beginning, SECTION THREE- In the proceeding herein adopted by this City Council for the vacation of the portion of street described in Section 29 the City of Redlands reserves and excepts frora the vacation 'the permanent easement and right at any time, or from time to tame,, to construct, maintain., operate,, repl,acep remove and renew sanitary sewers and storm drains and appurtenant structures in, upon,, over and across any street or part the-aof proposed to be vacated and porsua.nt to any existing franchises or renewals theraof., or otherwise,, to construct ,, maintain,, operate,, replace,, remove, renew and enlarge lines of pipe,, conduits,, cables,, w1res,, poles, and other convenient structures,, equipment and fixtures for the operation of gas pipe 13.nes,, telegraphic and telephone lj.nes,, railroad lines, and for the distri- bution or transportation of electric energy, petroleum., and its products,, ammonia,, water., and incidental, purposes,, includa..ng access and right to keep the property free from inflammable materials,, and wood growth., and to otharvise protect the same from all hazards in., upon., and over the street proposed to be vacated,, f r • t } eauK5508 PAO-91 SECTION FOUR.- The City Council hereby determines that the vacation of the street described herein is required by public interest,, convenience,, safety and welfare.
