HomeMy WebLinkAbout7962 RESOLUTION NO 7962 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS WAIVING REQUIREMENTS FOR THE DEDICATION OF RIGHTS OF WAY REQUIRED AS A CONDITION OF APPROVAL FOR A BUILDING PERMIT AT 223 W OLIVE AVENUE WHEREAS, on November 1, 2018, the Municipal Utilities and Engineering Department of the City of Redlands prepared conditions of approval for the building perinit (Permit No B18-01161) associated with the historic restoration of the Lucia Apartments (the "Apartments") located at 223 W Olive Avenue (the "Property"), and WHEREAS, a five foot dedication of right-of-way on Grant Street adjacent to the property was required pursuant to Redlands Municipal Code section 12 22 030 (a) which states that an owner shall provide an irrevocable offer of dedication for rights-of- way for any street in the City`s established street system when a building will be constructed, and WHEREAS, on January 24, 2019, the owner of the Property submitted a waiver request for requirement for the dedication of rights-of-way due to proximity of the Apartments to the proposed Property line, and WHEREAS, Redlands Municipal Code section 12 22 090 authorizes the City Council to waive dedication requirements if the City Council snakes certain determination, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redlands as follows Section 1 The City Council hereby waives the requirements for dedication of rights-of-way along Grant Street at 223 W Olive Avenue based upon the following determination I "The street fronts ig on the subject property has already been improved to the maximum feasible and desirable state, recognizing there are some such streets which may have less than standard improvements when necessary to preserve the character of the neighborhood, and to avoid unreasonable interference with existing conditions such as mature trees, walls, yards and open space," 2 "The granting of the waiver or modification will not perpetuate a hazardous or defective condition, be otherwise detrnnental to the health, safety or welfare of the residents of the city, or relieve a property owner of the obligations or requirements that have been imposed on other property or property owners on the same street," 1 I 1ResolutionslRes 7900-7999\7962-Waive Dedication Requirement 223 W Olive docx Section 2 The City Council hereby determines that approval of this Resolution is exempt review under California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15061(b)(3) which provides that CEQA does not apply if it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment ADOPTED, SIGNED AND APPROVED this 7L' day of May, 2019 Denise Davis, Mayor Pro Tenn ATTEST �)� Lv'l� nne Donaldson, City Clerk 2 I 1ResolutionslRes 7900-7999\7962-Waive Dedication Requirement 223 W Olive docx I, Jeanne Donaldson, City Clerk of the City of Redlands, do hereby certify that the foregoing Resolution was duly adopted by the City Council at a regular meeting thereof held on the this 7t' day of May, 2019, by the following vote AYES Councilinembers Barich, Tejeda, Momberger, Davis, NOES None ABSTAIN None ABSENT Mayor Foster fine Donaldson, City Clerk 3 1 1Resolutions\Res 7900-7999\7962-Waive Dedication Requirement 223 W Olive docx
