HomeMy WebLinkAbout2106 800 - PAGE 48 RESOLUTION NO,, 2106 a 'I SOLUTION OF THE CITY OF REDLANDS FINDING THAT ALL OF A CERTAIN ALLEY 1S UNNECESSARY FOR PRESENT OR PROSPECTIVE ALLEY PURPOSES AND ORDERING VACATION OF SAID ALLEY,, ALLEY VACATION NO. 30. THE CITY COUNCIL OF THE CITY OF`REDLANDS ORDAINS AS FOLLM.- SECTION ONE; The City Council of the City of Redlands having elected to proceed under the provisions of Division 59 Part 1,, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the alley described in this resolution is unnecessary for present or prospective alley (J1 purposes and that the public interest and convenience requires the closing of d alley. SECTION TW 2 The City Council hereby orders the vacation of all of a certain alley described as follows-. All that alleyin the City of Redlands9 County of San Bernardino., State of California, being 13 feet in width and lyang between Lot 7 and Lots 1, 2 and 3 of the Excelsior Tract as per plat recorded in Book 5 of Maps, page 40 thereof, extending from the westerly line of 80 foot wide Cajon Street to the westerly line of Lot 7 extended,, SECTION THREE-, In the proceeding herein adopted by this City Council for the vacation of the alley described in Section Two,, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time., or from time to time, to construct, maintain, operate, replace., remove and renew sanitary sewers and storm drains and appurtenant structures in., upon9 over and across any alley or pant thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintaan, operate, replace, removes renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures., equipment, and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of ctric energy, petroleum., and its products, ammonia, water and incidental purposes, including access and right to keep the property free from inflammable materials and wood growth, and to other- wise protect the same from all hazards in, upon, and over the street proposed to be vacated,, SECTION FOUR: The City Council hereby determines that the vacation of the alley described herein is required by public interest., convenience, safety and welfare.
