HomeMy WebLinkAbout2365 r F PAGE 78 RESOLUTION NO. 2365 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF A CERTAIN STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID STREET THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows . SECTION ONE- The City Council of the City of Redlands having elected to proceed under the provisions of Division 9 , Part 3 Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all the evidence submitted that the street described in this resolu- tion is unnecessary for present or prospective purposes and that the public interest and convenience requires the closing of said street . SECTION TWO , The City Council hereby orders the vacation of a portion of a street described as follows . All that portion in E2 T1S R3W, Terrace Villa Subdivision, recorded in Book 15 , Page 6 of Maps, records of San Bernardino County, State of California, and described in whole as follows - Commencing at centerline intersections of Ninth Street (50 feet wide) and High Avenue (60 Feet wide ) . Thence S 0°11117 " E, 30 feet , thence N 89054 ' 15" E, 45 feet to a point on southerly right-of-way of High Avenue and a true point of beginning Beginning at a point in the southerly right-of--way of High Ave , thence N 89054 , 151, E, 258 34 feet to a point in southerly right-of-wa-g of State Highway 99 , thence along the said right- of-way N 70 11123" W, 176 80 feet to a point in the northerly right-of-i,�ay of High Avenue . Thence along the northerly right- of- way of High Avenue S 89054, 15 " W 126. 74 feet to a point Thence southeasterly along a curve, with radius 70 feet , central angle 58059 ' 39" , 72 .08 feet to the southerly right-of-way of High Avenue and the true point of beginning. SECTION THREEa In the proceeding herein adopted by this City Council for vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent ease- ment and right at any time , or from time to time , to construct , main- tain, operate, replace , remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise , to construct , maintain, operate , replace , remove, renew and enlarge lines of pipe, conduits, cables , wires , poles , and other convenient structures , equipment and fixtures for the operation of gas pipe lines , telegraphic and tele- phone lines , railroad lines , and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes , indlucing access and right to keep property free BooK 6280 PAGE 79 from inflammable materials , and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR. The City Council hereby determines that the vaca- tion of the street described herein is required by public interest , convenience , safety and welfare.
