HomeMy WebLinkAbout2349 e�oK6�00 PAGF540 RESOLUTION NO. 2249 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A CERTAIN STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE t VACATION OF SAID STREET - Street Vacation No. 40 THE CITY COUNCIL OF THE CITY OF�REDLANDS hereby ordains and resolves as follows : SECTION ONE- The City Council of the City of Redlands having elected to proceed under the provisions of Division 9 , Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all the evidence submitted that the street described in this resolution is unnecessary for present or prospective purposes and that the public -interest and convenience requires the closing of said street . SECTION TWO : The City Council hereby orders the vacation of a portion of a street described as follows . All that Raortion_of Fountain Road in the City of Redlands , County of San Bernardino, State of California, lying north of Lot 1 and Lot 20, Terracina Bluff Lots , as per plat recorded in Book 9 of Maps, Page 38, records of said County ; said portion being between the westerly line of 80 foot wide Terracina Boulevard and that portion of Fountain Road closed by the City of Redlands Resolution No. 916, January 7 , 1958. SECTION THREE- In the proceeding herein adopted by this City Council for vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time , to construct , maintain, operate, re- place remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise , to construct , maintain operate, replace, remove, renew and enlarge lines of pipe , conduits , cables , wares, poles , and other conveni- ent structures , equipment and fixtures for the operation of gas pipe lines , telegraphic and telephone lines , railroad lanes , and for the dis- tribution or transportation of electric energy, petroleum, and its pro- ducts, ammonia, water and incidental purposes , including access and right to keep property free from inflammable materials , and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of the street described herein is required by public interest , conveni- ence, safety and welfare.
