HomeMy WebLinkAbout2317 f g w Room 5 98 5 PAGE 25 6 RESOLUTION NO. 2317 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF A CERTAIN STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID STREET THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands having elected to proceed under the provisions of Division 99 Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all the evidence submitted that the street described in this resolution is unnecessary for present or prospective purposes and that the public interest and convenience requires the closing of said street. SECTION TWO: The City Council hereby orders the vacation of a portion of..,_ a street described as followss That portion of Somers Street lying Westerly of and adjacent to Lots 4 , and 5 of Block 37, Addition No. 1 to Second Preliminary Map of Redlands as recorded in Book 5 of Maps, Page 4 Records of San Bernardino County, State of California described as follows: Bepinning at a point on the centerline of Somers Street distant North 33 42119" West 572.92 feet from the center lane intersection of Palm Ave. (100 feet wide) and Somers Street (60 feet wide), and Point of Beginning being a curve concave to the East and having a radius of 207.00 feet, a radial to said point bears North 88034140" East; thence Northerly along said curve through a central angle Oof00054122" a distance of 3.27 feet to a tangent lane, thence North 00 30158" West a distance of 51.57 feet along said tangent line to a line parallel to and distant 30.00 feet (measured at right angles) from said center lane of Somers Street; thence North 33042119" West along said parallel line a distance of 650.34 feet, more or less to the Southerly line of Cypress Avenue (100 feet wide); thence south 56017159 west along said Southerly lane a distance of 30.00 feet; thence South 33 42119" East along the center hose of Somers Street a distance of 696.25 feet, more or less, to the Point of Beginning. SECTION THREE: In the proceeding herein adapted by this City Council for vacation of the street described in Section 29 the City of Redlands reserves and excepts from the vacation the permanent easement and right at any tame, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing fran- chises or renewals thereof, or otherwise, to construct, maintain, operate, replace remove, renew and enlarge lanes of pipe, conduits, cables, wares, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water 26 and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of the street described herein is required by public interest, convenience, safety and welfare.
