HomeMy WebLinkAbout2300 eoau505 Pa405 "r,01 RESOLUTION NO. 2300 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF KANSAS STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET .PURPOSES AND ORDERING THE VACATION OF PORTION OF SAID STREET. The City Council of the City of Redlands hereby ordains and resolves as follows. SECTION ONE: The City Council of the City of Redlands having elected to proceed under provisions of ➢ivisa,on 5, Part 19 Chapter 2, Streets and Highways Code of the State of California, and having held a public hearing as provided herein, hereby finds from all the evidence submitted that the street described in this resolution is unnecessary for present or prospective street purposes and that the public interest and convenience requires the closing of a portion of said street. SECTION TWO: The City Council hereby orders the vacation of a portion of a certain street described as follows: The westerly 1/2 of Kansas Street, a street of 80 foot width, as shown on the Map of Barton Ranch recorded in Book 6 of Maps, page 19 thereof, Records of San Bernardino, lying between the southerly line of Colton Avenue, as said avenue is shown on the Map of Barton Ranch, and the northeasterly line of the 100-foot wide Atchison, Topeka and Santa Fe Railway Company right-of-way. SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, its products, ammonia, water, and incidental purposes, including access and right to keep property free from inflammable materials, wood growth, and to otherwise protect the same from all hazard in, upon, and over the portion of street proposed to be vacated. SECTION FOUR- The City Council hereby determines that the vacation of F the portion of street described herein is required by public interest, convenience, safety and welfare.
