HomeMy WebLinkAbout2230 got RESOLUTION NO. 2230 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF FRANKLIN AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID STREET. THE CITY COUNCIL OF THE CITY OF REDIANDS hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands having elected a to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all the evidence submitted that that portion of described in this resolution is unnecessary for present or prospective street purposes and that the public interest and convenience requires the closing of that portion of said street. SECTION TWO: The City Council hereby orders the vacation of that ,portion of Franklin Avenue described as follows: All of that portion of Lot 6, Block 10 as shown on Map No, l of a portion of Redlands Heights, in the City of Redlands, County of San Bernardino, State of California as per plat recorded in Book 8, Page 41, and Book 5, Page 74, records of said County, described as follows: Beginning at the intersection of the southerly line of 70-foot wide Franklin Avenue and the easterly line of 70-foot wide Garden Street; thence along said southerly line of Franklin Avenue south S$° 402 east 73.97 feet to the true point of begim-zing; thence continuing along the southerly line of Franklin Avenue south 880 401 east 232.04 feet; thence north l° 201 east 3.00 feet to the beginning of a curve concave to the north whose radius is 532 feet and whose tangent is parallel to the southerly line of Franklin Avenue; thence westerly along said curve 74.•28 feet through an included angle of $° 001, thence on a tangent north 800 401 west 65.90 feet to the beginning of a second curve concave to the south whose radius is 148.00 feet; thence southwesterly along said curve 96.04 feet through a central angle of 370 101 50" to the true point of beginning. SECTION THREE: In the proceeding herein adopted by this City Council for vacation of the street described in Section 2, the City of Redlands bOOK5751 PA reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transport- ation of electric energy, petroleum, and its products, ammonia, water, and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of that portion of street described herein is required by public interest, convenience, safety and welfare.
