HomeMy WebLinkAbout2215 b 0 0 K5714 PAGE307 RESOLUTION NO. 2215 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A PORTION OF AN ALLEY IS UNNECESSARY FOR PRESENT OR PROSPECTIVE ALLEY PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID ALLEY. THE CITY COUNCIL OF THE CITY OF'vREDLANDS Hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands having elected. 01I to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby find from all the evidence submitted that that portion of alley described in this resolution are unnecessary for present or prospective alley purposes and that the public interest and convenience requires the closing of that portion of said alley. SECTION TWO: This City Council does hereby order the vacation of a portion of an alley in Tract No. 2083 - Rogers Terrace - described as follows: All that portion of the alley in;.Tract No, 2083, Rogers Terrace, in The City of Redlands, County of San Bernardino, State of California, as recorded in Book 30 of Maps, Page 26 thereof, records of said County, described as: Commencing at the northeast corner of Lot 50 of said Tract No. 2083 said corner being on the westerly line of 50-fopt wide North Eureka Street, formerly First Street; thence along the north line of said Lot 50 west 120 feet to the beginning of a tangent curve whose radius is 10 feet con- cave to the southeast, said point being the True Point of Beginning; thence westerly along said tangent curve 15.71 feet through an included angle of 890 56t to a point on the westerly lane of Lot 50, thence along the westerly lane of Lot 50 and Lot 49 of said Tract, south Oo 041 west 67.48 feet to a point in the northerly line of Inter- state Highway No. 10, thence westerly along said northerly line 10.00 feet to a point in the westerly line of Tract 2083; thence along the westerly line of said Tract, north 00 041 east 77.47 feet; thence east 19.99 feet to the True Point of Beginning. SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of the alley described in Section 2, the City -1- booK5714 PAGE 308 of Redlands reserves and excepts from the vacation the permanent ease- ment and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, p„ wires, poles, and other convenient structures, equipment and fixtures r'Y for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water, and incidental purposes, including access and right to keep property free from inflam- mable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of that portion of alley described herein is required by public interest, convenience, safety and welfare ADOPTED, SIGNED AND APPROVED this ( day of 1962.
