BOO PAGE r RESOLUTION NO. 2207 OK PAGE653 A RESOLUTION OF THE CITY OF REDLAANDS FINDING THAT A PORTION OF AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID STREETo THE CITY COUNCIL OF THE CITY OF REDLANDS Hereby ordains and resolves as followse r , SECTION ONE. The City Council of the City of Redlands having elected to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby find from all the evidence submitted that that portion of street described an this resolution are ` unnecessary for present or prospective street purposes and that the public interest and convenience requires the closing of that portion of said street. SECTION TWO. The City Council hereby orders the vacation of that portion of Orange Avenue described as follows. Beginning at the intersection of the center line of Tennessee Street, also known as San Mateo Street, 80 feet wade, and Orange Avenue, as said intersection as shown on Tract No. 5300 as per map recorded in Book 63, Pages 13 and 14 of Maps in the office of the County Recorder of San Bernardino County} thence North 890 48' 0011 East along said eenterline of Orange Avenue 1091.79 feet; Thence South 100 22a 00" East 30.48 feet to the point of inter— section with a lane that is parallel with and distant Southerly 30.00 feet, measured at right angles , from said center line of Orange Avenue, said point also being the true point of beginning, thence South 890 481 0011 West 1040.77 feet along said parallel, lane to the beginning of a tangent curve concave Southeasterly and having a radius of 12.00 feet, said curve also being tangent at its Southerly terminus with a line that is parallel with and distant Easterly 44.00 feet measured at right angles, from said center line of Tennessee Street; thence Southwesterly along said curve through a central angle of 800 241 21S1 an are distance of 16.84 feet to the intersection with the Southerly line of said Orange Avenues thence North890 48' 00" East 1054.39 feet along said Southerly line to the intersection with the Southerly pro— longation of the aforesaid line having a bearing of South 100 4 s u 5695 PAGE 65 4 221 00" East and a length of 30.48 feet; thence North 100 22' 00" West 10.16 feet along said prolongation to the true point of beginning. SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of the street described in Section 2, the City Cj of Redlands reserves and excepts from the vacation the permanent ease— ment and right at any time , or from time to time , to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace , remove, renew and enlarge lines of pipe, conduits, cables, wires, poles , and other convenient structures , equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water, and incidental purposes , including access and right to keep property free from inflam— mable materials , and wood growth, and to otherwise protect the same from all hazards in,, upon, and over the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of that portion of street described herein is required by public interest, convenience , safety and welfare.
