HomeMy WebLinkAbout3157 O E.S1 0 " C{6I6.Fx�r4 by Ve""rTEP4 P7CORDLD MAIL TO �iC0'z _ 'Ei.'T�;i,IF�L`cFCvi7110' CITY CLFR3 e �,, CITY FALL SA11 k, t, COUNTY, U=i PIQLANDS, CALIF ^7��� ti tr 10077 UriN RESOLUTION NO. 3157 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF A CERTAIN STREET ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and re- solves as follows : SECTION ONE- The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter . 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the portions of an alley described in this reso- lution are unnecessary for present or prospective purposes and that the public interest and convenience require the closing of said portions of an alley. SECTION TWO : The City Council hereby orders the vacation of por- tions of an alley described as follows: Legal Description for Vacation of that portion of Toyon Avenue as shown on Golden West Addition Tract No. 1934 as recorded in Book 28 of Maps, Page 3, and all of Toyon Avenue as shown on Abbot Sub- division Tract No 1985 as recorded in Book 28 of Maps, Page 66 in the Office of the County Recorder, County of San Bernardino, State of California described as follows : Beginning at the intersection of the Northeast right-of-way lane of Ash Street (50 feet wide) with the Northwest right--of-way line of Toyon Avenue (30 feet wide) ; thence Northeasterly along said Northwest right- of--way line of Toyon Avenue to its intersection with the Southwest right- of-way line of Bond Street (60 feet wide) ; thence Southeasterly along the Southeasterly prolongation of said Southwest right-of-way line of Bond Street to its intersection with the Southeast right--of-way line of said Toyon Avenue, thence Southwesterly along said Southeast right-of- way line of Toyon Avenue to its intersection with the Southeasterly prolongation of said Northeast right-of-way line of Ash Street; thence Northwesterly along said Southeasterly prolongation of the Northeast right-of-way line of Ash Street to the Point of Beginning. SECTION THREE: In the proceeding herein adopted by this City Coun- cil for the vacation of the street described in Section Two, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, op- erate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, re- place, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad sour 8603 F aGE 335 lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, in- cluding access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated, SECTION FOUR: The City Council hereby determines that the vaca- tion of portions of the street described herein is required by public interest, convenience, safety and welfare.
