Box 280 14 JAN 2: an 9 22 C Redlands, CA 92373 RESOLUTION NO. 3093 C A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF A CERTAIN STREET ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and re- solves as follows. SECTION ONE The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3 , Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the portions of a street described in this resolution are unnecessary for present or prospective purposes and tnat the public interest and convenience require the closing of said portions of a street. SECTION TWO: The City Council hereby orders the vacation of por- tions of a street described as follows Legal Description for Vacating Portions of New York Street The West 8 feet of the West 40 feet and the East 8 feet of the East 40 feet of New York Street (80 feet wide) from the Northerly right-of-way line of A T. & S F Railway to the centerline of Colton Avenue (80 feet wide) as shown on "Map of the Barton Ranch" as recorded in Book 6 of Maps, Page 19 in the office of the County Recorder, County of San C Bernardino, State of California Excepting that portion within Interstate Highway 10 right-of-way as it exists on December 12, 1973 and excepting that portion within Colton Avenue right-of-way SECTION THREE: In the proceeding herein adopted by this City Coun- cil for the vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, op- erate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, re- place, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, in- cluding access and right to keep property free from inflammable materials, B00K8353 PAGE 627 and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated, SECTION FOUR The City Council hereby determines that the vaca- tion of poi:L?ons of the street described herein is required by public inLeres L, convenience, ekfeLy and weirare ADOPTED, SIGNED AND APPROVED this 15th day of January, 1974 ATTEST or of the City of R lands F �1 C erg APPROVED FOR FORM.
