Part 3, Chap- ter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the street described in this reso- lution is unnecessary for present or prospective purposes and that the public interest and convenience require the closing of said street. SECTION TWO: The City Council hereby orders the vacation of a portion of a street described as follows . Legal Description for Vacating a Portion of Highland Avenue That portion of Highland Avenue of the Second Preliminary Map of Redlands, Addition No. 1, as per plat recorded in Book 5 of Maps, Page 4, records of San Bernardino County, State of California, described as follows: Beginning at the Southeast corner of Lot 1, Tract No, 7108, as recorded in Book 102 of Maps, Pages 37 and 38, said South- east corner being 50 feet Northerly, measured at right angles from the centerline of 100 ' wide Highland Avenue; thence South 15°00 ' 00” East, 35 . 27 feet to a point on a curve concave to the Southeast and having a radius of 571,46 feet; tangent to said curve at last said point bears South 74°22 '47 ' West; thence Southwesterly along said curve through a central angle of 9°06 '00 ", 90 . 76 feet to a point of reverse curve, said curve being concave Northerly having a radius of 13 ,00 feet, thence Westerly along said curve through a central angle of 81°02 ° 36", 18,39 feet to a point on line parallel to and 32 feet Northeast from the centerline of 64 foot wide Grove Street; thence Northwesterly along last said parallel line 11.12 feet to the beginning of a curve concave Northerly and having a radius of 13 .00 feet, tangent to said beginning of curve bears South 33°40 ° 37 " East; thence Easterly along said curve through a central angle of 89°59 ' 23 `, 20 ,42 feet to a point on the South line of said Lot 1; thence Easterly along said South line 97 .00 feet to the Point. of Beginning, SECTION THREE: In the proceeding herein adopted by this City Council for the vacation of the street described in Section 2, the A 7 BOOK815 . PAGEIQ .O City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and stoLDu drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or other- wise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. SECTION FOUR The City Council hereby determines that the vacation of the street described herein is required by public in- terest, convenience, safety and welfare.
